A RESOLUTION OF THE COUNCIL TO ORDER THE VACATION OF A 50'
PORTION OF THE WAIVED VEHICULAR ACCESS RIGHTS ON THE
WEST SIDE OF ASHE ROAD AT THE NORTHEAST CORNER OF
PARCEL 2 OF PARCEL MAP NO. 9233
WHEREAS, CB RICHARD ELLIS, INC., ON BEHALF OF LARRY BEDROSIAN
submitted a request for the vacation of a 50 foot portion of the waived vehicular access rights on
the west side of Ashe Road at the northeast comer of Parcel 2 of Parcel Map No. 9233; and
WHEREAS, ail rights of vehicular ingress and egress were waived aiong a certain portion
or,he ~vest side of Ashe Road by "Vehicular Access Dedication" filed for record in Book 5510,
Page 1441, Official Records, in the Office of the Kern County Recorder; and
WHEREAS, for the above-described project, it was deten~ined that the proposed project
is exempt from CEQA, according to Section 15051 (b) (3) of CEQA Guidelines, in that there is
no possibility that the proposed vacation could have a significant effect on the environment; and
WHEREAS, at its meeting on April 6, 2000, the vacation was duly heard and considered
by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield
2010 General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein.
.This resolution is adopted pursuant to Section 8300, of the Streets and Highways
Code of the State of Caiifomia.
The Council intends to order the vacation of a 50 foot portion of the waived
vehicular access rights on the west side of Ashe Road at the northeast comer of
Parcel 2 of Parcel Map No. 9233 in the City of Bakersfield, County of Kem~ State
of Caiifomia, more particularly described as follows:
That portion of the West right of way line of Ashe Road situated in the southeast~'
1/4 of Section 16, T 30 S, R 27 E, MDM, more particularly described as follows:
Commencing at the point of intersection of the center lines of Ashe Road and
District Boulevard, also being a point on the east line of the southeast 1/4 of said
Section 16;

Thence N 00° 28' 48" E, along the center line of Ashe Road, 785.62 feet;
Thence, N 89° 112' 44" W, 55.00 feet to a point on the west right of way line of-
Ashe Road, said point being the northeast comer of Parcel 2 of Parcel Map 92233
filed in Book 42 of Parcel Maps, Page 153;
Thence S 00° 28' 48" W, along said right of way line, 15.00' to the TRUE POINT
OF BEGINNiNG.
Thence continuing S 00° 28' 48" W, along said right of way line, 50.00 feet to the
point of termination.
The time and place for hearing on the proposed vacation shall be Wednesday, May
24, 2000, at 7:00 P.M. in the Council Chambers, City Hall, 1501 Trmxtun Avenue,
Bakersfield, California, whereby all persons interested in or objecting to the
proposed vacation may appear before the City Council and be heard.
The City Clerk shall cause notice of the date, horn-, and place of said hearing on
this resolution to be published for two successive weeks prior thereto in
The Bakersfield Californian and the Superintendent of Streets of the City of'
Bakersfield, California, shall cause "Notice of Vacation" to be posted as required
by Section 8323 of the Streets and Highways Code of the State of California.
Proof of posting shall be made by affidavit of the person posting the notice and the
affidavit shall contain the facts of the posting. The proof of publication and the
affidavit shall be filed in the office of the Public Works Department pursuant to
Streets and Highways Code Section 2317.
The City Clerk shall certify to the passage of this resolution and shall cause the
same to be posted on the bulletin board at the City Hall, 1501 Truxtun Avenue, in
the City of Bakersfield, within fifteen (15) days after its passage.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the City
