A RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD DETERMINING THAT CERTAIN
AUTOMATED REFUSE CONTAINERS CAN BE
REASONABLY OBTAINED FROM ONLY ONE VENDOR,
TOTER, INC., AND AUTHORIZING THE FINANCE
DIRECTOR TO DISPENSE WITH BIDDING THEREFOR,
AND PURCHASE SAID CONTAINERS FOR AN AMOUNT
NOT TO EXCEED $225,000.00.
WHEREAS, the Finance Director has determined, and has
recommended that this Council find that, Automated Refuse
Containers for the Sanitation Department can be reasonably
obtained from only one vendor and has recommended that this
Council authorize dispensing with bidding therefor in accordance
with Section 3.20.060 B. of the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
The Council hereby finds that Automated Refuse
Containers for the Sanitation Department can be reasonably
obtained from only one vendor, because of automated system
compatibility, parts interchangeability and life expectancy of
containers to wit: Toter, Inc., and authorizes the Finance
Director to dispense with bidding therefor and to negotiate the
purchase of same from such vendor.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on DEC 1. 9 1990 , by
the following vote:
