HomeMy WebLinkAboutROI NO 1217RESOLUTION OF INTENT~ON NO, 1217 RESOLUTION OF ~NTENTION NO. 1217 PRELII~INARILY ADOPTING, CONF~RM~NG AND APPROWNG PUBLIC WORKS DIRECTOR'S REPORT FOR THE TRAFFIC SIGNAL NIAINTENANCE DISTRICTS AND THE 2000 - 2001 BUDGETS; SETTING TiME AND PLACE FOR HEARING PROTESTS ON THE AMOUNT OF ASSESSMENTS TO BE LEVIED THROUGHOUT EACH OF THE TRAFFIC SIGNAL. MAINTENANCE DISTRICTS. (WARD 4) WHEREAS, Chapter 13.04 of Title 13 of the Municipal Code of the City of Bakersfield provides fl}r an alternative procedure by which the City Council may provide for the payment of the whofe or any part of the costs and expenses of maintaining and operating any public improvements which are local in nature, from annual benefit assessments apportioned among the several lets or parcels of property within'the maintenance district established therefore; and WHEREAS, the Council approved Resolution 161-94 on September 28, 1994, which provides for the collection of maintenance and operating costs for "convenience" traffic signals (as that term is defined in said resolution) through a maintenance district; and WHEREAS, the Pubtic Works Director has on this date filed with the C~erk of saiid Council his Report, attached hereto and incorporated herein by reference as Exhibit "][", containing the following: (a) descriptions of the property' in each of the Traffic Signal Maintenance Districts, attached hereto as Exhibits 'A"; (b) the improvements to be maintained by each district specifically are traffic signals which benefit the areas within the boundaries as shown on Map and A:ssessment Diagram for each of the Traffic Signal Maintenance Districts, attached hereto as Exhibits "B"; (c) the benefit formulas for each district attached hereto as Exhibits "C"; (d) budgets for each district, containing the matters specified in Section 13.04.120 of the Bakersfield Municipal Code, attached hereto as Exhibits "D"; and (e) the amount of assessments to be tevied against each parcel in each district, attached hereto as Exhibits "E". NOW 'THEREFORE, BE iT RESOLVED by the City Council of the City of Bakersfield, State of California, as follows: The foregoing recitals are true and correct and are incorpo[ated;herein. 2. The City Council hereby reserves the dght to perform the work ef maintenance and operation of the public improvements within each of the Traffic Signal Maintenance Districts by City forces or by private contractor. Such determination and election is to be made for each year at the time the budget and assessment is approved for the year in question. 3. Tlhe City Council hereby preliminarily adopts and approves the Public Works Director's Report and declares that the territory with in the boundaries so specified and described are the Traffic Signal Maintenance Districts which benefit from said local improvements; that the expense of maintaining and operating said improvements is hereby made assessable upon the parcels and lots within each district; and that the exterior boundaries of said Traffic Signal Maintenance Districts are hereby specified and described on those certain maps now on file lin the Office of the City Clerk of the City of Bakersfield and in the Office of the Public Works Director, marked Exhibits '"B," entitled "Map and Assessment Diagram for Traffic Signal Maintenance District, Bakersfield, California." 4. The City Council hereby sets WEDNESDAY, June 14, 2000, AT 7:00 P.r~l., or as soon thereafter as may be heard, at the Councit Chambers of the City Council, 150,1 Truxtun Avenue, Bakersfield, California, as the time and place for hearing protests on the following matters: FAIRNESS OF THE BENEFIT FORMULA; THE AtViOUNT OF THE ASSESSblENT ON ANY PARCEL OF PROPERTY TO BE ASSESSED; RESERVATION BY C~TY OF RIGFIT TO ELECT WHETHER TO PROCEED TO PERFORM WORK BY CITY FORCES OR BY PRIVATE CONTRACTOR. Any interested person may object to any of the above-listed matters by filing a written protest with the City Clerk at 1501 Truxtun Avenue, Bakersfield, California, at or before said time set for the protest hearing; and said City Cterk shall endorse on each protest the date and hour of its receipt, and at said time appointed for said hearing shall present to the Council ali such protests filed 'with said Clerk. 5. Said Report sets forth the amounts in the budget for maintenance and operation of the above public improvements, a description of each parcel of property in each of the Traffic Signal Maintenance Districts and the amount of assessment levied for fiscal year 2000 - 2001 against each parcel. Said Report is open to public inspection. At this hearing, protests will be heard regarding, the fairness of the benefit formula, the amount of the assessment on any parcel of property to be assessed and the reservation of right by the City to utilize either City forces or to contract with private industry for the maintenance of the improvements. Any interested owner objecting to any of these items may file a written protest, signed by him/her, describing the parcel of property so that it may be identified and stating the grounds of his/her protest. (Exhibits "l-A" through "4-A", "l-B"through "4-B", "l-C"through "4-C", "I-D" through "4-D" and "1-E" through "4-E" are attached hereto and incorporated by reference as though fully set forth herein. Pursuant to the provisions of Chapter 13.04 of Title 13 of the Municipal Code of the City of Bakersfield, the Public Works Director