To wit: (3) * * * Persons who are subject to an order pursuant to this section include present and prior owners, lessees, or operators of the property where the hazardous waste is located... ' (b) Ifa facility or site subject to subdivision (a) is not in operation at the time the determination is made and the department finds that the owner of the facility or site, could not reasonably be expected to have actual knowledge of the presence of hazardous waste at the facility or site and of its potential for release, the department may 'issue an order requiring the most recent previous owner or operator of the facility or site who could reasonably be expected to have the actual knowledge to carry out the actions.specified in subdivision (a). SUMMARY The subject property had previously been the site of an auto body paint shop for the past 18 years. The new tenant cannot open his new business, an indoor Antique Mall, at this site yet because the floor ~drain has accumulated hazardous levels of lead, presumably as a result of the activities of the former tenant. A bathroom sink is connected to the floor drain, and is required to be operable prior to the City Building Department issuing a Certificate of Occupancy. City Wastewater Division currently has a Cease & Desist Order on the floor drain. This Office seeks your assistance on how to proceed with issuing a Corrective Action Order to the appropriate responsible parties. Corrective action shall include proper removal and disposal of the hazardous waste from the floor drain, which is estimated to cost approximately $1,500. Please arrange a time at your earliest convenience when we can meet and discuss the issues, facts, and application of the law regarding this case. A brief summary of the case is attached. FACTS 6/13/97 WINES received a telephone call complaint t'rom DAVID ALEXANDER, the new tenant of commercial pr0~e~y located at 1020 l 9t~, St.: "floor drain inside building has petroleum odor and sludge in bottom." ALEXANDER told me he believed the tbrmer tenant, an auto body repair and paint shop DBA "Carriage Masters," may have been responsible for the materials now accumulated in the floor drain. City Directories verify that Carriage Masters auto paint shop was located at the property since at least 1981, the oldest directory available in our office. WINES referred the complaint to Public Works Wastewater Division because the floor drain was presumed to be connected to the City sewer system. 6/17/97 LARA KIMM, Wastewater Inspector, obtained water sample from floor drain and had it analyzed for metals. Only lead exceeded the City's discharge limit. 6/26/97 Cease & Desist Order issued by Wastewater to property owner, GLORIA STEWART. The order read, in pertinent part, "The preliminary results of our sample analysis shows the lead concentration as 1.4 mg/L. The City limit for lead is 0.90 mg/L.* * * You are required to cease and 'desist all discharge from this sump until you can meet the City discharge limits." 7/17/97 Notice to Comply issued by WINES to STEWART to have the sludge in the floor . drain analyzed to determine if the solids are a "hazardous waste" pursuant to Section 66262.11 of Title 22, California Code of Regulations (22 CCR). 8/5/97 . WINES received telephone call from Ms. MARIAN SHAW, Civil Engineer with Public Works, requesting status of complaint investigation. SHAW said that Councilwoman PAT DeMOND has been contacted by ALEXANDER complaining of City's actions regarding the Cease & Desist Order and Notice to Comply with hazardous waste determination. 8/12/97 BC LABS, under contract with STEWART, obtains sample of floor drain sludge for hazardous waste analysis. WINES witnessed the sample collection under valid chain-of-custody. Photographs in file. 8/21/97 Channel 23 News reporter Martha Millan airs a story concerning the subject property as possibly being the original homestead site of Col. Baker. 8/25/97 BC LABS faxes results of hazardous waste analysis to WINES. Sludge in floor drain exceeds Soluble Threshold Limit Concentration value for lead listed in 22 CCR 66262.24, and is therefore considered a "hazardous waste" in California. STEWART meets with WINES to discuss the laboratory results. WINES informs STEWART that an opinion is being sought from the City Attorney's office regarding issuing a Corrective Action Order to the proper responsible parties. Dear Ms. Stewart: Recently the City of Bakersfield, Office of Environmental Sewices made a referral to our Wastewater Division regarding the sump connected to the City sewer system located on your property. We inspected the sump on 6/17/97 and sampled the liquid layer in the sump. The preliminary results of our sample analysis shows the lead concentration as 1.4 mg/L. The City limit for lead is 0.90 mg/L. Therefore, you are in violation of the City limit for lead under Bakersfield Municipal Code (BMC) Section 14.12.220~ You are required tO cease and desist all discharge from this sump until you can meet the City discharge .limits. Please contact the City of Bakersfield, Office of EnvirOnmental Services at (805) 326-3979 for information on pumping and disposing of the contents of this sump in accordance with state and federal regulations.
