An investigation was conducted and it was determined that contamination of the soil has occurred. It is a violation of the California Health and Safety Code, Article 13, Chapter 6.5, Division 20, Section 25250.5 for used oil to be disposed of in this manner. A search of the Kern County Assessors records indicate that you are the owner of this property. Please contact this office at (805) 861~3636, extension 582, within 10 days to discuss this matter. An investigation was conducted on December 13, 1990. It was determined that several spills of oil type materials have occurred in the rear yard at your shop. You indicated on December 18, 1990, that you were responsible for the waste oil contamination by the bay doors. It is a violation of the California Health and Safety Code, Article 13, Chapter 6.5, Division 20, Section 25250.5 for hazardous waste to be disposed of in this manner. Therefore, within 30 days, all visibly contaminated soil is to be excavated and placed into secure containers. A representative sample(s) must be collected and analyzed by a certified hazardous waste laboratory for the following constituents: lead, arsenic, chromium, cadmium, total halogens, and polychlorinated biphenyls (PCB's). Notify this office 48 hours prior to sampling. When laboratory analyses have been completed, forward a copy of the report to this office for review. Based on the analyses performed by Zalco Laboratories, the sample results for lead exceed the criteria for establishing the soil sampled as an hazardous waste. To date no documentation has been received by this office evidencing proper disposal of your hazardous wastes. Within 15 days of receipt of this letter, you are to either forward the proper documentation or arrange for a licensed hazardous waste hauler to provide transportation of your waste to an hazardous waste facility. Forward a copy of the Uniform Hazardous Waste Manifest to this office when this has been completed.
