RESPONSE
I am writing to you and all other owners and operators of underground storage tanks
(USTs) to remind you that you have just two years remaining in which to make sure that
your USTs comply with regulations aimed at protecting public health and ,the environment.
Under regulations issued by the U.S. Environmental Protection Agency (EPA) eight
years ago, USTs installed before December 22, 1988 must be protected against corrosion,
spills, and overfills by December 22, 1998. Unprotected USTs must be upgraded, replaced,
or properly closed by that date. If you have already complied with these requirements? I
commend you on a significant contribution to public health and environmental protection.
If you have yet to come into compliance, I want you to know that
EPA has no intention of extending the deadline and that States do not have
the authority to extend it.
Early compliance could save you money. The longer you wait to protect your tanks,
the more likely it is that they will have a release that could be costly in terms of cleanup
costs and lost operating time. Waiting also means that you probably will encounter delays in
getting tanks and other equipment delivered and installed and that you may have to pay
higher prices than contractors would charge now.
States and EPA are committed to' working with UST owners and operators to achieve
compliance with the 1998 requirements. I must emphasize, however, that we also are
committed to enforcing those requirements where UST owners or operators ultimately fail or
refuse to comply.

The specific violations and remedial action necessary to return the
property to compliance has been provided to you in the order of
Corrective Action-Schedule for Compliance by the City of Bakersfield '
Fire Department, Office of Environmental Services, dated November 4,
1998.
The purpose of this letter is to impress upon you the need to take
immediate action. With that goal in mind, I urge you to return the
property to compliance through cooperation with the Office of
Environmental Services. I must inform you that failure to properly close
(remove) the tank by December 4, 1998, may necessitate legal action,
including, but not limited to misdemeanor citations and/or injunctive
relief.
I thank you in advance for your anticipated cooperation and,
should you have any questions conceming the necessary action or require

Bakersfield, California."
I am enclos£ng for your convenience a copy of the recorded Quit
Claim Deed, wherein SBA conveyed this property to these gentlemen.

Fire Department, Office of Environmental Services, dated June 16, 1995.
The purpose of this letter is to impress upon you the need to take
immediate action. With that goal in mind, I urge you to return the
property to compliance through cooperation with the Office of
Environmental Services. I must inform you that failure to properly close
(remove) this tank by November l 0, 1998, may necessitate legal action,
including, but not limited to misdemeanor citations and/or injunctive
relief.

Dear Mr. Klm:
This is to confirm that the waste oil underground storage tank has been granted temporary closure
by this agency for the 12 month period beginning December 8, 1995 and ending on December 8,
1996.
Temporary closure is hereby granted under th® following conditions contained in Title 23 of the
California Code of Regulations:
2671. TEMPORARY CLOSURE REQUIREMENTS
(a) An Owner or operator shall comply with all of the following requirements to complete and
maintain temporary closure of an underground storage tank:
(1) All residual liquid, solids, or sludges shall be removed and handled in accordance with
the applicable provisions of in accordance with Chapters 6.5 and 6.7 of Division 20 of
the Health and Safety Code.
(2) If the underground storage tank contained a hazardous substance that could produce
flammable vapors at standard temperature and pressure, it shall be inerted, as often as
necessary, to levels that will preclude and explosion or to lower levels as required by the
local agency.
(3) The underground storage tank may be filled with a non corrosive liquid that is not a
hazardous substance. This liquid shall be tested and the test results submitted to the
local agency prior to removal from the underground storage tank at the end of the
temporary closure report.
(4) Except for required venting, all fill and access locations and piping shall be sealed using
locking caps or concrete plugs.
(5) Power service shall be disconnected from all pumps associated with the use of the
underground storage tank unless the power services some other equipment which is not
being closed, such as the impressed-current cathodic protection system.
(b) The monitoring required pursuant to the permit may be modified by the local agency during
the temporary closure period. In making a decision to modify monitoring requirements, the
local agency shall consider the nccd to maintain monitoring in order to detect unauthorized
releases that may have occurred during the time the underground storage tank was used by
that have not yet been detected. In all cases, corrosion protection shall continue to be
operated.
(c) The underground storage tank shall be inspected by the owner of operator at lease once every
three months to verify that the temporary closure measures are still in place. The inspection
shall include but is not limited to the following:
(1) Visual inspection of all locked caps and concrete plugs.
(2) If locking caps are used, at least on shall be removed to determine if any liquids or other
substances have been added to the underground storage tank or if there has been a
change in the quantity or type of liquid added pursuant to subsection (a) (3) of this
section.
(d) At the end of a temporary closure period over 12 months, including any extension granted by
the local agency, the owner may reuse the underground storage tank only it the tank meets the
requirements of Article 3 for new underground storage tanks or is upgraded to meet the
requirements of Article 6.
(e) All new and existing underground storage tank systems which have been temporarily closed
must continue to comply with repair and recordkeeping requirements, release reporting and
investigation requirements, and release response and corrective action requirements specified
in this chapter and Chapter 6.7 of the Health and Safety Code.
Failure to comply with the requirements will immediately terminate the temporary closure status. Upon
termination of temporary closure, either through non-compliance or by expiration of the 12 month
term, the tank(s) must either be integrity tested and repermitted for operation or else removed from
the site under a valid permit for permanent closure.

