HomeMy WebLinkAboutRES NO 03-91RESOLUTION NO. 3-91 A RESOLUTION OF APPLICATION OF THE COUNCIL OF THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS FOR ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 341, PACHECO NO. 10 ANNEXATION (WARD 7). WHEREAS, the Planning Commission of the City of Bakers- field, in accordance with the provisions of Section 65353 of the Government Code, held a public hearing on THURSDAY, DECEMBER 20, 1990, on the proposed annexation of certain properties to the City of Bakersfield known as PACHECO NO. 10 ANNEXATION, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, by Resolution No. 50-90 on December 20, 1990, the Planning Commission recommended approval of the annexation by this Council and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the City of Bakersfield desires to propose a change of organization, to wit, the annexation to the City of Bakersfield of the hereinafter-described territory, pursuant to Section 56800 of the Government Code of the State of California. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that it hereby finds and determines as follows: 1. That the City of Bakersfield hereby proposes the annexation to the City of Bakersfield of the territory described in Exhibit "A", attached hereto and made a part of this resolu- tion as though fully set forth herein. 2. That a map of the territory groposed to be so annexed, marked Exhibit "B", is attached hereto and made a part of this Resolution as though fully set forth herein. 3. That a plan for providing services within the affected territory of the proposed annexation, in accordance with the provisions of Section 56653 of the Government Code, is marked as Exhibit "C", attached hereto and made a part hereof as though fully set forth herein. 4. That this proposal for change of organization, to wit, annexation, is made pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, and it is requested that proceedings be authorized for annexation in accordance therewith. 5. That the reasons for the proposed change of organi- zation are that the owners and residents of the affected terri- tory desire to receive municipal services from the City of Bakersfield, and the City desires to receive tax revenues for benefits given and to be given to the territory proposed to be annexed. 6. That for this proposed annexation and the zoning upon annexation, therefor, Ordinance No. 2987, which was adopted July 10, 1985, an Initial Study was conducted and it was deter- mined that the proposed project would not have a significant effect on the environment. A Negative Declaration was prepared and posted. 7. That the laws and regulations relating to the prepa- ration and adoption of Negative Declarations as set forth in the California Environmental Quality Act and City of Bakersfield Resolution No. 107-86 have been duly followed and the Negative Declaration for this proposed annexation is hereby approved and adopted. 8. That the territory proposed for annexation as described herein has been determined to be inhabited pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Section 56046 of the Government Code. 9. Location Indicate location from which service will be provided (i.e. nearest fire station, library, etc.) only for services which will be provided by the Service Level Capaclty Indicate frequency and availability of service (i.e., street sweeping, response ti,ne for emergency services, rec. programs, etc. Police-All police servlces in the City of Bakersfield are administered through the City Police Department located at the s/w corner of Truxtnn Avenue & Eye Street about 4.5 miles north of the annexation. Fire-City Station No. 5 is within 1-l~miles at 700 W. Planz Parks and Recreatlon-Planz Park is located 1 mile to the north. Library-N/A Construction/Maintenance-The City Corporation Yard on Truxtun Avenue west of Freeway 99 will provide necessary facilities, personnel and services to accomodate Public Works efforts. Maintenance and personnel will be dispatched from the City Yard on a regular basis for preventative maintenance as needed. Repair includes streets, construction/maintenance, sweeping and lighting. Sweeping Lighting Sewer-Sewer connection is a~ailable at the north/west corner of So. "H" Street and Pacheco Road. Effiuant would then be treated by the City Was$ewater Treatment Plant #2. ~er-~Water)-this area is served by the California Water Service Company, D29 :ANN.341.2 -2- 24-hour patrol ls provided in the immediate vicinity of this annexation. First priority response is approximately 6.35 minutes of less. Fire protection is provided on a 24-hour basis. The annexation will not affect City/County Joint fire service capabilities. All City parks are open to the public at reasonable hours. There will be no reduction In the range capacity of the City to rpvodle the necessary Public Works services to this area. Services will be on a regular basis and "as needed". Adequate capacity exists. Adequate capacity exists. RTY:wrn:ih III. What effects, if any, would annexation of this territory have on the existing level of city/district serw[ces (i.e., need for additional emergency service personnel or construction of new facilities, etc.)? The annexation of this territory will not affect near term level or capability of the City to provide needed services. An increase in police personnel possibly would be required to maintain the current level of city service. IV. Would city/district require any upgrading or change in facilities to serve affected territory (roads, fire hydrants, mains, etc.): If so, would city/distruct or residents be responsible for financieg? The City will not require any upgrading or changes in existing facilities. Should the residents of Pacheco No. 10 want area wide street lights and sewers, the City would assist them in establishing a public improvement district to finance installation of these improvements. Indicate and explain existing zoning in affected territory. See attached zoning 123-24. The existing zone is R-1 (One Family Dwelling Zone). VI. Indicate and explain proposed prezoning in area. (List effects on present land use that would occur as a result of annexation such as maintenance of livestock on property, etc.) Pacheco No. 10 is fully developed into 148 R-1 lots. The City's R-1 and Ri-CH are compatible and consistent witht he exisitng zoning and within adopted Metropolitan Area General Plan. There would be no effect on the present land use. List city/district services that area will directly or indirectly benefit from such as decrease in fire insurance rate, shorter emergency response time, use of community facilities, etc. City Police should be able to respond in a more timely met'ret than present County Sheriff and State Highway Patrol. Current City Police standard is a higher number of officers per 1,000 population compared to the County standard. The City will provide street maintenance which includes street sweeping. Refuse service will be provided by the City and will result in savings to the homeowners within this annexation. VIII. Please provide the foil. owing information relative to city and county taxes: List existing tax rate(s) in area. Existing tax rate in the area equals 1.258853 percent of assessed market value. This represents the total property tax rate. When annexed, a designated percentage of the total of the area will accrue to the City. (Tax Rate per 1990-1991 Kern County Auditor-Controller's Tax Rate Schedule). Would effected area be subject to any bonded indebtedness of the city/district: If so, explain. Yes, the tax rate for City bonds, equals 0.004041% of assessed market value. When annexed, the total tax rate will be 1.262894% of assessed market value. How will the difference in tax rates affect a house with a market value of $50,000.00? The effect of the difference in tax rates will be negligible A house of this value would be taxed on .$43,000 after the $7,000 homeowners exemption. The difference would amount to $1.74 due to the City Bond. Bond rate of 0.004041% amounts to a difference of $1.74 more per year on a house of this value.
