NOTICE TO CONTRACTORS
SEALED PROPOSALS will be received by the City of Bakersfield at the Office
of the Purchasing Officer, City Hall, 1501Truxtun Avenue, Bakersfield, California,
until 2:00 o'clock P.M. on December 15, 1988 to be publicly opened and read
immediately thereafter, for the following work:
MITIGATION OF FUEL CONTAMINATED SOIL AT THE
RIO BRAVO FIRE STATION
12100 ALFRED HARRELL HIGHWAY
BAKERSFIELD, CALIFORNIA
Geotechnical engineering investigation report and specifications, forms of
proposal, bonds, and contract may be obtained at the office of the Purchasing
Officer by posting a refundable deposit of ZERO DOLLARS {$ -0~) for each
complete set. Refund of deposit will be made provided the plans and specifica-
tions are returned to the Purchasing Officer within ten {10) days from date of
bid opening and the documents are in reasonable good condition.
No bid will be considered unless it is made on a proposal form furnished
by the Purchasing Officer and attached to submittal proposal as required by
specification, which appears herein immediately following the specifications of
the project, and is made in accordance with the provisions set forth under
Section 2, "Proposal Requirements and Conditions" of the Standard Specifications/
of the Department of Transportation, Business & Transportation Agency, State of
/
California, under date of July, 1984. Each bid must be accompanied by a pro- .~.
posal guarantee in accordance with the requirements of article 2-1.07 of the /
said Section 2 of the Standard Specifications.
The City of Bakersfield reserves the right to reject any or all bids.
Bids are required on the entire work described herein.
Substitution of securities for moneys retained to ensure performance shall
be permitted pursuant to the provisions and requirements of Government Code 4590.
The eligible securities include interest bearing demand deposit accounts, standby
letters of credit, or any other security agreed to by the Contractor and the
City of Bakersfield. The request for substitution of securities to be deposited
shall be submitted on the form entitled "Escrow agreement for Security Deposits
in Lieu of Retention" included in the back of these special provisions.
The Contractor must be a licensed California general contractor and a
chemical engineer registered with the State of California, and must be experienced
in performing environmental assessments and/or mitigations. The Contractor is
subject to the approval of the Bakersfield City Fire Department and any agency
with jurisdiction in this matter.
SPECIFICATIONS: The work embraced herein shall be done in accordance
with the Standard Specifications of the Kern County Health Department.

PROGRESS OF THE WORK AND TIME FOR COMPLETION. Attention is directed to
the provisions of Section 8, 8-1.03, "Beginning of Work", Article 8-1.06, "Time
of Completion", and Article 8-1.07, "Liquidated Damages", of the Standard
Specifications, and is specifically hereby made a part of these special provisions.
The first paragraph of Section 8-i.03, "Beginning of Work", of the Standard
Specifications, is amended to read:
The COntractor shall begin work within fifteen {15) days after
receiving written notice the contract has been approved by the
City Council and to proceed. The Contractor shall diligently
prosecute the same to completion before the expiration of the
time limit contained in the accepted proposal.
Contract working days will commence from the date the Contractor
begins work or the 15th calendar day from the date of the
written notice to proceed, whichever comes first.
Full compensation for conforming to the requirements of above paragraph
shall be considered as included in the prices paid for the various items of work
and no additional allowance will be made therefor.

(b) PROPOSAL FORM. All proposals must be made upon blank forms to be
obtained from the Purchasing Officer and attached to submittal proposal as
required by specification, the form of which appears' herein immediately follow-
ing these specifications. All proposals must give the prices proposed, both in
writing and figures, and must be signed by the bidder, with his address. If the
proposal is made by an individual, his name and post office address must be
shown. If made by a firm or partnership, the name and post office address of
each member of the firm or partnership must be shown. If made by a corporation,
the proposal must show the names of the state under the laws of which the corpo-
ration was chartered and the names, titles, and business addresses of the
president, secretary and treasurer.
{c) BIDDER'S GUARANTEE. All bids shall be presented under sealed cover
and shall beaccompanied by a certified check or bid bond made payable to the
City of Bakersfield, for an amount equal to at least ten percent {10% of the
amount of said bid, and no bid shall be considered unless such certified check
or bid bond is enclosed therewith.
{d) RETURN OF BIDDER'S GUARANTIES. Within ten {10) days after the award
of the contract, the City.of Bakersfield will return the proposal guaranties
accompanying such of the proposals as are not to be considered in making the
award. All other proposal guaranties will be held until the contract has been
finally executed, after which they will be returned to the respective bidders
whose proposals they accompany.
{e) CONTRACT BONDS. The Contractor shall furnish two good and sufficient
bonds. One of the said bonds shall guarantee the faithful performance of the
said contract by the Contractor and shall be in an amount equal to one hundred
percent {lO0~) of the contract price. The other of the said bonds shall be in
an amount of fifty percent {50%} of the contract price and shall be furnished as
required by the terms of an act entitled:
"An act to secure the payment of the claims of persons employed
by contractors upon public works, and the claims of persons who
furnish materials, supplies, teams, implements, or machinery used
or consumed by such contractors in the performance of such works,
and prescribing the duties of certain public officers with respect
thereto," approved May 10, 1919, as amended.
Forms of bonds required may be obtained at the office of the City Attorney.

Whenever any surety or sureties on any such bonds, or on any bonds required
by law for the protection of the claims of laborers and material men, become
insufficient, or the Mayor has cause to believe that such surety or sureties
have become insufficient, a demand in writing may be made of the Contractor for
such further bond or bonds or additional surety, not exceeding that originally
required, as is considered necessary, considering the extent of the work remain-.
lng to be done. Thereafter no payment shall be made upon such contract to the
Contractor or any assignee of the Contractor until such further bond or bonds or
additional surety has been furnished.
{fl REJECTION OF PROPOSALS CONTAINING ALTERATIONS, ERASURES OR IRREGULAR-
ITIES, Proposals may be Pejected if they show any alterations of form, additions
not called for, conditional or alternative bids, incomplete bids, erasures or
irregularities of any kind. Proposals in which the prices obviously are unbal-
anced may be rejected.
The right is reserved to reject any and all proposals.
(g} AWARD OF CONTRACT. The award of the contract, if it be awarded, will
be to the lowest proposer.whose proposal is found to be, by the City of Bakersfield
and the County of Kern, acceptable in terms of trustworthiness, fitness, and
capacity of the proposer to do the work proposed, and whose proposed method to
mitigate is acceptable and consistent with the goals of the City, including a
time frame from reception to completion.
The award of the contract will be made within forty-five {45) days after
the opening of the proposals unless extension is approved by the lowest respon-
sible bidder. ~
{h) EXECUTION OF CONTRACT. The contract shall be signed by the success-
ful bidder and returned, together with the contract bonds within ten {10) days,
not including Sundays, after the bidder has received notice that the contract
has been awarded. No proposal shall be considered binding upon the City until
the execution of the contract. All contracts shall be considered as being made
and entered into in the City of Bakersfield, California.
Failure to execute a contract and file acceptable bonds as provided herein
within ten {10) days, not.including Sundays, after the bidder has received
notice that the contract has been awarded, shall be just cause for the cancella-
tion of the award and the forfeiture of the proposal. guaranty.
{il EXAMINATIONS OF PLANS, SPECIFICATIONS, SPECIAL PROVISIONS, AND SITE
OF WORK. The bidder is required to examine carefully the site of, the proposal,
plans and specifications, and contract forms for the work contemplated, and it
will be assumed that the bidder has investigated and is satisfied as to the con-
ditions to be encountered, as to the character, quality, and quantities of work
to be performed and materials to be furnished, and as to the requirements of the
specifications, the special provisions, and the contract. It is mutually agreed
that the submission of a proposal shall be considered prima facie evidence that
the bidder has made such examination.
{j) COMPANY RESUME'. Provide company resume' listing experience and
qualifications in the mitigation of fuel-contaminated soil. Include in the
resume' qualifications and certifications of the Contractor.
The Contractor must be a licensed California general contractor and a
professional geologist, hydrogeologist, or civil or chemical engineer registered
with the State of California, and must be experienced in performing environmental
assessments and/or mitigations. The Contractor may possess equivalent education

and experience to that described above, but is subject to the approval of the
Bakersfield City Fire Department and any agency with jurisdiction in this matter.
The Contractor must provide proof of certification or permitting for the type of'
decontamination proposed by any governing or regulation agency with jurisdiction.
{k) SITE SAFETY. Enclose a detailed site safety plan outlining personal
safety, environmental safety, and possible hazards to the surrounding residents.
Enclose a site map showing location of any equipment or materials that will
remain on-site longer than 72 hours. This map should also show any materials or
equipment that will be stored or used off-site and address security and safety
factors.
SECTION 2. SCOPE OF WORK
{al WORK TO BE DONE. The work to be done consists of furnishing all labor,
materials, methods and processes, implements, tools and machinery, except as oth-
erwise specified, which are necessary and required to construct the proposed
improvements, as designated in the contract.
The work, in general, consists of mitigating fuel contaminated soil with
an on-site treatment or by "Alternate A" removal and disposal of contaminated
soil.
The work shall be performed at:

Bakersfield, CA
(b) PERMITS. The Contractor shall procure all permits and licenses, pay
all charges fees, and give all notices necessary and incidental to the due and
lawful prosecution of the work.
{c) ALTERATIONS. By mutual consent in writing of the parties signatory to
the contract, alterations or deviation, increases or decreases, additions or
omissions, in the plans and specifications, may be made and the same shall in no
way affect or make void the contract.
The City of Bakersfield reserves the right to increase or decrease the
quantity of any item or portion of the work, or to omit portions of the work as
may be deemed necessary or expedient by the Engineer.
{d) EXTI~A WORK. New and unforeseen work will be classed as extra work when
such work cannot be covered by any of the various items or combination of items
for which there is a bid price.
The Contractor shall do no extra work except upon written order from the
Engineer. For such extra work the Contractor shall receive payment as previ-
ously agreed upon in writing, or he shall be paid on force account.
{el REMOVAL OF OBSTRUCTIONS. The removing and disposing of all obstruc-
tions to the prosecution of the contract, unless otherwise specified, shall be
considered as included in'the various items of contract work and no additional
compensation will be allowed therefor.
{fl FINAL CLEANING UP. Upon completion and before acceptance of the work,
the Contractor shall clean the site, and all ground occupied by him in connec-
tion with the work, of all rubbish, excess materials, temporary structures, and
equipment; and all parts of the work shall be left in a neat and presentable
condition.
: ON-SITE TREATMENT
When proposing an on-site treatment your proposal must address the follow-
ing special provisions.
(a) COMPREHENSIVEWORK PLAN. This plan must detail the decontamination
process. Discuss the feasibility of this procedure as it relates to soil
conditions at the site, moisture content, and effectiveness.
A timetable must be presented with this plan detailing each phase of
the process, including a Completion date.
Outline a quality assurance plan discussing sample collection, handling
procedures, and analytical quality assurance.
Attention is directed to the fact that the parking lot drains across the
contamination site. It will be the responsibility of the Contractor to provide
a cap for the site that will prevent surface water from entering the contamina-
tion site.
(b) DISPOSAL. Disposal of any waste produced by decontamination process is
the sole responsibility of the Contractor. The Contractor shall obtain all per-
mits and authorization necessary for proper and legal disposal of such wastes.
The cost for such disposal shall be considered as included in total cost of the
project.
(c) COMPLETION., Up6n completion and before acceptance of the work, the
Contractor shall test the soil within the contamination site to verify that the
contamination has been reduced below the action levels established.
The soil samples shall be tested in a lab approved and certified to test
hazardous materials. Laboratory analysis shall be performed using an approved
method. These methods must be discussed in the comprehensive work plan. The
Contractor shall provide the City of Bakersfield with the results of these
tests.
{d) MINIMUM ACTION LEVELS.' The minimum clean-up action levels are:
Benzene .07 ppm
Toluene 10. ppm
Xylene 62.0 ppm
Ethylbenzene 2.9 ppm
Total Petroleum Hydrocarbons 100 ppm
{ppm = parts per million)
These action levels'shall be met before final acceptance of the work.
The verification and determination of these levels.is subject ot the approval of
the City of Bakersfield and Kern County Health Department.
{e) RECOMPACTION OF SOIL. After minimum action levels of soil cOntamina-
tion are achieved, the soil within the previous excavation site, and any removed
during mitigation procedures, shall be recompacted.
The soil within the excavation site and along the length of the product
lines and vent lines shall be removed. The soil shall be placed within the
excavation sites, in lifts approximately 6 inches thick, and compacted at or
near optimum moisture to achieve a dry density of at least 92 percent of the
maximum dry density as determined by ASTM Test Method D1557-78. Additional
lifts should not be placed if previous lifts do not meet the required dry den-
sity of if soil conditions are not stable, The contractor shall recompact the
soil to within one-half of one inch of existing grade,
The contractor shall have the soil compaction tested every three feet,
beginning at the deepest point within the excavation, using test method ASTN
D1557-78, The contractor shall provide the test results to the City of
Bakersfield before final acceptance and payment will be made.
Backfill material shall consist of soils already existing within excavation
sites. Any import fill shall be free of contamination, organics and debris and
should be non-expansive and granular, in nature with the following requirements:

Percent passing No. 200 sieve 0-30
Plasticity Index Less than 10

REMOVAL AND DISPOSAL

tion site shall be backfilled with engineered fill. The import fill shall be
free of the contamination, organics, and debris, and should be non-expansive and
granular in nature with the following requirements:

Plasticity Index Less than 10

Engineered fill soil should be placed in lifts approximately six {6} inches
thick, moisture conditioned as necessary, and compacted at, or near, optimum
moisture to achieve a dry density of at least 92 percent of the maximum dry den-
sity as determined by ASTM Test Method Dl157-78.
Additional lifts should not be placed if previous lifts do not meet the
required dry density, or if soil conditions are not stable. The Contractor shall
recompact the soil to within one-half of an inch of existing grade.
The Contractor shall have the soil compaction tested every three {3} feet,
beginning at the deepest point within the excavation, using test method ASTM
D1557.78. The Contractor shall provide the test results to the City of
Bakersfield before final acceptance and payment will be made.
The soil within the excavation sites of the vent lines and product lines
shall be removed and recompacted according to the specifications stated above.
SECTION 3. CONTROL OF THE WORK
{a} AUTHORITY OF THE ENGINEER. The Engineer shall be the person or persons
as designated by the Chief of the Bakersfield Fire Department. The Engineer
shall decide any and all questions which arise as to the quality or acceptabil-
ity of materials furnished and work performed, and as to the manner of perform-
ance and rate of progress'of the work; all questions which arise as to the
interpretation of the plans and specifications; all questions as to the accepta-
ble fulfillment of the contract on the part of the Contractor; and all questions
as to claims and compensation.
The Engineer's decision shall be final and he shall have executive author-
ity to enforce and make effective such decisions and orders as the Contractor
fails to carry out promptly.
{b} PLANS. All authorized alterations affecting the requirements and
information given on the approved plans shall be in writing. No changes shall
be made of any plan or drawing after the same has been approved by the Engineer,
except by direction of the Engineer.
Working drawings or plans for any structure not included in the plans
furnished by the Engineer shall be approved by the Engineer before any work
involving these plans shall be performed, unless approval is waived in writing
by the Engineer.
It is mutually agreed, however, that the approval by the Engineer of the
Contractor's working plan does not relieve the Contractor of any responsibility

