HomeMy WebLinkAboutROI NO 1213RESOLUTION OF INTENTION NO. 1213 A RESOLUTION OF THE COUNCIL DECLARING ITS INTENTION TO ORDER THE VACATION OF LONDONDERRY AVENUE (ENTIRE ROADWAY FROM STINE ROAD TO EAST END). WHEREAS, PORTER-ROBERTSON ENGINEERING & SURVEYING, INC. Submitted a request for the vacation of Londonderry Avenue (entire roadway from Stine Road to east end); and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA, pursuant to Section ][5051 (b) (3) of CEQA Guidelines in that there is no possibility that the proposed vacation could have a significant effect on the environment; and WHEREAS, at its meeting on April 6, 2000, the vacation was duly heard and considered by the Planning Commission and was found to be consistent with Metropolitan Bakersfield 2010 General Plan. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are tree and correct and are incorporated herein. This resolution is adopted pursuant to :Section 8300, of the Streets and Hi,wayS' Code of the State of California. The Council intends to order the vacation of Londonderry Avenue (entire roadway from Stine Road to east end) in the City of Bakersfield, County of Kern, State of California, more particularly described as follows: All that portion of Lot 8 of Section 35, Township 30 South, Range 27 East, M.D.M., in the City of Bakersfield, Kern County, California, according to the "Kern County Sales Map No. 1 of Lands of J.B. Haggin" filed in the Office of the Kern County Recorder on May 3.1889, also being a portion of Parcels "A" being more particularly described as follows: Commencing at a point on the west line of said Section 35, from which point the northwest comer thereof bears N 0© 34? 42" E, 795.22 feet; thence S 89© 25' 18" E, 55.00 feet to the Tree Point of Begi~ming; thence S 0© 34' 42" W, 585.90 feet, 100.00 feet; thence N 45 © 44' 08" E, 28.36 feet; thence S 89 °06' 25" E, 585.67 feet; thence N 0© 34' 50" E, 60.00 feet; thence N 89© 06' 25" W, 585.90 feet; -t- thence N 44° 15' 52" W, 28.21 feet to the Tree Point of Beginning. 7:00 PM on Wednesday, May 24, 2000, in the Council Chambers, City Hall, 1501 Truxtun Avenue, Bakersfield, Califorrda, is hereby fixed as the time and place when ail persons interested in or objecting to the proposed vacation may appem' before the City Council and be heard. The City Clerk shall cause notice of the date, hour, and place of said hearing on this resolmion to be published for two successive weeks prior thereto in The Bakersfield Californian and the Superintendent of Streets of the City of Bakersfield, California, shail cause "Notice of Vacation" to be posted as required by Section 8323 of the Streets and Highways Code of the State of California.
