G · 1988-212-aes (A) STATE 'CONTRACT o The State Leaking Underground Storage Tank Pilot Program provides a mechanism for the State to reimburse the County for County oversight. The County will conduct the necessary oversight and bill the State Water Resources Control Board under this state contract. The State will then charge you, a responsible party, for both the costs, incurred by the County and the State, pertaining to your site, ~under the State terms explained below: Whereas the Legislature has appropriated ~'u'nds from the California Hazardous Substance Clean-up Fund to pay the local and state agency administrative and oversight costs associated with the cleanup of releases from'unde~'ound storage tanks; and Wl~ereas the direct and indirect costs of overseeing removal or remedial action at the above site are funded, in whole or in part, fxom the Hazardous Substance Cleanup Fund; and Whereas the above individual(s) or entity(ins) have been identified as the party or parties responsible ~ft~r investigation and cleanup of the above site; YOU ARE HEREBY NOTIFIED that pursuant to Section 25360 of the Health and ,~Safety code, the Above Responsible Party or Parties shall reimburse the State Wa,er'Resources Control Board for all direct and ~!~? The site described above is not in an environmentally sensitive area and may be enrolled in the Local Agreement Option; however, the County of Kern reserves the right to cancel any Local Agreement Option, should it be discovered that groundwater contamination or a unique, complex hydrogeological condition exists. In such cases, Environmental Health will utilize the State contract to pay for County oversight activities. The County of Kern reserves this right for, any site even when the site is located in a non-environmentally sensitive area. It is necessary for you to respond, in .w~'iting, within ten (10) calenda~ days of receipt of this letter to advise Ke~n County Environmental Health of your choice: either the State contract or the County's Local Agreement Option. (~RI) removed one 1000 gallon unleaded gasoline underground tank from the Kalibur Engineering facility at 3109 Antonino 'Avenue, Bakersfield. The tank was decontaminated on site using a 'high pressure steam cleaner and it was inerted with dry ice. Rinsate wis disposed of at Gibson Oil and Refining in Bakersfield under hazardous waste manifest # 88524458. The tank was removed to 'American Recycling Inc. in Ontario, California. Soil was sampled under. Kern County Department of Environn~ental ' Health Services direction at a depth of two and six feet beneath the center of the tank bottom and at the same depths beneath 'the adjacent' dispenser. The samples were ,analYzed at. SMC -Laboratory in Bakersfield for BTXE and TPH (gasoline). The results for benzene and TPH are listed below. A complete chemical analysis is enclosed. RECOMMENDATIONS/GUIDELINES FOR REMOVAL OF UNDERGROUND STORAGE TANKS This depart mcnt is responsible for enforcing thc Kern County OrdinanceCode, Division 8 and state regulations pertaining to underground storage tanks. Representatives from this department respond to job sites during tank removals to ensure that the tanks are safe to remove/close and that the overall lob performance ts consistent with permit requirements, applicable laws and safety standards. The following guidelines are offered to clarify the interests and expectations for this department. 1. Job site safety is one of our primary concerns. Excavations are inherently dangerous. It is thc contractor's responsibility to know and abide' by · CAL-OSHA regulations. Thc job foreman is responsible for thc crew and any subcontractors on thc job. As a general rule Workers are not permitted in improperly sloped excavations or when unsafe conditions exist in the hole. Tools and equipment are to be used only for their designed ' function. For example, backhoe buckets are never substituted for ladders. · 2. Properly licensed contractors are aSSumed to understand the requirements of the permit issued. The job foreman is'~esponsible for knowing and abiding by the conditions of the permit. Deviation from the permit conditions may result in a stop-work order. . ...... 3.
