(ESE) for the above-referenced site has been reviewed. ESE has recommended excavation of the former pit areas (sludge, N.P. and S.P.L.) with the disposal of the contaminated soil at an approved landfill (McKittriek). This Department agrees, provided that the excavation of the impacted area extends to a minimum depth of 20 feet below surface grade (BSG). This depth is deemed necessary due to high historical groundwater of approximately 20 feet BSG. The Regional Water Quality Control Board (RWQCB) concurs with this office. Excavation of TH1, TH2 at the former clarifiers shall alsoextend to a minimum depth of 20 feet BSG, to assure that the threats posed by the contamination to high historical groundwater are minimized. This office and the RWQCB has no objections to on-site bioremediation of the excavated soil removed at the former clafifier areas. ESE has suggested that the bioremediated soil be used as surface paving after the bioremediated' treatment of the impacted soil has reduced the contamination to' acceptable levels o£ 100 ppm diesel. Photo ionization detector field instrument readings.of 50 ppm or less will indicate that the excavated areas may undergo soil sampling for analyses at a state certified laboratory. Forty-eight (48) hours prior notice is required by this office before excavatiOn activities begin. Upon completiOn of the remediation activities your consultant will prepare a final report. A copy of the report, including all shipping manifests for the soils removed from the pit areas shall be forwarded to this Department for review. Upon a satisfactory demonstration that all of the above actions have been completed, a modified closure letter 'will be issued by this office. (E.S.E.) has been reviewed by this office. Note: Pages 15, 16, and 17 were not included in the report. The areas of concern are TH-l, TH-2, TH2-A at the previous clarifier, and sludge present at 3 feet below the surface grade. TPH as diesel in mounts of 12,000 ppm in sludge plus oil and grease levels from 7,900, 10,000, and 45,000 ppm indicate cleanup actions will be necessary. E.S.E. has reported that groundwater is presently at 50 feet below surface grade. However, historical groundwater has been noted. at approximately 20 feet below surface grade. Since the existing contamination poses a threat to ground- water and cannot remain in place, remedial activities are indicated. Your consultant should provide several recommendations for remedial actions. The acceptable levels of contamination remaining in the soil after cleanup shall not exceed 100 ppm diesel. A copy of the remedial action workplan shall be forwarded to this office for review and approval before remedial activities commence. Dear Mr. Keith: REPORT OF VIOLATIONS On August 27, 1987 the Department of Health Se~ices (DHS) conducted an inspection of Don Keith T~cking. As a result of that inspection, violations of hazardous waste statutes and repletions were identified. Violations 1. Section 66471, Title 22, California Administrative Code: This "' section re~ires .a person who generates a waste to dete~ine if '~:~'~:~?, that waste is hazardous or non-hazardous by the criteria in .,. Articles 9 and 11 of Title 22, California Administrative Code. Don Keith T~cking generated a waste from their t~ck wash out '.'~%-:':~:-~.~.~:'~ .... sump. This waste stream was transported by M.P. Vacuum of Oildale and disposed of at the Li~id Waste Management site in McKittrick, without being fully characterized..=This transacti0~.~~ took place on June 16, 1987 and was recorded by non-hazardous waste hauler record 94736 provided by M.P. Vacuum. ii. Schedule for Compliance 1. I~ediately comply with ~the hazardous waste storage and ... handling practices specified in Chapter 6.5, Division 20, ~-~ ~.. '~. Health and Safety Code and Chapter 30, Title 22, California Administrative Code. 2. Within 60 days provide written doc~entation that all waste· ~" streams will be characterized by the criteria in Article 9 -2- and 11 of Title 22, California Administrative Code prior to transporting, storing, treating or disposing of that waste. The information submitted must be accompanied by one of the attached certificiates signed by yourself or an authorized agent of your company. Please send written certification, which contains the sample certification statement indicated on the enclosed sheet, to this office as soon as the above corrections have been completed. The Department may schedule a re-inspection of Don Keith Trucking to verify compliance. The issuance of this Report of Violations and Schedule for Compliance does not preclude DHS from taking administrative, civil, or criminal action as a result of the violations noted herein.
