(805) 861-3429 FAX June 2, 1993 Mrs. Jackie Bittle 6500 Olive Drive Bakersfield, CA 93308 SUBJECT: Class V Shallow Injection Well located at 3212 Gulf Street, Bakersfield, CA Work Order No.: 50,142 Dear Mrs. Bittle: This Department has reviewed the Site Characterization Report submitted by Smith-Gutcher and Associates, Inc. on behalf of the above-referenced site. Analytical results have demonstrated that neither further characterization or remediation will be required. It is the opinion of this Department that the shallow injection well at this site can be closed. Closure of the well must be accomplished in a manner such that no movement of fluid containing any contaminant will impact underground sources of drinking water. Acceptable options are: 1) abandonment in place, and 2) removal and disposal (see Closure of Shallow Disposal Wells, Kern County Handbook, SDW-100, page 8). A third option would be if the system would be intended for future use. If this would be the case, the dry well would still need to be destroyed and removed or properly abandoned-in-place. The separation tank could remain with proper waste fluid disposal practices. Please advise this Department as to your decision and contact the office at least 48 hours prior to implementation of the selected option. SMITH GUTCHER AND ASSOCIATES, INC. The site is located at 3223 Brittan Road just north of Gulf Street in Bakersfield, California (see Attachment A). Access to the site is from Gulf Street. The separation tank and dry well were part of a steam cleaning facility. The facility has not been in use for some time. Fluid drained into the separation tank which contains two sediment traps. It then flowed into the dry well located about 8 feet west of the tank. The fluid in the separation tank was sampled by personnel of BC Laboratories. The sample was analyzed for CAM 17 heavy metals, total petroleum hydrocarbons (EPA Method 418.1), purgeable organic constituents (EPA Method 8010/8020), total petroleum hydrocarbons as gasoline and diesel (Modified EPA Method 8015), and base neutral and acid extractable organic constituents (EPA Method 8270). Based on the results of the preliminary assessment, the soil samples collected during the site assessment were analyzed for total petroleum hydrocarbons as diesel and four heavy metals. The heavy metals were barium, copper, lead, and zinc. This was approved by Mr. Mike Driggs of the Kern County Environmental Health Services Department. Mrs. Jackie Bittle May 28, 1993 Page 2 On May 7, 1993 two test holes were drilled with a hand auger in the area of the separa- tion tank and dry well. Test Hole No. 1 was slant drilled below the separation tank. The location of the test hole is shown in the lower right portion of Attachment B. A cross section through the test hole is shown on the upper portion of Attachment B. Soil samples were collected at depths of 12 feet and 15 feet. These depths were 5.5 feet and 8 feet below the separation tank. Test Hole No. 2 was drilled through the vertical dry well. The location of the test hole is shown in the lower right portion of Attachment B. A cross section through the test hole is shown in the lower left portion of Attachment B. A soil sample was collected at a depth of 19 feet in the test hole. All soil samples were collected in accordance with accepted Kern County guidelines. All drilling and sampling equipment was cleaned between drilling each test hole and when the project was completed. The test holes were backfilled with native soil. Soil sample collection was witnessed by Mr. Mike Driggs. The results of the chemical analyses is included in Attachment C. The 12 foot and 15 foot soil sample from Test Hole No. 1 contained varying concentrations of barium, copper, and zinc. None exceeded the STLC limits. No lead was detected in either of the soil samples. No TPH (diesel) was detected in the 12 foot soil sample. The 15 foot soil sample contained a TPH (diesel) concentration of 17 ppm. The soil sample from Test Hole No. 2 contained barium, copper, lead, and zinc in concentrations of 33 ppm, 6.6 ppm, 4.5 ppm, and 31 ppm, respectively. No TPH (diesel) was detected in the soil sample. Heavy metal concentrations detected in the three soil samples appear to be at or near background levels. SMITH- GUTCHER AND ASSOCIATES, INC. The well has been identified as a washrack. This notice is being sent to you because you are the owner of the property listed above. Pursuant to Code of Federal Regulations 40, (40 CFR), Section 144.12 (a) provides that "no owner or operator shall...operate [an injection well]...in a manner that allows the movement of fluid containing any contaminant into underground sources of drinking water, if the presence of that contaminant may cause a violation of any primary drinking water regulation...or may otherwise adversely affect the health of persons." There is evidence that the drain located behind the remains of the service station discharges to the ground. You must demonstrate that the drain is not regulated under the Class V Shallow Injection Well Program within thirty (30) days of receipt of this notice or proceed with the characterization of the Class V well as outlined in the enclosed copy of EPA- REGION 9 GUIDELINES FOR CLOSURE OF SHALLOW DISPOSAL WELLS. Bittle 6500 Olive Drive Bakersfield, CA 93308 SUBJECT: HAZARDOUS WASTE STORAGE VIOLATIONS LOCATED AT 3223 BRITTAN ROAD, BAKERSFIELD, CALIFORNIA NOTICE OF VIOLATIONS Dear Ms. Bittle: On December 17, 1992, an inspector from this Department noted a open drum containing waste motor oil at the facility noted above. This is a violation of hazardous waste regulations and statutes. Specific violations are listed below. ~ VIOLATIONS It has been determined that the facility is in violation of the following regulations and statutes cited below: 1. The facility is in violation of California Code of Regulations, Chapter 30, Title 22, Section 66262.34(0(1)(2)(3)(A)(B)(C). "Generators who accumulate hazardous waste on site without a permit or grant of interim status shall comply with the following requirements: the date upon which each period of accumulation begins shall be clearly marked and visible for inspection on each container and portable tank; the date the 90 day period begins, for purposes of Subsection (a) and (b) of this Section, shall be clearly marked and visible for inspection on each conta#ter and tank. All containers and portable tanks shall be labeled with the following information: The composition and physical state of the wastes, statement or statements which call attention to the particular hazardous properties of the wastes (e.g. flammable, reactive, etc.) and the name of the person producing the wastes." It was determined during the inspection that the drum storing the waste motor oil was not labeled in accordance with the above requirements. Jackie E. Bittle Subject: Hazardous Waste Violations December 28, 1992 Page 2 2. The facility is in violation of California Code of Regulations, Chapter 30, Title 22, Section 66264.173. "A container holding .hazardous waste shall always be closed during transfer and storage, except when it is necessary to add or remove waste." It was observed during the inspection that drum storing waste oil was open. ORDER TO CORRECT Upon receipt of this letter, the facility owners or operator must correct all deficiencies noted in this Notice of Violation within thirty (30) days, and submit to the Department written documentation that all violations have been corrected. In accordance with Kern County Ordinance Code G-5541, Section 8.04.100 the Department is authorized to charge for inspections, review of reports, laboratory service costs and any other costs incurred in the process of obtaining compliance with any violations noted. Be advised that you will be billed at the rate of $80.00 per hour for time spent to date as well as future oversight costs incurred during the abatement of these violations.
