JOHNSON March23,1993 BAKERSFIELD, 93301 FIRE CHIEF 326-3911 Alex Bertolucci Yard Foreman Sierra Iron & Metal Co. 1620 E. Brundage Lane Bakersfield, CA 93307 Alex: As we discussed on the_phone, the quantities of battery acid listed on Sierra's hazardous materials inventOry appear to be over estimated. I have attached a printout of the existing inventory and business plan. Please review it, make any revisions necessary, sign the front page and return, it to me by April 23, 1993. If you need to add any inventory items, use the enclosed form. All other corrections can be written directly on the printout. You told me on the phone that the maximum quantity of batteries accumulated ranges from 20-40,000 lbs. From a U.S. Battery material safety data sheet, I determined that up to 30% of the battery weight is electrolyte which may be up to 40% sulfuric acid. Based on these numbers, I adjusted the inventory entries on the printout of your plan. Please call me at 326-3979, if you have any questions or 'need assistance with the revision. Sierra Ltd, has developed a Hazard Communication Program to enhance our employee's health and safety. As a company we intend to provide information about chemical hazards and other hazardous substances, and the control of hazards via ou~ comprehensive Hazard Communication Program which includes container labeling, Naterlal Safety Data Sheets (HSDS), and training. The following program outlines how we will accomplish this objective. 1. Container Labeling It is the poll. cy of this company that no container of hazardous substances will be ~eleased for use until the following label info~matton is verified: · Containers are clearly labeled as to the contents · Appropriate hazard warnings are noted · The name and address of the manufacturer are lis~ed -This responsibility has been assigned to Hark Kobdish. The supervisor in each section will ensure that all secondary containers are labeled wi~h either an extra copy of the o~iginal manufacturer's label or wi~h generic labels which have a block for identity and blocks for the hazard warning. 2. Material Safety Data Sheets (MSDS) Copies of MSDS fo~ all hazardous substances to which employees of this company may be exposed are kept at the Sierra Iron & Metal front office, the shop, and the K.C. Sierra front office. Mark Kobdish will be responsible for obtaining and maintaining the data sheet system. Andrea Austin will review incoming data sheets fo~ new and significant health-' safety information. She will see that any new information is passed on to the affected employees. MSDS will be reviewed for completeness monthly.. If an MSDS is missing or obviously incomplete, a new MSDS will be requested from ~he manufac~ure~. Cal/OSHA will be notified if a complete MSDS is not recieved. MSDS are available to all employees in their work area for review during each · ork shift. If MSDS are not available or new hazardous substances in use do not have MSDS. olease contact ~qu~.sppe~v!sor !~ediakely~ Burlap · OnionBags · CdttOn Bags · Ca~ons · ~myelny~ene · ~ultiwa~ ~aper · cxpor:ers · ImpoSers · Scrap Metal ; SIERRA IRON & ~ETAL · 324-~$8S Hazard Communication Program Page 2 3. Quanti6es for RMPP compliance are "equal to or greater, than" the minimum criteria and apply to chemicals handled "at any one time". 2. Businesses handling reportable quantities of Acutely Hazardous Materials that have not submitted a business plan MUST contact local Administering Agencies. The business plan submission date will assure the Administering Agency that a business plan has been submitted and is on t'fie. This will also immediately identify businesses that have not submitted business plans. 3. "Process Designation" is provided as a reporting option (with the approval of the Administering Agency) for facilities that can most easily report by process. Thus, facility RMPP registration data could be submitted in a similar format to a business plan that is divided by process. "By lxocess" dam can initiate an emergency response to a lXOCeSS incident rather than a general emergency response to a major facility. Process designation can simplify inspections for major facilities and improve future emergency response. 4. Refer to the EPA list of Extremely Hazardous Substances from the Federal Register (Volume 52, No. 77, p. 13397 et. sea_., April 22, 1987). Each chemical has a threshold planning quantity. This list may be changed by EPA on an annual basis. Updates of this list may be available early in 1988. To comply with this element, you may auach a copy of the inventory submitted to your Administering Agency from your business plan and highlight all Acutely Hazardous Materials. It is recommended that facilities list all extremely haTardous chemicals handled in quantifies equal to or in excess of 1) 500 pounds, and 2) any EPA threshold planning quantity less than 500 pounds. 5. Do not include Trade Secret information in these descriptions. General: For emergency response purposes, it would be desirable to describe the following to the Administering Agency: I.