for accuracy. The Contractor shall be responsible for agreement and conformity
of his working plans with the approved plans and specifications.
{c) COORDINATION OF PLANS, SPECIFICATIONS, AND SPECIAL PROVISIONS. These
specifications, the plans, special provisions, and all supplementary documents
are essential parts of the cotnract, and a requirement occurring in one is a
binding as though occurring in all. They are intended to be .cooperative, to
describe, and to provide for a complete work. Plans shall govern over
specifications; special provisions shall govern over both specifications and plans.
{d) SUPERINTENDENCE. Whenever the Contractor is not present on any part of
the work where it may be desired to give direction, orders will be given by the
Engineer in writing, and shall be received and obeyed by the superintendent or
foreman in charge of the particular work in reference to which orders are given.
{e) INSPECTION. The Engineer shall at all times have access to the work
during construction, and shall be furnished with every reasonable facility for
discertaining full knowledge respecting the progress, workmanship, and character
of materials used and employed in the work.
Whenever the Contractor varies the period during which work is carried on
each day, he shall give due notice to the Engineer, so that proper inspection ~
may be provided. Any work done in the absence of the Engineer will be subject
to rejection.
The inspection of the work shall not relieve the Contractor of any of his
obligations to fulfill the contract as prescribed. Defective work shall be made
good, and unsuitable materials may be rejected, notwithstanding the fact that
such defective work and unsuitable materials have been previously overlooked by
the Engineer and accepted or estimated for payment.
{f) REMOVAL OF DEFECTIVE AND UNAUTHORIZED WORK. All work which is defec-
tive in its construction or deficient in any of the requirements of these speci-
fications shall be remedied, or removed and replaced by the Contractor in an
acceptable manner, and no compensation will be allowed for such correction.
Any work done beyond the lines andgrades shown on the plans or ~stablished
by the Engineer, or any extra work done without written authority, will be con-
sidered as unauthorized and will' not be paid for.
Upon failure on the part of the Contractor to comply forthwith with any
order of the Engineer made under the provisions of this article, the Engineer
shall have authority to cause defectivew work to be remedied, or removed and
replaced, and unauthorized work to be removed, and to deduct the costs thereof
from any monies due or to become due the Contractor.
{g) FINAL INSPECTION. Whenever the work provided and contemplated by the
contract shall have been satisfactorily completed and the final cleaning up per-
formed, the Engineer will make final inspection.
(h) CONFORMITY WITH PLANS AND ALLOWABLE DEVIATION. Finished surfaces in
all cases shall conform with the lines, grades, cross-sections, and dimensions
shown on the approved plans. Deviations from the approved plans, as may be
required by the exigencies of construction will be determined in all cases by
the Engineer and authorized in writing.
{i) INTERPRETATION OF PLANS' AND SPECIFICATIONS. Should it appear that the
work to be done, or any matter ne.lative thereto, is not sufficiently detailed or

explained in these specifications, plans, and the special provision, the con-
tractor shall apply to the Engineer for such further explanations as may be
necessary, and shall conform to such explanation or interpretation as part of
the contract, so far as may be consistent with the intent of the original
specifications. In the event of doubt or question relative to the true meaning
of the specifications, reference shall be made to the City Council, whose deci-
sion thereon shall be final.
In the event of any discrepancy between any drawings and the figures written
thereon, the figures shall be taken as correct.
(j) LINES AND GRADES. All distances and measurements are given and will be
made in a horizontal plane. Grades are given from the top of stakes or nails,
unless otherwise noted on the plans.
SECTION 4. CONTROL OF MATERIALS
(a) SAMPLES AND TESTS. At the option of the Engineer, the source of
supply of each of the materials shall be approved by the Engineer before deliv-
ery is started and before such material is used in the work. Representative
preliminary samples of the character and quality prescribed shall be submitted
by the contractor or producer of all materials to be used in the work, for test-
ing or examination as desired by the Engineer.
All tests of materials furnished by the contractor shall be made in
accordance with commonly recognized standards of national organizations, and
such special methods and tests as are prescribed in the specifications.
The contractor shall furnish such samples of materials as are
requested by the Engineer, without charge. No material shall be used until it
has been approved by the Engineer. Samples will be secured and tested whenever
necessary to determine the quality of material.
(b) DEFECTIVE MATERIALS. All materials not conforming to the
requirements of these specifications shall be considered as defective, and all
such materials, whether in place or not, shall be rejected and shall be removed
immediately from the site of the work unless otherwise permitted by the
Engineer. No rejected material, the defects of which have been subsequently
corrected, shall be used until approved in writing by the Engineer.
Upon failure on the part 'of the contractor to 'comply with any order of
the Engineer made under the provisions of this article, the Engineer shall have
authority to remove and replace defective material and to deduct the cost of
removal and replacement from any monies due or to become due the contractor.
SECTION 5. LEGAL RELATIONS AND RESPONSIBILITIES TO THE PUBLIC
(a) LAWS TO BE OBSERVED. The Contractor shall keep himself fully informed
of all existing and future State and National laws and follow municipal ordinances
and regulations of the City of Bakersfield which in any manner affect those
engaged or employed in the work, or the materials used in the work, or which in
any way affect the conduct of the work, and of all such orders and decrees of
bodies or tribunals having any jurisdiction or authority over the same.
{b) HOURS OF LABOR. The contractor shall forfeit, as penalty to the
City of Bakersfield, Ten Dollars {$10.00) for each laborer, workman, or mechanic
employed in the execution of the contract by him, or by any subcontractor under
him, upon any of the work hereinbefore mentioned, for each calendar day during

