A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD RESCINDING RESOLUTION NO. 134-88
DECLARING THE PUBLIC I~T~REST AND NECESSITY
FOR THE TAKING OF CERTAIN PROPERTY LOCA'i'~
BWI~ENHOSKING ROAD ANDASTORAVENuS, NORTH
OF SF~ANNON DRIVE IN THE GREENFIELD AREA,
OUTSIDE THE CITY LIMITS, FOR THE PURPOSE OF
ACQUIRING ~ FOR W~£~a~ LINE PUP~OSES
TO A SUBDIVISION IN '£~u~ CITY (CODE OF CIVIL
PROCEDURES SECTION 1245.230).
WHEREAS, on July 6, 1988 Resolution No. 134-88 was
approved by the Council of the City of Bakersfield; and
WHEREAS, the Subdivider of Tract 5029 no longer intends
to develop the Tract and water supply is no longer a necessity.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. That the property which was to be acquired,
described in Exhibit "A" attached hereto, for the purpose of a
water line easement is no longer needed to provide water service
to Tract 5029.
2. That the necessity, for which eminent domain
proceedings to acquire property necessary for public use, no
longer exists.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on N0¥ 7 199~ , by the
