SUMMARY OF PROPOSAL
This proposal is for the development of a 45-unit affordable housing development for
seniors in the City of Bakersfield. The project will include laundry facilities, a community
room, open space, storage and off-street parking.
pROJECT LOCATION AND CURRENT LAND USES
Located in northeast Bakersfield, the proposed project sits on a triangular block bordered
by Baker Street to the east, Grace Street to the south and Bernard Street to the north. The
neighborhood includes public transportation (city buses run along Bernard Street), grocery
and convenience shopping, parks, churches, hospitals and medical offices. Single family
neighborhoods are directly north and south of the site.
Joe McFadden currently owns the three parcels furthest east on the block. Each of these is
zoned C-1 (commercial). The first parcel is located at the corner of Baker and Grace Streets
and includes a 4500 square foot single family home and accessory structures. The home is
currently leased to a day care provider from Bakersfield Junior College. The second parcel
(currently vacant) is a corner lot adjacent to the first and is located at the corner of Bernard
and Baker Streets. The third parcel (currently vacant) is an interior "through lot"
extending from Grace to Bernard Streets.
The balance of the block (between Bernard and Grace Streets) is to be included in the
master plan development. These parcels include three (3) single family detached homes,
one mobile home, one three-plex and an abandoned gas station. One single family home
and the mobile home would be moved from the site with the three-plex and its neighboring
single family home to be included in the project and used either for affordable housing or as
offices for local social service agencies serving seniors. The remaining single family home
would be used as an on-site manager's unit. In addition, Kern Street which connects Grace
and Bernard Streets adjacent to the gas station would be abandoned by the City and
incorporated into an open space landscaping and parking plan together with the gas
station. Because no utilities run under Kern Street, the abandonment of this section of the
street by the City would not pose a problem. !
DEVELOPMENT TEAM
The following individuals and/or firms make up the project's development testa:
Developer/General Contractor
Joe McFadden has over fifteen years experience in the development of single
family and rental housing throughout Kern County. In addition to having
acquired the land, entitlements and permits for his projects, Mr. McFadden has
served as the general contractor for all of his company's projects~

Planning and Development Consultant
Daniel Fred, AICP - Fred Consulting Associates (FCA), a California based
planning and development firm, has extensive experience in all aspects of the
development of affordable housing including land entitlements and financing.
FCA has obtained financing using California HCD, CRA, local Redevelopment
agencies, tax exempt bond financing and low income housing tax credits. Daniel
Fred will assist the owner in developing the master plan and financial package
for local approval as well as financing from CRA lenders and other funding
sources (e.g., City, County, Housing Authority, Tax Credit Allocation
Committee).
Architect
At the present time, the development team is interviewing two architecture firms
located in Bakersfield. Both firms have extensive experience in the design and
construction of affordable multi-family rental hoflsing developments.
Property Manager
The management company has yet to be determined for the project although one
local firm has ben interviewed. This firm is currently managing over 4000
residential units including affordable apartment buildings with HUD subsidies.
A management company will be determined by july 15, 1993.
PROJECT OBJECTIVES
The 45 unit residential community for seniors on the block bordered by Baker Street, Grace
Street, and Bernard Street will address the following objectives which are embodied in the
City's General Plan and which have been generally embraced by the Bakersfield community:
· There is a need to stabilize a neighborhood which is beginning to show signs
of deterioration.
· The project addresses the need for affordable housing for seniors which is
well designed, constructed and maintained and which is conveniently located
to shopping, churches, medical care, parks, transportation, etc. Senior
citizens make up over 50% of the census tract in which the project is located
· The project addresses the objectives of the Baker Street Corridor Study to
upgrade the area. The block serves as an entryway to the Baker Street
Corridor and thus should be representative of how the City wants its
neighborhoods to be perceived by its citizens and by the outside public.
· Upgrading this block will improve neighbors' pride in their neighborhood and
ultimately improve property values throughout the area.
· Traffic flow and safety can be improved by closing off Grace Street to
through traffic which also will solidify the residential quality of the adjacent
neighborhoods.