which said laborer, workman, or mechanic is required or permitted to labor in
violation of the provisions of Section 1810 to Section 1815, inclusive, of the
Labor Code.
(c) The contractor shall comply with Section 6705 of the Labor Code
which provides that the contractor's responsibility shall be as follows:
If the contract price for the project includes an expenditure in
excess of twenty-five thousand dollars ($25,000) for excavation of any trench or
trenches five feet or more in depth, the contractor or his subcontractor shall
not begin any trench excavation unless a detailed plan, showing the design of
shoring, bracin9, sloping or other provisions to be made for worker protection
during the excavation of the trench, has been submitted by the contractor to the
City Engineer and the detailed plans has been approved by the City Engineer.
If such plan varies from the shoring system standards established by
the Construction Safety Orders of the Division of Industrial Safety, the plan
shall be prepared by a registered civil or structural engineer.
Nothing in this section shall be deemed to allow the use of a shoring,
sloping,~or protective system less effective'than that required by the
Construction Safety Orders of the Division of Industrial Safety.
Nothing in this section shall be construed to impose tort liability on
the awarding body or any of its employees.
The terms "public works" and "awarding body", as used in this section,
shall have the same meaning as in Labor Code Sections 1720 and 1722 respectively.
(d) EQUAL EMPLOYMENT OPPORTUNITY. During the performance of this
contract the Contractor agrees as follows:
(1) The contractor will not discriminate against any employee
or applicant for employment because of race, creed, color,
sex, or national origin. The Contractor will take affirma-
tive action to ensure that applicants are employed, and
that employees are treated during employment, without
regard to their race, creed, color, sex, or national ori-
gin. Such action shall include, but not be limited to, the
following: Employment, upgrading, demotion, or transfer;
recruitment or recruitment advertising; layoff or ter-
mination; rates of pay or other forms of compensation; and
selection for training, including apprenticeship. The
Contractor agrees to post in conspicuous places, available
to employees and applicants for employment, notices to be
provided setting forth the provisions of this non-
discrimination clause.
(2) The Contractor will, in all solicitations or advertisements
for employees placed by or on behalf of the Contractor,
state that all qualified applicants will receive considera-
tion for employment without regard to race, creed, color,
sex, or national origin.
(3) The Contractor will send to each labor union or representa-
tive of workers with which he has a collective bargaining
agreement or other contract or understanding, a notice to
be provided advising the labor union or workers' represen-
tative of the Contractor's con~nitments under Section 202 of
Executive Order No. ll24B of September 24, lgB5 and shall
post copies of the notice in conspicuous places available
to employees and applicants for employment.
(4) The Contractor will comply with all provisions of Executive
Order No. ll24B as amended by Executive Order 11375, and of
the rules, regulations, and relevant orders of the
Secretary of Labor.
(el PREVAILING WAGE. The Contractor shall, as a penalty to the City
of Bakersfield, forfeit $25.00 for each calendar day or portion thereof, for
each workman paid less than the stipulated prevailing rates for such work or
craft in which such workman is employed under this contract or by any subcon-
tractor under him, in violation of the provisions of Section 1770 to Section
1780, inclusive, of the Labor Code. The Contractor shall be responsible for its
own and subcontractors' compliance with the requiremedt of Section 1776 of that
Code.
Copies of the prevailing rate of per diem wages, for each craft, clas-
sification or type of workman needed to execute the contract, are on file in the
office of the Director of Public Works and shall be made available to any inter-
ested party on request.
(fl APPRENTICES. All Contractors and Subcontractors shall comply
with the provisions of Labor Code Section 1777.5 relating to the employment of
apprentices.
(gl REGISTRATION OF CONTRACTORS. Prior to award, Contractors shall be
licensed in accordance with the provisions of Section 7055 of Business and
Professions Code.
(h) PERMITS AND LICENSES. The Contractor shall procure all permits
and licenses, pay all charges and fees, and give all notices necessary and inci-
dental to the due and lawful prosecution of the work.
(il PATENTS. The Contractor shall assume all responsibilities aris-
ing from the use of patented materials, equipment, devices, or processes used on
or incorporated in the work.
(j) PUBLIC CONVENIENCE AND SAFETY. The Contractor shall so conduct
his operations as to cause the least possible obstruction and inconvenience to
public traffic. Unless other existing streets are stipulated, in the special
provisions to be used as detours, all traffic shall be permitted to pass through
the work.
Residents along the road or street shall be provided passage as far as
practicable. Convenient access to driveways, houses and buildings along the
road or street shall be maintained and temporary crossings shall be provided and
maintained in good condition. Not more than one cross or intersecting street or
road shall be closed at any time without the approval of the Engineer.
The Contractor shall furnish, erect, and maintain such fences,
barriers, lights, and signs as are necessary go give adequate warning to the
public at all times that the improvement is under the construction and of any
dangerous conditions to be encountered as a result thereof, and he shall also
erect and maintain such warnings and directional signs as may be furnished by
the City.

Full compensation for conforming to the provisions of this Section 5
(j) shall be considered as included in the prices paid for the various contract
items of work and no additional compensation will be allowed therefor.
(k) RESPONSIBILITY FOR DAMAGE. The City of Bakersfield, the City Council,
or the Engineer shall not be answerable or accountable in any manner for any
loss or damage that may happen to the work or any part thereof; or for any mate-
rial or equipment used in performing the work, or for injury or damage to any
person or persons, either workmen or the public; or for damage to adjoining
property caused by the negligence of Contractor or one of his subcontractors
during the progress of the work at any time before final acceptance.
The Contractor shall indemnify and save harmless the City of
Bakersfield, the City Council, and the Engineer from any suits, claims, or
actions brought by any person or persons for or on account of any injuries or
damages sustained or arising in the construction of the work or in consequence
thereof.
(1) CONTRACTOR'S RESPONSIBILITY FOR WORK. Except as provided above, until
the formal acceptance of the work by the Engineer, the Contractor shall have the
charge and care thereof and shall bear the risk of injury or damage to any part
thereof by the action of the elements or from any other cause, whether arising
from the execution or from the non-execution of the work. The Contractor shall
rebuild, repair, restore, and make good all injuries or damages to any portion of
the work occasioned by and of the above causes before final acceptance and shall
bear the expense thereof, except such injuries or damages occasioned by acts of the
Federal Government or the Public enemy.
If at any time during the term of this contract there shall be filed by
or against the Contractor in any court, pursuant to any statute either of the
United States or of any state, a petition in bankruptcy or insolvency or for the
reorganization or for the appointment of a receiver or trustee of all or a por-
tion of the Contractor's property, or if Contractor makes an assignment for the
benefit of creditors, this contract, at the option of City may be cancelled and
terminated and this contract shall not be an asset in any bankruptcy or
insolvency proceeding set forth above.
Contractor shall not assign or transfer any of Contractor's rights or
obligations under this contract, nor shall any party be substituted, added,
deleted, or otherwise changed, without the written consent of City. Any volun-
tary assignment, orassignments by operation of law of any rights or obligations
of Contractor, or the transfer of any rights or obligations of Contractor, or
the change of any party by Contractor shall be deemed a default under the con-
tract allowing City to exercise all remedies available to it under the law.'
(m} NO PERSONAL LIABILITY. Neither the City Council, the Engineer, nor any
other officer or authorized assistance or agent shall be personally responsible
for any liability arising under the contract.
{n) RESPONSIBILITY OF CITY. The City of Bakersfield shall not be held
responsible for the care or protection of any material or parts of the work
prior to final acceptance, except as expressly provided in these specifications.
SECTION 6. PROSECUTION AND PROGRESS
{a) SUBLETTING AND ASSIGNMENT. The Contractor shall give his personal
attention to the fulfillment of the contract and shall keep the work under his
control.