makes and files this Report and proposed assessment of and upon all parcels of property within the districts for the cost of maintaining and operating traffic signals that benefit the various districts. The assessment includes the cost to operate, maintain, repair and replace signal poles, mast arms, signal heads, controller, cabinet, machine vision detection system, street light luminaires, conduits, wires and pull boxes, cost of energy, supervision and any and all other items necessary' for the proper maintenance and operation thereof. Developers often request permission to install traffic signals on major streets to enhance access to their development. These "convenience" traffic signals are not required by the Traffic Authority !o regulate traffic flow, but are installed so~ely at the discretion of the develloper of a commercial site. Such signals do not provide a general public traffic benefit. Under the "user pay" concept, the private property deriving benefits should bear the costs of maintenance and operation of convenience traffic signals. On September 28, 1994 the City Council approved Resolution 161-94 instituting the collection of maintenance and operating costs of future convenience traffic signals through maintenance districts. The traffic signals that are operated and maintained under these maintenance districts benefit the parcels within the various districts. Each parcel is assessed an amount based on formulas set forth herein as Exhibits "1-C", "2-C", "3-C"and EXHIBIT" ~[" NOW, THEREFORE, I, RAIJL M. The Marketplace shopping center is divided into 5 zones (see next pa§e). The amount to be assessed to each parcel is calculated as follows: Calculate the total number of trips generated by each building using the City Average Daily Trips (ADT) rates. (2) Multiply the number of trips of each buildi~g by the percentage of the zone shown above. (3) Add the total number of trips (2) of all buildings in each parcel. (4) Add the total number of trips (2) of all buildings in all zones. (5) Divide the total number of trips of each parcel (3) by the total number of trips in alii zones (4). This is the proportionate share of the total assessment for each parcel. (6) Multiply the result of (5) times the total cost of the district for each parcel. This is the amount to be assessed to each parcel. * Since Rosedale Highway is a state highway, the state pays 2/3rds of the cost of the signal and the district pays 1/3rd. Assessment amounts could vary substantially during the initial development of the shopping center. Since onlythe developed parcels will generate traffic using the signalized intersection, those parcels will be responsible for the entire cost. None of the parcels were assessed in 1998-99 since the signals were not in operation at the beginning of the fiscal year. The signals were energized in August 1998. The costs incurred in the 1998-99 fisca[I year were carried over and added to the 1999-2000 costs. The amount to be assessed to each parcel is calculated as follows: (1) Calculate the total number of trips generated by each building using the City Average Daily '['rips (ADT) rates. (2) Add the total number of trips (1) of all buildings in each parcel. (3) Add the total number of trips (2) of all buildings in all parcels. (4) Divide the total number of trips of each pa~rcel (2) by the total number of trips in all parcels (3). 'i-his is the proportionate share of the total assessment for each parcel. (5) Multiply the result of (4) times the total cost of the district for each parcel. This is the amount to be assessed to each parcel. * Since Rosedale Highway is a state highway, '[he state pays 2/3rds of the cost of the signal on Rosedale and the district pays 1/3rd. The district pays all of the cost of the signal on Coffee Road. Assessment amounts could vary substantially during the initial development of the shopping center. Since only the developed parcels will generate traffic using the signalized intersections, those iparcels will be responsible for the entire cost. At the beginning of the 1998-99 fiscal year none, of the parcels were developed and the costs were spread on a per acre basis. This year only two of the parcels are developed and, therefore, only those parcels will be assessed. The signals on Rosedale Highway were put into service in November 1997. The costs incurred during the 1997-98 fiscal year were added to the 1998-99 costs. The signals on Coffee Road are not yet in service. Any costs incurred during the 1999-2000 fiscal year for the signals on Coffee Road will be added to the 2000-2001 assessments. S\PROJ\MD\Tra fsig\Form ulas'~TS-3 EXHIBIT "3-C" NIA~NTENANCE DISTRICT TS-4 (Calloway, Gleneagles) CITY OF BAKERSFIELD BENEFIT FORMULA Each parcel shall be assessed a pementage of the total operating and maintenance cost, adjusted for prior year fund balance or deficit, as calculated below: Fifty percent (50%) of the total operating and m~intenance cost of the district, adjusted for prior year balance or deficit, shall be assessed to the parcels east of Calloway Drive (Parcel Map 10406, Parcels 1-4) and fifty percent (50%) shall be assessed to the parcel west of Calloway Driw~ (Parcel Map 10263, Parcel 1 ). Parcels east of Calloway Drive, (Pamel Map 10406) shall be assessed as follows: Parcel 1 Parcel 2 Pamel 3 Parcel 4 Total adjusted cost x 50% x 36.7% Total adjusted cost x 50% x 24.6% Total adjusted cost x 50% x 38.7% No charge.
