conditions, it is the position of this office that no further action is required at this time.
Please be advised that this letter does not relieve you of any liability under the Code of
Federal Regulations or Water Code for past, present, or future operations at the site.
Further, it does not relieve you of the responsibility to clean up existing, additional, or
previously unidentified conditions at the site which cause or ihreaten to cause pollution or
nuisance or otherwise pose a threat to water quality or public health.
Additionally, be advised that changes in the present or proposed use of the site may

Dear Mr. Cooper:
The results of the samples retrieved on March 17, 1993, at the above-noted facility have
been received by this Department. Our review has determined that the hazardous waste
toxicity criteria for metals has not been exceeded in the soil sampled at the leach line, nor
have the samples analyzed for total organics and toxic organics exceeded acceptable levels
as cited in the Safe Drinking Water Act (SDWA) of 1974.
In reference to our telephone conference of July 22, 1993, this office agrees that
abandonment (fill with cement) of the catch basin would be prudent to prevent possible
illegal disposal of the above-noted wastes to the septic system. The abandonment of the
catch basin should be accomplished within 30 days of receipt of this letter. Upon
confirmation that the catch basin abandonment has been completed, this office will issue
a closure letter for the facility.

BSK & Associates (BSK) is pleased to present analytical results for the above-referenced project.
This work was authorized by Mr. Wim Cooper by written agreement dated February 24, 1993,
and was conducted in conformance with the requirements of the Kern County Environmental
Health Services Department (KCEHSD) and the U. S. EPA.
A soil sample was obtained from beneath the leach line on March 17, 1993, under the direction
of Mr. Terry Gray of the KCEHSD. Soil sampling location is shown on Figure 1. The sample
was obtained at a depth of approximately one foot beneath the line by a BSK geologist. Prior to
sampling, the equipment was decontaminated by washing in laboratory grade detergent and rinsed
with deionized water. The sample was collected, stored and transported in accordance with
guidelines outlined in U.S. EPA Test Methods for Evaluating Solid Waste, Physical/Chemical
Methods: SW-846, Third Edition. Chain-of-Custody documentation was maintained during
sample collection and transport.
The sample was analyzed for volatile organic compounds and total petroleum hydrocarbons as
gasoline by EPA Method 8260, total recoverable petroleum hydrocarbons by EPA Method 418.1,
semivolatile organic compounds by EPA Method 8270, and CCR Tire 22 metals by Zymax
Envirotechnology of San Luis Obispo, California. The sample was analyzed for total petroleum
hydrocarbons as diesel using DHS GC/FID Method by BSK Analytical Laboratories. Copies of
the analytical results and Chain-of-Custody documentation are attached.

Findings presented in this report are based on laboratory testing of a discrete soil sample obtained
from the site. Reported results may not reflect actual concentrations which may exist at other
locations on the site. Findings are valid as of the date of the report. Passage of time, natural
processes, or human intervention on the property can cause changed conditions which can
invalidate the f'mdings and conclusions presented. This report provides neither certification nor
guarantee that the property is free of toxic or hazardous materials.
We have prepared this report for the exclusive use of the client. Unauthorized use or reliance
on the information contained in this report, unless given express written consent by BSK, is
prohibited. This report has been prepared in accordance with generally accepted engineering
practices for the area, based on guidelines of local and federal agencies. No warranties, either

SUBJECT: CLASS V SHALLOW INJECTION WELL LOCATED AT 3329 PIERCE
ROAD, BAKERSFIELD, CA
Ladies and Gentlemen:
This letter is an official 'notice to inform you that the property noted above has been
determined by Kern County Environmental Health Services Department to be the site of
a Class V shallow injection well. This notice is being sent to you because you have been
identified as the owners of the property listed above.
Pursuant to Code of Federal Regulations 40, (40 CFR), Section 144.12 (a) provides that "no
owner or operator shall...operate [an injection well]...in a manner that allows the movement
of fluid containing any contaminant into underground sources of drinking water, if the
presence of that contaminant may cause a violation of any primary drinking water
regulation...or may otherwise adversely affect the health of persons."
There is evidence that a wash rack located at the rear of the office building discharges to
the ground. Within thirty (30) days of receipt of this notice, compliance must be initiated
with the guidelines cited in the enclosed copy of EPA-REGION 9 GUIDELINES FOR
CLOSURE OF SHALLOW DISPOSAL WELLS. The booklet cites the minimum
requirements for site work plan activities, contractor requirements, example illustrations of
well designs, and sampling methods and procedures. Be advised that KCEHSD may have
additional requirements not listed in the EPA closure guideline booklet.
In accordance with Kern County Ordinance Code G-5541, Section 8.04.100 the Department
is authorized to charge for inspections, review of reports, and laboratory service costs
incurred in the process of obtaining compliance with any violations noted. Be advised that
you will be billed at the rate of $24.80 per hour for oversight during the abatement of
violations connected to the Class V well.

