A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADOPTING DRAINAGE PLAN FOR RIVERLAKES RANCH
PLANNED DRAINAGE AREA AND MAKING FINDINGS
RELATIVE THERETO.
WHEREAS, pursuant to Section 66483 of the California Government Code, this
Council is, upon the making of specified findings, authorized to adopt drainage
plans for local and neighborhood drainage areas, and;
WHEREAS, the Council approved Resolution No. 3092 which adopted the Rancho
LaBorde Planned Drainage Area on the 25th day of March, 1987, and;
WHEREAS, the Council approved Resolution Nos. 80-90 and 81-90 which adopted
the General Plan Amendment 1-90, Segment III and the Riverlakes Ranch/Unibell
Specific Plan Amendment, respectively, on the 27th day of June, 1990, and;
WHEREAS, the Conditions of Approval for Resolutions 80-90 and 81-90
required a modification to the fee structure of the Rancho Laborde Planned
Drainage Area due to changes in land use within the Planned Drainage Area.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:

The above recitals are true and correct.
Subdivision and development of property within the Riverlakes Ranch
Planned Drainage Area (formerly known as the Rancho LaBorde Planned Drainage
Area), as shown on the map attached hereto and incorporated herein by reference
as Exhibit "A", will require construction of facilities described in the
Riverlakes Ranch Drainage Plan, attached hereto and incorporated herein by
reference as Exhibit "B".
3. The fees mandated by such Drainage Plan are fairly apportioned within
the such Planned Drainage Area on the basis of benefits conferred on property
proposed for subdivision and on the need for such facilities created by the
proposed subdivision and development of other property within such area.
4. The Riverlakes Ranch Planned Drainage Area is hereby adopted.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by

The total estimate of $1,995,787 for constructing PDA facilities will be distributed between Area 1, Area
2, Area 3A and Area 38 to determine a per acre fee. Refer to the enclosed Fee Area Map. The following
paragraphs describe the basis of determining the fees.
A portion of the PDA facilities have been constructed with funds from Assessment District 86-2. As
indicated in the detail estimates on the following pages, the cost of these facilities totals $663,405. The
benefit area for Assessment District 86-2 is Area 1 and Area 2 of the Fee Area Mar). The total area of
Area 1 is 323.1 acres, which includes a 10.3 acre park. Since assessment district fees are not collected
on neighborhood I~arks, the net area of Area 1 paying fees is 312.8 acres. The total area of Area 2 is
493.3 acres, which includes a 1.7 acre park. The net area of Area 2 paying fees is 491.6 acres. Area
1 and Area 2 will contribute Assessment District fees towards PDA facilities in the amount of
$663,405/804.4 acres = $825/acre.
Since properties in Area 1 are currently being developed and some have already paid PDA fees based on
the Rancho LaBorde PDA, this PDA will not revise the PDA fee for Area 1. Therefore, PDA fee for Area
1 will remain at $1,000 per acre.
Area 3A and Area 38, which total 295.9 acres, contribute PDA fees only. The PDA fee per acre for Areas
3A and 38 will be equal to the sum total of PDA fee and Assessment District PDA contribution per acre
for Area 2. The dollar total of PDA fees and Assessment District PDA contributions for Area 1, 2, 3 and
3A will equal the total estimate for constructing all PDA facilities. The table below shows the PDA per
acre fee and Assessment District PDA contribution per acre for each area within the Riverlakes Ranch
Planned Drainage Area. PDA fees will not be collected on the elementary school and neighborhood park
sites. The table below shows the acreage of each area on which PDA fees will be collected.