FINANCING AND STRUCTURE OF DEVELOPMENT
In meeting the foregoing objectives, the developer proposes the following development plan,
most of which will be financed from private sources:
· Acquire the adjoining parcels on the block.
· The City acquires the Gas station acquired and Kern Street abandoned by City.
Parking and open space developed on this parcel.
· The City provides a $225,000 grant (CDBG, HOME and/or Redevelopment Set-aside)
and 3% deferred loan of $175,000 - $225,000 to the developer to cover the cost of
infrastructure improvements (sidewalks, power lines, etc.) and predevelopment
planning/consulting fees. In return, City receives second lien on the property which
requires an affordability restriction for a period of 30+ years. Repayment of the loan
is subject to the project's ability to carry its debt service after repaying the first lien
holder. Should the developer sell the property, the loan can transfer to the new
buyer with a similar deed restriction.
· Design of 40 unit affordable apartment complex with laundry facilities, common
areas, passive park, open areas and off street parking.
· Construction financing commitment obtained.
· Tax credit reservation receiVed from the Tax Credit Allocation Committee.
· Permanent financing commitment obtained.
· PG&E to bury power lines which border the block.
· Sidewalks, curbs and gutters along property are repaired.
· Lot line adjustments made after all parcels have been acquired.
· Design approved by City and permits taken out.
· Project built and rented to residents at 50-60% of median income.

Dear Mr. McFadden,
A review of our files for the property located between Bernard, Grace and Kern Streets
'show that this was the former Eagle Gas Station. Six fuel tanks were removed from this
property on March 16, 1966, and the waste oil tank was removed on July 27, 1989.
The soil samples removed 'in 1986 show contamination levels of up to 94 P.P.M. O-
Xylene two feet under the 500 gallon fuel tank. Lower levels of contamination were
found under two other tanks, but a full site assessment was not required at that time.
The site has. been adequately closed with the contaminated soil left in place, because
it was determined that is was not a threat to ground water.
A change in land use to residential may require further analysis of this site and a risk
analysis may be completed.

of the tank noted above.
Based upon the sample results submitted, this Department is
satisfied that the assessment is complete. Based on current
requirements and policies, no further action is indicated at this
time.
It is important to note that this letter does not relieve you of
further responsibilities mandated under the California Health and
Safety Code and California Water Code if additional or previously
unidentified contamination at the subject site causes or threatens
to cause pollution or nuisance or is found to pose a significant
threat to public health.

This report presents the analytical results of soil samples
retrieved following the removal of one underground storage tank
at the above-referenced project location. Attached to the
report are a site map and a copy of the chain-of-custody
documentation. ~
The scope of our testing was initiated per the verbal
authorization of Mr. Rich Warren of Crisp Construction.
SCOPE OF WORK
Services performed by The Twining Laboratories, Inc.,
consisted of the sampling and analysis of two soil .-samples
retrieved from the former location of a 350 gallon underground
storage tank.
The tank was rusty, no holes were visible in the tank. No
odor was present in the excavation.

The storage tank had a product history of waste oil. The
approximate locations of the former tank is presented on Drawing
No. 1. The project site is located at the southwest corner of
Bernard and Kern Avenue in Bakersfield, California.
SAMPLING PROCEDURE
The soil samples were obtained by Mr. Bruce Blythe of The".
Twining Laboratories, Inc., on July 27, 1989. The soil samples
were retrieved from the depth of approximately 2 feet and 6 feet
below the bottom of the tank excavation. The locations and depth
were specified by Ms. Amy Green of the Kern County Environmental
Health Department. The soil samples were retrieved using brass
sleeves, then capped with aluminum foil then plastic caps and
immediately packed in ice for shipment to our laboratory. The
samples were clearly identified and banded with shipping seals.
The samples retrieved in the field were brought to our facility
in Fresno, California on July 27, 1989. The results of the
sample analysis is presented in the attached table.

Dear Richard:
Per our conversation on August 24, 1989, you stated that the waste oil tank
that was removed from the facility located at 511 Bernard Street on July 25,
1989, had not yet been taken to American Metal Recyclers in Ontario for
disposal.
As per the permit to abandon conditions, the tank tracking disposition must
be returned within fourteen (14) days of the tank removal. You are, therefore,
in violation of the Kern County Ordinance Code 8.48.270(c) which states
"Provides for and carries out, such maintenance of the tank as the permitting
authority determines is necessary."
Allowing the tank to sit above grade for a long period of time may cause
the L.E.L. along with the Oz level to become hazardous. Therefore, before
transportation the tanks must be below the hazardous level and certification must
be submitted to this Office by an approved decontamination contractor that they.
meet these conditions. In the future, tanks must be disposed of within the
timeframe specified on the permit.

station. Based on this review, your application has been denied

1. No workers compensation information given on the application.
It Lust either be supplied or you must be self employed with
no employees and sign the enclosed waiver statement.
2. 'Section D - environmental information, is incomplete. It must
be completed. Please see pages 6 and 7 of the enclosed
handbook #UT-30, which detail how to determine the number of
samples required, and what they must be analyzed for.
3. Section E - disposal information, is lncoaplete. It must be
completed. Please refer to page 5 of the enclosed handbook
for help in filling this out.