Subcontractors wi]] not be recognized as such, and al] persons engaged
in the work of construction will be considered as emp]oyees of the Contractor,
and their work shall be subject to the provisions of the contract and
specifications.
Where a portion of the work sublet by the Contractor is not being pros-
ecuted in a manner satisfactory to the Engineer, the subcontractor shall be
removed immediately on the requisition of the Engineer and shall not again be
employed on the work.
(b) WORK TO COMPLETION. The Contractor shall diligently prosecute the work
to completion before the expiration of the permitted number of working days or
calendar days as specified on Page 1 of this specification.
{c} CHARACTER OF WORKMEN. If any subcontractor or person empldyed by the
Contractor shall fail or refuse to carry out the directions of the Engineer or
shall appear to the Engineer to be incompetent or to act in a disorderly or
improper manner, he shall be discharged immediately on the requisition of the
Engineer, and such person shall not again be employed on the work.
{d} TEMPORARY SUSPENSION OF WORK. The Engineer shall have the authority to
suspend the work wholly or in part, for such period as he may deem necessary,
due to unsuitable weather, or to such other conditions as are considered unfa-
vorable for the suitable prosecution of the work, or for such time as he may
deem necessary, due to the failure on the part of the Contractor to carry out
orders given, or to perform any provisions of the work. The Contractor shall
immediately obey such order of the Engineer and shall not resume the work until
ordered in writing by the Engineer.
{el TIME OF COMPLETION AND LIQUIDATED DAMAGES. It is agreed by the parties
to the contract that in case all the work called for under the contract is not
completed before or upon the expiration of the time limit contained in the
accepted proposal, damage will be sustained by the City of Bakersfield, and that
it is and will be impracticable to determine the actual damage which the City
will sustain in the event of and by reason of such delay, and it is therefore
agreed that the Contractor will pay to the City of Bakersfield, the sum of Two
Hundred Dollars {$200.00} per day for each and every calendar day's delay beyond
the time prescribed to complete the work; and the contractor agrees to pay such
liquidated damages as herein provided, and in case the same are not paid, agrees
that the City of Bakersfield may deduct the amount thereof from any money due or
that may become due the Contractor under the contract.
It is further agreed that in case the work called for under the con-
tract is not finished and completed in all parts and requirements within the
time specified, the City Council shall have the right to extend the time for
completion or not, as may seem best to serve the interest of the City~ and if it
decides to extend the time limit for the completion of the contract, it shall
further have the right to charge to the Contractor, his heirs, assigns or or
sureties, and to deduct from the final payment for the work, all or any part, as
it may deem proper, of the actual cost of engineering, inspection,
superintendence, and other overhead expenses which are directly chargeable to
the contract, and which accrue during the period of such extension, except that
the cost of final surveys and preparation of final estimate shall not be
included in such charges.
The Contractor shall not be assessed with liquidated damages nor the
cost of engineering and inspection during any delay in the completion of the
work caused by acts of God or of the public enemy, acts of the City, fire,

floods, epidemics, quarantine restrictions, strikes, freight embargoes, and unu-
sually severe weather or delays of subcontractors due to such causes; provided
that the Contractor shall within ten (lO) days from the beginning of any such
delay, notify the Engineer in writing of the causes of delay, who shall ascertain
the facts and the extent of the delay, and his findings of the facts thereon
shall be final and conclusive.
(f) SUSPENSION OF CONTRACT. If at any time in the opinion of the City
Council, the Contractor has failed to supply an adequate working force, or
material of proper quality, or has failed in any other respect to prosecute the
work with the diligence and force specified and intended in and by the terms of
the contract, notice thereof in writing will be served upon him, and should he
neglect or refuse to provide means for a satisfactory compliance with the
contract, as directed by the Engineer, within the time specified in such
notice, the City Council in any such case shall have the power to suspend the
operation of the contract, Upon receiving notice of such suspension, the
Contractor shall discontinue said work, or such parts of it as the City Council
may designate. Upon such suspension, the Contractor's .control shall terminate,
and thereupon the City Council, or its duly authorized representative, may take
possession of all or any part of the Contractor's materials, tools, equipment,
and appliances upon the premises, and use the same for the purpose of completing
said contract, and hire such force and buy or rent such additional machinery,
tools, appliances and equipment, and buy such additional machinery and supplies
at the Contractor's expense as may be necessary for the proper conduct of the
work and for the completion thereof; or may employ other parties to carry the
contract to completion, employ the necessary workmen, substitute other machinery
or materials, and purchase the materials contracted for, In such manner as the
City Council may deem proper; or the City Council may annul and cancel the con-
tract and re-let the work or any part thereof. Any excess of cost arising
therefrom over and above the contract price will be charged against the
Contractor and his sureties, who will be liable therefor. In the event of such
suspension, all money due the Contractor or retained under the terms of this
contract shall be forfeited to the City; but such forfeiture will 'not release
the Contractor or his sureties from liability or failure to fulfill the contract.
The Contractor and his sureties will be credited with the amount of money so
forfeited toward any excess of cost over and above the contract price, arising
from the suspension of the operations of the contract and the completion of the
work by the City as above provided, and the Contractor will be so credited with
any surplus remaining after all just claims for such completion have been paid.
In the determination of the question whether there has been any such.
non-compliance with the contract as to warrant the suspension or annulment
thereof, the decision of the City Council shall be binding on all parties to the
contract.
{g) RIGHT-OF-WAY. The right-of-way for the work to be constructed will
be provided by the City. The Contractor shall make his own arrangements, and
pay all expenses for additional area required by him outside of the limits of
right-of-way unless provided in the Special Provisions.
SECTION 7. MEASUREMENT AND PAYMENT
{a) EXTRA AND FORCE ACCOUNT WORK. Extra work as hereinbefore defined,
when ordered and accepted, shall be paid for under a written work order in
accordance with the terms therein provided. Payment for extra work will be made
at the unit price or lump sum previously agreed upon by the Contractor and the
Engineer, or by force account.

