Dear Ms. Robinson:
This is in connection with that certain Lease dated as of February 21, 1978 (the
"Lease"), between you, as Lessor, and Dob's Tire and Auto Centers, a California corporation,
predecessor in interest to Phoenix Racing, Inc., d/b/a Tires One, as Lessee, covering the premises
located at 2575 Brundage Lane, Bakersfield, California (the "Premises").
As you know, there is an underground storage tank for waste motor oil located at
the Premises which is no longer in use. We understand that the tank was installed prior to 1978.
The U.S. Environmental Protection Agency and California State Water Resources Control Board
require the upgrade, replacement or. clo~ure of all underground storage tanks which do not meet
current regulations by December 22, 1998. We understand that the tank does not comply with
current regulations and must be brought into compliance or closed. We have been informed that
the penalties for noncompliance can be as high as $11~000 per day for civil penalties and $27,500
per day for judicial penalties.
It is not in the interest of either of us to have an underground storage tank on the
Premises which is not in compliance with current regulations. As you are the respon§ible party
under applicable law, you must ensure the tank is brought into compliance or closed by the,
December 22 deadline. As we do not intend to use the tank, we prefer that the tank be closed and
removed. Please telephone me by no later than November 20, 1998 to discuss your plans
regarding this matter.

On July 9, 1998, you were notified to contact our office to discuss informal resolution of an illegal
condition existing on your property.
NOTICE IS HEREBY GIVEN, pursuant to Bakersfield Municipal Code Chapter 8.80, that the
condition of your property constitutes a public nuisance, in violation of Bakersfield Municipal Code
section(s) 8.27.010 (E)namely: wall maintained in such condition of deterioration or disrepair
as to be unsafe.
YOU ARE HEREBY NOTIFIED that you may remove or repair the condition before the date of
hearing stated below. Otherwise, the City of Bakersfield may obtain permission to remove the
illegal condition. If the illegal condition has not been resolved within the time specified above, you
will be charged a $145.00 administrative fee to cover the cost of reinspection. This fee, and any
other costs necessary, to remove the violation will be charged to you personally and/or will be
assessed against the land and can be foreclosed on or made a tax assessment which will be placed
on the tax rolls to be collected.
YOU ARE FURTHER NOTIFIED to appear before the Building Director for the City of
Bakersfield on September 1. 1998, at the hour of 10:00 a.m,, at 1715 Chester Avenue, Bakersfield,
California to show cause, if any you have, why said nuisance should not be found to exist and the
same ordered abated.
YOU ARE FURTHER NOTIFIED that at the above-stated hearing you may call witnesses to
testify on your behalf, present documentary evidence, cross-examine witnesses, and otherwise show
why said nuisance should not be ordered abated. You may be represented by legal counsel at your
own expense.
SHOULD YOU FAIL TO APPEAR AT SUCH HEARING it shall be deemed a waiver of your right

found, after consideration of all the evidence presented, that a condition constituting a public
nuisance does exist at 2575 Brundage Lane (APN 147-071-01) and there is the necessity for timely
abatement of this nuisance, to wit: wall maintained in such condition of disrepak as to be unsafe.
AND, IT IS HEREBY ORDERED, the City of Bakersfield proceed with the abatement of the
nuisance pursuant to the provisions of Chapter 8.80 of the Bakersfield Municipal Code and all other
applicable provisions thereof.
NOTICE IS FURTHER GIVEN you may appeal this decision to the City Council by filing with
the City Clerk, at 1501 Tmxtun Avenue, Bakersfield, California 93301, a written request to appeal

location listed above as required by the City of Bakersfield. The total bill is $10,423.99 however we feel
we should pay ,for the travel time, which is $2,115.00. Your share is $8,308.99, which we will deduct
from the rent. The amounts to be deducted are as follows:
