A RESOLUTION OF APPLICATION OF THE COUNCIL OF
THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS
FOR ANNEXATION OF TERRITORY TO THE CITY OF
BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 340,
HOSKING NO. 1 ANNEXATION (WARD 7).
WHEREAS, the City of Bakersfield desires to propose a
change of organization, to wit, the annexation to the City of
Bakersfield of the hereinafter-described territory, pursuant to
Section 56800 of the Government Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that it hereby finds and determines as
follows:
1. That the City of Bakersfield hereby proposes the
annexation to the City of Bakersfield of the territory described
in Exhibit "A", attached hereto and made a part of this resolu-
tion as though fully set forth herein.
2. That a map of the territory proposed to be so
annexed, marked Exhibit "B", is attached hereto and made a part
of this Resolution as though fully set forth herein.
3. That a plan for providing services within the
affected territory of the proposed annexation, in accordance with
the provisions of Section 56653 of the Government Code, is marked
as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
4. That this proposal for change of organization, to
wit, annexation, is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985, and it is requested that
proceedings be authorized for annexation in accordance therewith.
5. That the reasons for the proposed change of organi-
zation are that the owners and residents of the affected terri-
tory desire to receive municipal services from the City of
Bakersfield, and the City desires to receive tax revenues for
benefits given and to be given to the territory proposed to be
annexed.
6. That for this proposed annexation and the zoning
upon annexation, therefor, Ordinance No. , which was adopted
December 19, 1990, an Initial Study was conducted and it was deter-
mined that the proposed project would not have a significant
effect on the environment. A Negative Declaration was prepared
and posted on September 26, 1990.
7. That the laws and regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in the
California Environmental Quality Act and City of Bakersfield
Resolution No. 107-86 have been duly followed and the Negative
Declaration for this proposed annexation is hereby approved and
adopted.
8. That the territory proposed for annexation as
described herein has been determined to be uninhabited pursuant
to the Cortese-Knox Local Government Reorganization Act of 1985,
Section 56046 of the Government Code.
9. That the names of the officers of the City of
Bakersfield who arE? to be furnished with copies of the Executive
Officer's Report and who are to be given mailed Notice of
Hearing, if any, are:

ANNEXATION NO. 340 BOUNDARY
A parcel of land being a portion of Section 31, Township 30 South, Range 28
East and Section 36, Township 30 South, Range 27 East, M.D. M., County of
Kern, State of California, more particularly described as follows:
Beginning at the point of J_ntersectlon of the East line of the Northwest 1/4
of said Section 31 and the South line of the North 30 feet thereof, as said
section is shown on Parcel Map No. 5750 filed in Book 24 of Parcel Maps, Page
184 in the Office of the Kern County Recorder, said point also being on the
existing corporate boundary of the City of Bakersfield;
THENCE (1) South 00° 34' 46" West along said East line, 1322.09 feet. to a
point on the Easterly prolongation of South right of way line of Astor Avenue
(30 ft. wide) as shown on map of Tract No. 1092 filed in Book 4 of maps, Page
147 in the Office of the Kern County Recorder;
THENCE (2) North 89° 29' 5]7" West along said South line and prolongation
thereof (South 89° 55' West per said Tract No. 1092) a distance of 690.00 feet
to a point on the West boundary line of sald Tract No. 1092;
THENCE (3) South 00° 03' 00" East, along said West line, 10.00 feet to a point
on the Easterly prolongation of the South right of way line of the 40 foot wide
portion of Astor Avenue;
THENCE (4) South 89° 56' 34" West, along said South right of way line (as shown

filed in Book 28, Page 71 in the Office of the Kern County Recorder) a distance
of 1630.65 feet to the beginning of a 25.00 foot radius curve concave South-
easterly, as shown on map of said Tract No. 3763;
THENCE (5) Southwesterly along said curve through a central angle of 29° 35' 31"
an arc distance of 12.91 feet to the beginning of a 90.00 foot radius reversing
curve concave Northeasterly;
THENCE (6) Westerly along said reversing curve through a central angle of 96° 42'
23" an arc distance of 151.91 feet to a point on the North boundary line of
said Tract No. 3763;
THENCE (7) South 89° 56' 34" West, along said North line and Westerly prolonga-

What effects, if any, would annexation of this territory have on the existing level
of city/district services (i.e., need for additional emergency service personnel or
construction of new facilities, etc.)? The annexation of this territory will not
affect the near term level or capability of the City to provide needed services.
Upon time of full buildout of this territory, additional police officers will
be required to maintain the current level of City service. Streets an$ other
municipal improvements resulting from planned development will increase City
maintenance responsibilities but will not affect the existing level of service.
IV.
Would city/district require any upgrading or change in facilities to serve affected
territory (roads, fire hydrants, mains, etc.): If so, would city/distruct or residents
be responsible for financing? As development occurs the developer provides a-~d pays
for facilities and dedicates them to the City. A proposed trunk sewer system through
the area is to be refinanced by an assessment district which will encompass the
entire annexation area and extend westerly beyond Wible Road. Developers are
now petitioning for the formation o& the sewer district.
Indicate and explain exlsting zoning in affected territory. Subject property is Zoned
A (exclusive agriculture), A-1 (Limited Agriculture) and E(1/4)RS (Estate 1/4 acre min.

Indicate and explain proposed prezoning in area. (List effects on present land
use that would occur as a result of annexation such as maintenance of livestock
on property, etc.) Proposed prezonin~ and amendment to the Bakersfield Metropolitan
Area General Plan will consist of City R-1 (Single Family Dwelling) Zone over
the entire subject property. The impact in general will be a change from existing
agriculture land use to city low density residential use.

VII.
List city/district services that area will directly or indirectly benefit
from such as decrease in fire insurance rate, shorter emergency response
time, use of community facilities, etc. City Police should be able to
respond in a more timely matter than present County Sheriff and State
Highway Patrol services. The present City refuse collection rate is
substantially lower than fees county residents now pay to independent
companies. No special assessment or charges for street sweeping, leaf
collection, school crossing guards, street lighting energy costs and fire
hydrants upon development of subject area. This territory is part of an
area now being petitioned by developers for the possible formation of an
assessment district to provide sewer service tying into the city system.

Please provide the following information relative to city/district and county taxes:
List existing tax rate(s) in area. The existing tax rate in the area
equals 1.103006% (West side South "H" St.)'and 1.213748% (East side South
"H" St.) of assessed market value. This represents the total property
tax rate. When annexed, a designated percentage of the total property
tax of the area will accrue to the City and the remaining to the County for
providing health care and social services.
Would effected area be subject to any bonded indebtedness of the city/district:
If so, explain. Yes, when annexed, the rate will be increased to
1.107047% (west side South "H" Street) and 2.177890% (east side South "H"
Street) of assessed market value which equals the City bond rate of
0.004041% and the total property tax now existing. (Rates as shown on
1990-91 County Auditor-Controller tax rate list).

How will the difference in tax rates affect a house with a market value of
$50,000.00? If the house is used as the principal residence, the $7000.00
homeowners exemption leaves $43,000.00 for taxing purposes. The City
Bond rate of 0.0040411% amounts to a difference of $1.74 more per year on
a house of this value.