If the work is done on force account,'the Contractor shall receive the
actual cost of all material furnished by him as shown by his paid vouchers, plus
fifteen percent {15%), and for all equipment and teams that are necessary, he
shall receive the current prices in the locality, which sha]l have been previ-
ously determined and agreed to in writing by the Engineer and' by the Contractor,
plus fifteen percent {15%) and for all labor that is necessary he shall receive
the current prices in the locality, plus twenty percent {20%) provided, however,
that the City reserves the right to furnish such materials required as it deems
expedient, and the Contractor shall have no claim for profit on the cost of such
materials. The price paid for labor shall include all payments imposed by State
and Federal laws for all payments made to, or on behalf of, the workmen, other
than actual wages.
All extra work and force account shall be adjusted, daily upon report
sheets, prepared by the Engineer, furnished to the Contractor and signed by both
parties, which daily reports shall thereafter be considered the true record of
extra work or force account work done.
{b} PROGRESS PAYMENTS. The Contractor shall, once in each month, submit
for approval, an estimate in writing to the City Engineer of the Total amount of
work done by the Contractor, to the time of such estimate, and the value
thereof. The City of Bakersfield shall retain ten percent {10%) of such esti-
mated value of the work done as part security for the fulfillment of the con-
tract by the Contractor, and shall monthly pay to the Contractor, while carrying
on the work, the balance not retained, as aforesaid, after deducting therefrom
all previous payments and all sums to be kept or retained under the provisions
of the contract. No such estimate or payment shall be required to be made, when
in the judgment of the Engineer the work is not proceeding in accordance with
the provisions of the contract, or when in his judgment the total value of the
work done since the last estimate amounts to less-than Three Hundred Dollars
{$300.00).
(c) FINAL PAYMENT. The Engineer shall, after the completion of the contract,
make a final estimate of the amount of work done thereunder, and the value of such
work, and the City of Bakersfield shall pay the entire sum so found to be due after
deducting therefrom all previous payments and all amounts to be kept and all amounts
to be retained under the provisions of the contract. All prior partial estimates
and payments shall be subject to correction in the final estimate and payment. The
final payment shall not be due and payable until the expiration of thirty (30) days
from the date the "NOTICE OF COMPLETION" is recorded at the County Recorder's
Office.
It is mutually agreed between the parties to the contract that no cer-
tificate given or payments made under the contract, except the final certificate
or final payment, shall be conclusive evidence of the performance of the
contract,..either wholly or in part, against any claim of the party of the first
part, and no payment shall be construed to be an acceptance of any defective
work or improper materials.
And the Contractor further agrees that the payment of the final amount
due under the contract, and the adjustment and payment for any work done in
accordance with any alterations of the same, shall release the City of
Bakersfield, the City Council, and the Engineer from any and all claims or lia-
bility on account of work performed under the contract or any alteration thereof.
{d) SUBSTITUTION OF SECURITIES. Whenever herein provision is made for
withholding or retention of monies to ensure performance, substitution of an
equivalent amount {value) of securities shall be permitted in accordance with
the provisions and requirements of Government Code Section 4590.

SECTION 8. INSURANCE
The Contractor shall save, hold harmless and indemnify the City, its
officers, agents, employees and Volunteers from all claims, demands, damages,
judgments, costs or expenses in law or equity that may at any time arise from or
related to any work performed by the Contractor, his agents, employees or sub-
contractors under the terms of this agreement.
In addition to any other form of insurance or bond required under the
terms of this agreement and specifications, the Contractor shall procure and
maintain for the duration of this agreement the following types and limits of
insurance:
Automobile liability insurance providing coverage on an occurrence
basis for bodily injury, including death, of one or more persons, property dam-
age and personal injury, with limits of not less than one million {$1,000,000)
per occurrence; and
General liability insurance providing coverage on an occurrence basis
for bodily injury, including death, of one or more persons, property damage and
personal injury, with limits of not less than one million {$1,000,000} per
occurrence.
Workers' compensation with statutory limits and employer's liability
insurance with limits of not less than one million {$1,000,000) per accident.
All policies required of the Contractor hereunder shall be primary
insurance as respects the City, its mayor, council, officers, agents, employees
and volunteers, and any insurance or self-insurance maintained by the City, its
mayor, council, officers, agents, employees and volunteers shall be excess of
the Contractor's insurance and shall not contribute with it.
The automobile liability policies shall provide coverage for owned,
non-owned, and hired autos.
The liability policies shall provide contractual liability coverage
for the terms of this agreement.
The liability policies shall contain an additional insured endorsement
in favor of the City, its mayor, council, officers, agents, employees, and
volunteers.
The workers' compensation policy shall contain a waiver of subrogation
endorsement in favor of the City, its mayor, council, officers, agents,
employees, and volunteers.
All policies shall contain the following endorsements:
An endorsement providing the City with ten {10) days written notice of
cancellation or material change in policy language or terms.
If any part of the' work under this agreement is sublet similar insur-
ance shall be provided by or on behalf of the subcontractors to cover their
operations.
The insurance required under this agreement shall be maintained until
all work required to be performed under the terms of this agreement is satisfac-
torily completed as evidenced by formal acceptance by the City.

