A RESOLUTION ADOPTINO CONFLICT OF I~T~T
CODE FOR THE HANDICAPPED ACCE~ APP~ BOARD.
~W~.WP_~%S, every city agency is requiredby the Political
Reform Act of 1974 to have a Conflict of Interest Code, which,
when adopted by the City Council, shall have the force of law;
and
WHEREAS, the City Council formed the Handicapped Access
Appeals Board of the City, requiring it to formulate and submit
Conflict of Interest Codes to the Council; and
WHEREAS, the Handicapped Access Appeals Board has
listed the positions which involve the making or participation in
the making of decisions which may foreseeably have a material
effect on financial interests.
NOW, Tw~RF_~OI~E, BE IT RESOL%~ED by the Council of the
City of Bakersfield as follows:
1. The Conflict of Interest Code of the Handicapped
Access Appeals Board of the City of Bakersfield, on file in the
City Clerk's Office, is hereby approved and adopted.
2. Within thirty (30) days after the date of this
Resolution, all offLcers and employees holding the positions
designated in Exhibit "A" of each code shall, where so required,
file their Initial Statement of Economic Interest.
3. The City Clerk is hereby directed to furnish to
each person who is required to file Statements, the following:
(a) Instruction Manual for Statements of Economic
Interests; and
Three (3) copies of form of Statement of
Economic Interests for Designated Employees.

The Political Reform Act, Government Code Section B1000,
et seq., requires s=ate and local gouernment agencies to adopt and
promulgate conflict of interest codes. The Fair Political
Practices Commission has adopted a regulation, 2 Cal. Code of Regs.
Section 18730, which contains the terms of a standard conflict of
interest code. It can be incorporated by reference and may be
amended by the Fair Political Practices Commission after public
notice and hearings to conform to amendments in the Political
Reform Act. Therefore, the terms of 2 Cal. Code of Regs. Section
15730 and any amendments to it duly adopted by the Fair Political
Practices Commission are hereby incorporated by reference and,
along with the attached Appendix in which members and employees are
designated and disclosure categories are set forth, constitute the
conflict of interest code of the Handicapped Appeals Board of the
City of Bakersfield. Designated employees shall file
statements of economic interests with the city clerk.

APPENDIX OF DESIGNAT~ POSITIONS

* The City Manager may determine in writing that a particular
consultant, although a "designated position," is hired to perform
a range of duties that is limited in scope and thus is not required
to fully comply with the disclosure requirements in this section.
Such written determination shall include a description of the
consultant's duties and, based upon that description, a statement
of the extent of disclosure requirement. The City Manager's
determination is a public record and shall be retained for public
inspection in the same manner and location as this conflict of
interest code.

APPENDIX OF DI-~CLOSUR~ CATEGORIES
Persons in the following categories must disclose as

sources of income, loans and gifts, and all interests in

Consolidation Corporation, all loans and gifts from such
entities, and all interests in real property within two
miles of land owned or used by the Southeast Bakersfield
Wastewater Treatment Facilities Consolidation Corporation.
