O'Neil of Phoenix Racing Inc., stating that you have an underground PREVENTION SERVICES storage tank (UST) located at 2575 Brundage Lane, in Bakersfield 1715 Chester Ave. Bakersfield, CA 93301 California. ENVIRONMENTAL SERVICES A review of our files could find no evidence of a underground 1715 Chester Ave. Bakersfield, CA 93301 storage tank being installed at that address, or a underground storage tank VOICE (805) 326-3979 FAX (805) 326-0576 ever being permitted, or reported at that address. To confirm the existence of a UST on site, one of our inspectors completed a visual inspection of vmun~No OmSIOn the property today, December 8, 1998. As you know, there is an underground storage tank for waste motor oil located at the Premises which is no longer in use. We understand that the tank was installed prior to 1978. The U.S. Environmental Protection Agency and California State Water Resources Control Board require the upgrade, replacement or. clo~ure of all underground storage tanks which do not meet current regulations by December 22, 1998. We understand that the tank does not comply with current regulations and must be brought into compliance or closed. We have been informed that the penalties for noncompliance can be as high as $11~000 per day for civil penalties and $27,500 per day for judicial penalties. It is not in the interest of either of us to have an underground storage tank on the Premises which is not in compliance with current regulations. As you are the respon§ible party under applicable law, you must ensure the tank is brought into compliance or closed by the, December 22 deadline.