The Contractor shall furnish the City Risk Manager and the Public
Works Department with a certificate of insurance evidencing the insurance
required under this agreement.
All costs of insurance required under this agreement shall be included
in the Contractor's bid, and no additional allowance will be made for additional
costs which may be required by extension of the insurance policies.
SECTION 9. GENERAL PROVISIONS
(a) DUST CONTROL. It shall be the Contractor's responsibility to prevent
a dust nuisance from originating from the site of the work as a result of his
operations during the effective period of this contract. Preventative measures
to be taken by the Contractor shall include, but shall not be limited to, the
following:
1. Water shall be applied to all unpaved areas as required to
prevent the surface from becoming dry enough to permit dust
formation.
2. Paved surfaces over which vehicular traffic is permitted to
travel shall be kept free of dirt.
Temporary suspension of the work, either as a result of order by the
Engineer, or as a result of conditions beyond the control of the Contractor
shall not relieve the Contractor from his responsibility for dust control as set
forth herein.
Full compensation for conforming to the requirements of this article
shall be considered as included in the prices paid for the various contract
items of work and no additional compensation wili be allowed therefor.
Attention is directed to the fact that the parking lot drains across
the contamination site. It will be the responsibility of the Contractor to pro-
vide for handling this water and any expense involved shall be considered as
included in the price paid for the various items of work and no additional
allowances will be made therefor.
(b) WORK HOURS. The work hours for this project shall be between the
hours of 7:00 a.m. and 5:00 p.m. Notification must be given as to the days work
will be performed.

Investigation began at the site in January, 1988 when the facilities' inventory records indicated a loss of about 700 gallons of
gasoline product. A tightness test was conducted and the results showed that the gasoline product delivery system was not tight.
In February and April of the same year, a total of eleven (11) exploratory borings were drilled to evaluate the soils beneath the
tanks, lines, and dispensers. The results of the laboratory analysis indicated subsurface soils were impacted to a dePth of about
20 feet. The TPH (g) concentration ranged from ND to 27,000 rog/kg. A table of the complete analysis is.attached.
In. 1991, soil remediation by vapor ex~raction was conducted at the site. The VE system was operated for 254 days and was
reported to have removed a total of 3,294 pounds of petroleum hydrocarbons.
Four (4) confirmatory borings were drilled in January 1992 to determine the status of remediation. One of the borings (CB-2)
showed that 1900 mg/kg TPHg remained in the soil. The boring was completed into a well and further rem~diation was .
conducted. A few months later, another confirmatory boring was drilled and the results showed that petroleum hydrocarbons
are still present at this location. Further analysis of the soil samples collected revealed that the contamination found is diesel.
A table of the confirmatory boring results is attached.
The responsible party's (RP) contractor estimated that the potential migration of the diesel if it is to be left in place Would be
32 feet. They indicated that the remaining hydrocarbons would be retained .by the soil particles due to capillary forces.
The soil profile at the site generally consisted of sandy silts underlain by silty sands and poorly graded sands. Groundwater was
encountered at 57 feet below grade in 1988.
Based on the above information, closure was requested in behalf of the RP. Environmental Health does not object to closing
this investigation.

EQUIPMENT DESCRIPTION: 500 Gallon Above-Ground Convault Gasoline Storage & Dispensin~ System,
including the following equipment-:
a. One 550 gallon Convault Unleaded grade aboveground gasoline storage
tank(s) each with a permanently affixed fill tube terminating no more than six'
inches from the bottom of the tank and provisions for the collection of gasoline
vapors during filllng.
b. One OPW-VF nozzle each with provisions for the collection of gasoline
vapor during use.
OPERATIONAL CONDITIONS:
1. California Air Resources Board certified vapor recovery efficiency must be attained when
filling storage tanks and during the refueling of vehicles. (Rules 412 & 412.1)
2. Ail lines, fittings, adapters, caps and connections shall be leak free.
3. Only California Air Resources "Certified" vapor control equipment shall be utilized.
(Rules 209, 4~2, 412.1)
4. System shall be installed, operated and maintained in accordance with manufactures'
recommendation. (Rule 209)
5. Phase I (filling of storage tank) vapor collection equipment shall be used when tanks are
filled by nonexempt distributor. (Rules 209 and 412)
6. Illustrated instructions for use of nozzle shall be posted. (Rule 209)
STATE OF CALIFORNIA AIR TOXICS HOT SPOTS REQUIREMENTS:
Facility shall comply with California Health and Safety Code Sections 44300 through 44384.

when filling storage tanks and during the refueling of vehicles. (Rule 412 & 412.1)
2. Ail lines, fittings, adaptors, caps and connections shall be leak free.
3. Liquid spillage and drippage at disconnect shall be prevented.
4. Only California Air Resources "Certified" vapor control equipment shall be
utilized.
5. Tanks on delivery vessels shall be leak free.
6. Tank filling shall be accompliS'~ed only through a permanently affixed submerged
fill device.
7. Illustrated instructions for use of nozzles shall be posted at each island.
