NOTICE OF VIOLATION AND SCHEDULE FOR. COMPLIANCE
The following hazardous materials regulation violations
have been identified regarding Today Cleaners located at 5600
Auburn Street, Bakersfield, CA.:
1. The hazardous materials business plan and inventory have
not been updated since July of 1987.
VIOLATION OF CH. 6.95 CALIFORNIA HEALTH AND
SAFETY CODE SEC.25505
(b) In addition to the requirements of Section
25510, whenever a substantial change in the handler's
operations occurs which requires a modification of its
business plan, the handler shall submit a copy of the
plan revision to the administering agency within 30 days
of the operational change.
(c) The handler shall, in any case, review the
business plan, sUbmitted pursuant to subdivision~ (a)
and (b), on or before January 1, 1988, and at least once
every two years thereafter, to determine if a revision
is needed and shall certify to the administering agency
that the review was made and that any necessary changes
were made to the plan, A copy of these changes shall be
submitted to the administering agency as part of this ,.
certification.
(d) Unless exempted from the business plan
requirements under this chapter, any business which
handles a hazardous material shall annually submit a
completed inventory form to the administering agency of
the county or city in which, the business is located.
Notwithstanding any other provisions of the law, an
inventory form shall be filed on or before January 1,
1988, for the 1988 calendar year, and-annually
thereafter. This inventory shall be filed annually,
notwithstanding the review requirements of subdivision
(c).
2. A hazardous.materials site diagram has not been filed.
VIOLATION OF CALIFORNIA HEALTH & SAFETY CODE CHAPTER 6°95, SECTION 25509
Inventory forms; contents; amount of hazardous material;
federal requirements
(a)(5) Sufficient information on how and where the
hazardous materials disclosed in paragraphs
(1),(2), and (3) are handled by the business to
allow fire, safety, health, and other
appropriate personnel to prepare adequate
emergency responses to potential releases of
the hazardous materials.
The above violations must be corrected by December 17, 1992.
A computer printout-of the.existing hazardous materials'
-management plan is enclosed. Revisions may be marked
di~rectly on the printout. Sign the certification on the first
page and return the revised plan. Blank forms to be used to
complete the site diagram and to make additions to the
hazardous materials inventory are also enclosed.
Failure to correct these violations will result in
enforcement action. The department will schedule a re-
inspection of your facility to verify compliance. If you have
