HomeMy WebLinkAboutUNDERGROUND TANK '~ ~ UNITED STATES ENVIRONMENTAL PROTECTION AGENCY ~,.e~o~ WASHINGTON, D.C. 20460 %~ ,~.o~O OFFICE OF Dear UST Owner/Operator: SOLID WASTE AND EMERGENCY RESPONSE I am writing to you and all other owners and operators of underground storage tanks (USTs) to remind you that you have just two years remaining in which to make sure that your USTs comply with regulations aimed at protecting public health and ,the environment. Under regulations issued by the U.S. Environmental Protection Agency (EPA) eight years ago, USTs installed before December 22, 1988 must be protected against corrosion, spills, and overfills by December 22, 1998. Unprotected USTs must be upgraded, replaced, or properly closed by that date. If you have already complied with these requirements? I commend you on a significant contribution to public health and environmental protection. If you have yet to come into compliance, I want you to know that EPA has no intention of extending the deadline and that States do not have the authority to extend it. Early compliance could save you money. The longer you wait to protect your tanks, the more likely it is that they will have a release that could be costly in terms of cleanup costs and lost operating time. Waiting also means that you probably will encounter delays in getting tanks and other equipment delivered and installed and that you may have to pay higher prices than contractors would charge now. States and EPA are committed to' working with UST owners and operators to achieve compliance with the 1998 requirements. I must emphasize, however, that we also are committed to enforcing those requirements where UST owners or operators ultimately fail or refuse to comply. The purpose of this letter is to impress upon you the need to take immediate action. With that goal in mind, I urge you to return the property to compliance through cooperation with the Office of Environmental Services. I must inform you that failure to properly close (remove) the tank by December 4, 1998, may necessitate legal action, including, but not limited to misdemeanor citations and/or injunctive relief. Temporary closure is hereby granted under th® following conditions contained in Title 23 of the California Code of Regulations: 2671. TEMPORARY CLOSURE REQUIREMENTS (a) An Owner or operator shall comply with all of the following requirements to complete and maintain temporary closure of an underground storage tank: (1) All residual liquid, solids, or sludges shall be removed and handled in accordance with the applicable provisions of in accordance with Chapters 6.5 and 6.7 of Division 20 of the Health and Safety Code. (2) If the underground storage tank contained a hazardous substance that could produce flammable vapors at standard temperature and pressure, it shall be inerted, as often as necessary, to levels that will preclude and explosion or to lower levels as required by the local agency. (3) The underground storage tank may be filled with a non corrosive liquid that is not a hazardous substance. This liquid shall be tested and the test results submitted to the local agency prior to removal from the underground storage tank at the end of the temporary closure report. (4) Except for required venting, all fill and access locations and piping shall be sealed using locking caps or concrete plugs. (5) Power service shall be disconnected from all pumps associated with the use of the underground storage tank unless the power services some other equipment which is not being closed, such as the impressed-current cathodic protection system. (b) The monitoring required pursuant to the permit may be modified by the local agency during the temporary closure period. In making a decision to modify monitoring requirements, the local agency shall consider the nccd to maintain monitoring in order to detect unauthorized releases that may have occurred during the time the underground storage tank was used by that have not yet been detected. In all cases, corrosion protection shall continue to be operated. (c) The underground storage tank shall be inspected by the owner of operator at lease once every three months to verify that the temporary closure measures are still in place. The inspection shall include but is not limited to the following: (1) Visual inspection of all locked caps and concrete plugs. (2) If locking caps are used, at least on shall be removed to determine if any liquids or other substances have been added to the underground storage tank or if there has been a change in the quantity or type of liquid added pursuant to subsection (a) (3) of this section. (d) At the end of a temporary closure period over 12 months, including any extension granted by the local agency, the owner may reuse the underground storage tank only it the tank meets the requirements of Article 3 for new underground storage tanks or is upgraded to meet the requirements of Article 6. (e) All new and existing underground storage tank systems which have been temporarily closed must continue to comply with repair and recordkeeping requirements, release reporting and investigation requirements, and release response and corrective action requirements specified in this chapter and Chapter 6.7 of the Health and Safety Code. Failure to comply with the requirements will immediately terminate the temporary closure status. Upon termination of temporary closure, either through non-compliance or by expiration of the 12 month term, the tank(s) must either be integrity tested and repermitted for operation or else removed from the site under a valid permit for permanent closure. Site Description Brundage Car Wash Store is located at 2523 Brundage Road, Bakersfield, as shown in Figure (1). There were 2 x 10,000 gallon gasoline tanks (T1, T2). There was one dispenser island, which had 4-dispensers (D-l, 2, 3, 4). B. Tank Removal Activities (March 18, 1992) The general contractor was Redi-Rental Company of Santa Ana, CA. The rinsing-washing-pumping and the sludge transportation were done by Calvac Company of Santa Fe Springs. Attachment (A) shows the tank-pull permit obtained from the City of Bakersfield. Attachment (B) shows the manifest for the tank sludges disposed by Calvac Co. to Industrial Service Co. in L.A. Attachment (C) shows the disposal/destruction certificate for the two tanks. (i) C. Soil Sampling, Soil Description, and Analysis Report Western Environmental Engineering Co. with the supervision by Mr. C.A. Richards (Certified Engineering Geologist No. 50) took soil samples after the tank removal. The location of the soil samples are shown in Figure (2). The soil samples were taken as below; (1). From Under the Removed Tanks Tank T1 T2 North B-3 B-4 South B-I B-2 (2). From Dispenser Area D-l, D-2, D-3, D-4 The soil samples were described as shown in Attachment (E) according to the Unified Soil Classification Codes. The soil samples were analyzed' by Chemtek Environmental Laboratory located in Santa Fe Springs, CA. This lab is certified by the California Dept. of Health Services to conduct the required tests. (2) The results of the soil sample analysis are as shown in Attachment (F'). The soil sample whose TPH(EPA-8015M) exceeds 10 ppm is only one sample taken at B-l-12 (11.6 ppm). The remaining soil samples had all "ND" levels for TPH(gasoline) by EPA-8015M analysis. D. Conclusion As shown in the previous section, all of the soil samples analyzed show non-detectable levels of total petroleum hydro- carbon (TPH) contents, except for B-l-12 (11.60 ppm). The-soils underneath the tanks and the dispensers are clean.