As a follow up to our telephone conversation on July 5, 1995 regarding the Notice
of Violation for the underground tank located at the property described above, the
following must be done in order to avoid further legal action:
1. Remove all petroleum waste liquids from the underground tank and
adjacent lube pit. The removal must be performed by a licensed
hazardous waste hauler and disposed of at a properly permitted
facility.
2. Forward copies of the waste oil removal manifest and disposal
receipt to this office, along with a letter requesting '~emporary
closure" of the underground waste oil tank.
The work described above must be completed and supporting documents
forwarded to this office within 30 days of this letter.

tank(s) have not been properly permitted and have been out of service, therefore you are in
violation of the following sections of the Uniform Fire Code as adopted by the Bakersfield
Municipal Code, Chapter 15.64, Ordinance No. 3502:

Please forward either a copy of your existing State approved mechanism to show financial responsibility or else
complete the attached Certification of Financial Responsibility form.
An attached letter from the State Water Resources Control Board lists the approved financial responsibility mechanisms
required to pay for corrective actions resulting from leaking underground fuel tanks.
Remember, most tank owners only have to show financial responsibility for at least $10,000 of clean up lability. The
Underground Storage Tank Clean Up Fund (USTCF) may be used as the mechanism to cover the remaining aocidental release
liability.
The total amounts of financial responsibility required (check boxes from section A of form) are as follows:
If you don't sell product from you tanks, and you pump less than 10,000 gallons per month,
check "$500,000 per occurrence". Else, or if you are in the business of selling from your
tanks, check '1 million dollars per occurrence".
For owners of 101 or more petroleum underground storage tanks, check the '2 million dollar
annual aggregate" box. All others need only check the "1 million dollars annual aggregate'
box.
Please be aware that failure to provide the financial responsibility document to this office within 30 days will result in
your Permit to Operate being revoked. (25285.1 (b) California Health & Safety Code). ~

Dear Mr. Haddadin:
It has come to our attention that you currently own property located at 2523 Brundage Lane, in
Bakersfield which contains at least one underground storage tank. The tank have not been
properly permitted and have been out of service, therefore you are in violation of the following
sections of the Uniform Fire Code as adopted by the Bakersfield Municipal Code, Chapter 15.64,
Ordinance No. 3502:
Section 79.115 (a,b,& f) Uniform Fire Code, (1992 edition)
(a) Failure to remove or safeguard an out of service tank(s).
(b) Failure to obtain a permit to remove or temporarily close an underground storage
tank.
(f) Failure to remove an underground tank out of service for one (1) year.
In order to avoid regulatory action, you must either properly permit and bring the tank up to
code, or else apply for a proper abandonment and removal of the tank within 14 days of this
notice.

THE PERMIT TO OPERATE YOUR UNDERGROUND STORAGE TANK(S)
HAS EXPIRED AND WILL NOT BE REISSUED UNTIL YOUR STORAGE
TANK(S) ARE BROUGHT INTO COMPLIANCE.
Our records indicate that you have not performed an annual underground tank system
tightness test in the last year. This annual tightness test was a condition of your
previous permit to operate which has now expired as of June 30, 1994.
Herein, you are granted a conditional authorization to continue to operate, your
underground storage tank(s) for the next 30 days. During this interim, you must submit
proof to this office that you have arranged for the tank system tightness test. ^ valid
permit issued within the next 30 days by this office, to perform a tightness test at your
underground tank site will satisfy the interim condition.
If you do not respond to this notice within 30 days either by providing proof of an annual
tightness test performed within the last year, or obtaining a permit now to do so, you will
be required to cease underground tank operations until compliance is achieved.

In the inspection of The Brundage Car Wash Located at 2523 Brundage Lane,
Bakersfield, CA 93304 ON March 9, 1994 the following Hazardous Materials
regulation violations were identified.
1) Waste oil was present in large quantities in the former Lubricating pit. This
unauthorized release has not been properly reported and does pose a public safety
threat.
VIOLATION OF CALIFORNIA HEALTH AND SAFETY CODE
CHAPTER 6.7, SECTION 25295
(a) (1) Any unauthorized release which escapes from the secondary
containment, or from the primary containment, if no secondary containment exists,
increase the hazard of fire or explosion, or causes any deterioration of the secondary
containment of the underground tank system shall be reported by the operator to the
local agency within 24 hours after the release has been detected or should have been
detected. A full written report shall be transmitted by the owner or operator of the
underground tank system within five working days of the occurrence of the release. The
report shall describe the nature and volume of the unauthorized release, any corrective
or remedial actions undertaken, and any further corrective or remedial actions, including
investigative actions, which will be needed to clean up the unauthorized release and
abate the effects of the release and a time schedule for implementing these actions.
VIOLATION OF SEC 80.104 OF THE UNIFORM FIRE CODE
Hazardous materials shall not be released into a sewer, storm drain, ditch,
drainage canal, lake, river or tidal waterway, or upon the ground, sidewalk, street,
highway or into the atmosphere.
NOTE: This hazardous waste must be cleaned up and properly disposed off by Friday
March 11 and a copy of the Uniform Hazardous Waste Manifest must be forwarded to
this office. When the Liquid is removed a inspection will be made to determine if any
additional contamination is present and if soil testing is required.
2) The Underground waste oil tank is not properly permitted and has been out of service
for more than 90 days

pressure for a compressed gas, or if the substance is a radioactive material which is
handled in quantities for which an emergency plan is required to be adopted pursuant
to Part 30 (commencing with Section 30.1), Part 40 (commencing with 40.1), or Part 70
(commencing with 70.1 ) of Chapter 10 of Title 10 of the Code of Federal Regulations (54
Federal Register 14051), or pursuant to any regulations adopted by the state in
accordance with those regulations, shall establish and implement a business plan for
emergency response to a release or threatened release of a hazardous material in
accordance with the standards in the regulations adopted pursuant to Section 25503.

RE: Monitoring requirements for underground storage tanks.
Dear Business Owner:
Our records reveal that no precision tank testing has been
performed on the underground storage tank located at 2523 Brundage
Lane.
Section 2643 2(A) of Article 4; Title 23, Div. 3, Chapter 16,
CCR., requires that all underground tanks that do not utilize
automated leak detection shall have a precision tank test annually.
Additionally, pressurized piping shall be tested annually and non-

A. Site Description
Brundage Car Wash Store is located at 2523 Brundage Road,
Bakersfield, as shown in Figure (1).
There were 2 x 10,000 gallon gasoline tanks (T1, T2).
There was one dispenser island, which had 4-dispensers (D-l,
2, 3, 4).
B. Tank Removal Activities (March 18, 1992)
The general contractor was Redi-Rental Company of Santa Ana, CA.
The rinsing-washing-pumping and the sludge transportation were
done by Calvac Company of Santa Fe Springs.
Attachment (A) shows the tank-pull permit obtained from the City
of Bakersfield.
Attachment (B) shows the manifest for the tank sludges disposed
by Calvac Co. to Industrial Service Co. in L.A.
Attachment (C) shows the disposal/destruction certificate for
the two tanks.

C. Soil Sampling, Soil Description, and Analysis Report
Western Environmental Engineering Co. with the supervision by
Mr. C.A. Richards (Certified Engineering Geologist No. 50) took
soil samples after the tank removal. The location of the soil
samples are shown in Figure (2).
The soil samples were taken as below;

The soil samples were described as shown in Attachment (E)
according to the Unified Soil Classification Codes.
The soil samples were analyzed' by Chemtek Environmental
Laboratory located in Santa Fe Springs, CA. This lab is
certified by the California Dept. of Health Services to
conduct the required tests.

The results of the soil sample analysis are as shown in
Attachment (F').
The soil sample whose TPH(EPA-8015M) exceeds 10 ppm is only
one sample taken at B-l-12 (11.6 ppm).
The remaining soil samples had all "ND" levels for TPH(gasoline)
by EPA-8015M analysis.
D. Conclusion
As shown in the previous section, all of the soil samples
analyzed show non-detectable levels of total petroleum hydro-
carbon (TPH) contents, except for B-l-12 (11.60 ppm).
The-soils underneath the tanks and the dispensers are clean.