Gentlemen:
In accordance with your request, we have obtained a soil sample from
below a concrete sump at the above-referenced site. The sampling was
conducted on May 17, 1988 by Tony Martin and was delivered to BC
Laboratories for analysis. The results of the chemical analysis appear to
indicate that no significant contamination of the soil has occurred from leakage
of fluids from the sump.
A visual inspection oi the excavated portion of the sump and the soil
beneath the sump was conducted. The soil below and around the sump appeared
to be ol normal color. No unnatural odors emanated from the soil. The sump
itself appeared to be working as designed.

SUBJECT: HAZARDOUS WASTE STORAGE VIOLATIONS LOCATED AT
3329 PIERCE ROAD, BAKERSFIELD, CA
NOTICE OF VIOLATIONS
Dear Mr. Martin:
On January 25, 1993, an inspection was conducted at the facility noted above. As a result
of that inspection, violations of hazardous waste regulations and statutes were identified.
Specific violations are listed below.
VIOLATIONS
It has been determined that the facility is in violation of the following regulations and
statutes cited below:
1. The facility is in violation of California Code of Regulations, Chapter 30, Title
22, Section 66262.34(f)(1)(2)(3)(A)(B)(C).
"Generators who accumulate hazardous waste on site without a permit or
grant of interim status shall comply with the following requirements: the
date upon which each period of accumulation begins shall be clearly
marked a~ui visible for inspection on each container and portable tank;
the date the 90 day period begins, forpurposes of Subsection (a) and (b)
of this Section, shall be clearly marked and visible for inspection on each
contab~er and tank. All containers and portable tanks shall be labeled
with the following information: The composition and physical state of the
wastes, statement or statements which call attention to the particular
hazardous properties of the wastes (e.g. flammable, reactive, etc.) and the
name of the person producing the wastes."

It was determined during the inspection that none of the containers storing hazardous
waste were labeled in accordance with the above requirements.
2. The facility is in violation of California Code of Regulations, Chapter 30, Title 22,
Section 66264.173.
"A container homing hazardous waste shall always be closed during
transfer and storage, except when it is necessary to add or remove waste."
It was observed during the inspection that containers storing hazardous waste oil were
open while not in the process of adding or removing waste.
3. The facility is in violation of California Code of Regulations, Chapter 16, Title 22,
Section 66266.130 (c)(3).
"In accordance with subsection (a) of this section, used oil filters must
meet the conditions of subsection (b) of this section and are managed
atwl recycled in compliance with the following requirements shall not be
managed as a hazardous waste." "The drained used oil filters are
accumulated, stored, and transferred in a closed, rainproof container that
is capable of contab~ing any used oil that may separate from the filters
placed inside. Containers shall be labeled as drained used oil filters and
show initial date of accumulation or receipt on each container of filters."
It was determined during the inspection that used oil filters were not contained or
labeled in accordance with the above requirements.
ORDER TO CORRECT
Upon receipt of this letter, the facility owners or operator must correct all deficiencies noted
in this Notice of Violation within thirty (30) days, and submit to the Department written
documentation that all violations have been corrected. You may obtain an identification
number by calling the California Environmental Protection Agency, Department of Toxic
Substances Control at (916) 324-1781.
In accordance with Kern County Ordinance Code G-5541, Section 8.04.100 the Department
is authorized to charge for inspections, review of reports, laboratory service costs and any
other costs incurred in the process of obtaining compliance with any violations noted. Be
advised that you will be billed at the rate of $80.00 per hour for time spent to date as well
as future oversight costs incurred during the abatement of these violations.
