RESOLUTION NO. 155-90
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ORDERING THE VACATION OF THE
EASTERLY PORTION OF 5TH STREET IN LOWELL
PARK TRACT (BLOCK E) IN THE CITY OF
BAKERSFIELD.
WHEREAS, on October 17, 1990, the Council of the City of
Bakersfield, pursuant to the provisions of the "Public Streets,
Highways and Service Easements Vacation Law," being Chapter 3 of
Part 3 of Division 9 of the Streets and Highways Code of the State
of California, passed and adopted its Resolution of Intention No.
1075 declaring its intention to order the vacation of the easterly
portion of 5th Street in Lowell Park Tract (Block E) in the City
of Bakersfield, County of Kern, State of California; and
WHEREAS, said Council did fix a time and place for hearing
all persons interested in or objecting to said proposed vacation,
which said hearing was held on WEDNESDAY, NOVEMBER 28, 1990, after
notices were duly published and posted as required by law; and
WHEREAS, this Council after duly considering the matter,
does hereby find and resolve as follows:
1. That the vacation of easterly portion of 5th street
in Lowell Park Tract (Block E) in the City of Bakersfield, County
of Kern, State of California, more particularly described in
Exhibit "A" attached hereto and made a part hereof, is unnecessary
for present or prospective street or easement purposes.
2. That the vacation of the easterly portion of 5th
street in Lowell Park Tract (Block E) in the City of Bakersfield,
County of Kern, State of California, be and the same is hereby
closed up, vacated and abandoned for public street purposes.
Reference to said Resolution of Intention No. 1075 is hereby made
for further particulars.
3. That the City Clerk shall certify to the passage of
this Resolution an~ shall cause a certified copy hereof, attested
by the Clerk under the seal of the City, to be recorded in the
office of the County Recorder of the County of Kern, California.

All of that portion of 5th Street (60 feet in width) in LOWELL PARK TRACT lying
between the Southerly prolongation of the West line of Lot 13 and the Westerly
right of way line of the Kern Island Canal as said street, lots and canal are
shcwn on said LOWELL PARK I~ACT filed December 30, 1926 in Book 3 of Maps, Page
184 in the office of the KErn County Recorder.
RESERVING THEREFROM a nonexclusive easement and right of way for public utili-
ties, to lay, construct, oE~rate, maintain, repair, reconstruct, change the size
of or remove pipelines, conduits, cable, wires, poles or any other structures,
fixtures or equipment, in, under, across, over and upon the south 15 feet of the
north 22 feet and the west 15 feet of the North 15 feet of the South 22 feet of
the above described portion of 5th Street.
