A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ENDORSING APPLICATION FOR AN
ENVIRONMENTAL ENHANCEMENT AND MITIGATION
PROGRAM GRANT FOR LANDSCAPE IMPROl/E~ENTS AT
HIGHWAYS 99, 58, AND 178 IBT~KC/4ANGE.
WHEREAS, t.he Environmental Enhancement and Mitigation
Program was established by Section 164.56 of the Streets and
Highways Code which was added by Chapter 106 of the statutes of
1989 (AB 471); and
%~{EREAS, the Program provides grant funds to local,
state, and federal .agencies and nonprofit entities to mitigate
the environmental impact of modified or new public transportation
facilities; and
WHEREAS, the Resources Agency of California has been
delegated the responsibility for the administration of the
program within the state, setting up necessary procedures
governing application by local agencies and nonprofit
organization under the program; and
WHEREAS, said procedures established by the Resources
Agency of California require the applicant to certify by
resolution the approval of application(s) before submission of
said application(s) to the state; and
WHEREAS, the City of Bakersfield, ("City") wishes to
submit an application for said funds for landscape improvements
at Highways 99, 58, and 178 Interchange; and
WHEREAS, the prospects of receiving such a grant are
reasonably likely.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. The filing of an application for the landscape
improvements at Highway 99, 58, and 178 Interchange under the
Environmental Enhancement and Mitigation Program is hereby
approved.
2. The City Manager is hereby authorized, with the
concurrence of the City Attorney, to conduct all negotiations,
execute and submit all documents including, but not limited to
application, agreements, amendments, payment requests an so on
which may be necessary for the completion of the aforementioned
project.
