Dear Mr. Chaudoin: 48 HOUR NOTICE Your facility located, at 3400 Pier~e Road, Bakersfield, Ca, was inspected by this office on Monday, October 7, 1991 and by the City of Bakersfield Building Department again on Wednesday, October 9, 1991. Although the product that was stored in the building on Monday had been moved to an outdoor location by Wednesday, we still find the outdoor storage of toxic gasses are covered by the 1988 Uniform Fire Code as follows: Article 80.303, Section 11, 2.,A A. Distance limitation to exposures. The exterior storage of highly toxic or toxic compressed gases shall not be within 75 feet of a building, property line, street, alley, public way or exit to a public way unless the storage is shielded by a structure having a minimum fire-resistive rating of two hours and which interrupts the line of sight between the storage and the exposure. The protective structure shall be at least 5 feet from any exposure. The protective structure shall have not more than two sides at approximately 90 degree directions, except that a third diagonal section may be used at the vertex. The building department has already issued a correction notice outlining the correction necessary before.the building can be used for the storage of Methyl Bromide or Vikane. The outdoor storage situation must also by corrected within 48 hours of this notice. The effective time for remedial action will therefore be 5:00 p.m. Friday, October 11, 1991. ... Obtain Site Plan Review for change of use or occupancy. 2. Submit plans for approval to obtain a building permit. Plans to show compliance with a change to an H-7 occupancy shall include but is not limited to the following: a. One-hour protection for exterior walls within 20' of property line. b. Mechanical ventilation as required by the Fire Code and Mechanical Code. c. VIOLATION OF CALIFORNIA HEALTH AND SAFETY CODE CHAPTER 6.95, 25504 Business plans shall include all of the following: (b)Emergency response plans and procedures in the event of a rePortable or threatened release of a hazardous material, including, but not limited to, all of the following: (1) Immediate notification to the administering agency and to appropriate local emergency rescue personnel and the office. (2) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (3) Evacuation plans and procedures, including immediate notice, .for the business site. 5) Toxic and Highly Toxic gasses stored improperly. VIOLATION OF UFC 80.315 (a) Indoor Storage. 1. General. Indoor storage of other health hazard solids, liquids and gases shall be in accordance with the provisions of Sections 80.315 (a) and (c) and the general provisions specified in Section 80.301. 2. Exempt amounts. When the amount of health hazard solids, liquids and gases exceeds that specified in Table No. 80.315-A, such storage shall be within a room or building conforming to the Building Code requirements for a Group H, Division 7 Occupancy. 3. Liquid-tig~ floors. In addition to the provisions of Section 80.301(z), floors of storage rooms shall be of liquid-tight construction. 5. Containment. Secondary Containment shall be provided in accordance with the provisions of Section 80.301(1)4. (c) Breathing Apparatus. Where other health hazard solids,.liquids and gases are stored, a minimum of two self-contained breathing apparatus shall be provided. The breathing apparatus shall be suitable for use with the materials stored and shall be located near the immediate area'of storage in a location that provides safety to those expected to don the apparatus. Street Norco Ca. 91760 Dear Mr Chaudoin: NOTICE OF VIOLATION In the inspection of your business Division of Fumigation located at 3400 Pierce Rd., Bakersfield, Ca.93308 on October 7th. the following Hazardous Materials regulation violations were identified: 1) Hazardous Materials Business Plan inaccurate and incomplete. VIOLATION OF CH. 6.95'CALIFORNIA HEALTH AND SAFETY CODE SEC.25505 (b) In addition to the requirements of Section 25510, whenever a substantial change in the handler's operations occurs which requires a modification of its business plan, the handler shall submit a copy of the plan revision to the administering agency within 30 days of the operational change. (c) The handler shall, in any case, review the business plan, submitted pursuant to subdivisions (a) and (b), on or before January 1, 1988, and at least once every two years thereafter, to determine if a revision is needed and shall certify to the administering agency that the review was made and that any necessary changes were made to the plan, A copy of these changes shall be submitted to the administering agency as part of this certification. (d) Unless exempted from the business plan requirements under this chapter, any business which handles a hazardous material shall annually submit a completed inventory form to the administering agency of the county or city in which the business is located. Notwithstanding any other provisions of the law, an inventory form shall be filed on or before January 1, 1988, for the 1988 calendar year, and annually thereafter. This inventory shall be filed annually, notwithstanding the review requirements of subdivision (c). 2) Compressed gas cylinders not properly secured. VIOLATION OF UFC SECTION 74.107 AND BAKERSFIELD MUNICIPAL CODE, SECTION 15.64.110 Section 74.107, Storage and Use of Cylinders, of the Uniform Fire Code is amended to read: All compressed gas cylinders in service or in storage shall be adequately secured to prevent falling or being knocked over. This shall be accomplished by the installation of safety chains of suitable size or other restraining methods approved by the Bureau of Fire Prevention. 3) Hazardous materials training not available for "crew" employees. VIOLATION OF OSHA 1910.1200(H) (2) Training. Employee training shall include at least: (i)Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when. being released, etc.); (ii)The physical and health hazards of the chemicals in the work area; (iii)The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and, (iv)The details of the hazard communication program developed by the employer, including an explanation of the labeling system and. the material safety data sheet, and how employees can obtain and use the appropriate hazard information. (h) Employee information and training. Our concerns are that the business plan and inventory submitted for this faCility are inaccurate, that acutely hazardous materials are stored at this facility, however an Acutely Hazardous Materials Registration form has not been submitted, and that the building occupancy level may be inappropriate for the current usage. Chapter 6.95 of the California Health and Safety Code does provide for civil penalties, for failure to properly report, of up to $2,000 for each day in which the violation occurs. Further, if in our inspection we do find violations that pose a current threat to public safety, these violation will require satisfactory mitigation before work can resume at that facility. VIOLATION OF CH. 6.95 CALIFORNIA HEALTH AND SAFETY CODE SEC.25505 (b) In addition to the requirements of SectiOn 25510, whenever a substantial change in the handler's operations occurs which requires a modification of its business plan, the handler shall submit a copy of the plan revision to the administering agency within 30 days of the operational change. (c) The handler shall, in any case, review the business plan, submitted pursuant to subdivisions (a) and (b), on or before January 1, 1988, and at least once every two years thereafter, to determine if a revision is needed and shall certify to the administering agency that the review was made and that any necessary changes were made to the plan, A copy of these changes shall be submitted to the administering agency as part of this certification. (d) Unless exempted from the business plan requirements under this chapter, any business which handles a hazardous material shall annually submit a completed inventory form to the administering agency of the county or city in which the business is located. Notwithstanding any other provisions of the law, an inventory form shall be filed on or before January 1, 1988, for the 1988 calendar'year, and annually thereafter. This inventory shall be filed annually, notwithstanding the review requirements of subdivision (c). 2) Compressed gas cylinders not properly secured. VIOLATION OF UFC SECTION 74.107 AND BAKERSFIELD MUNICIPAL CODE, SECTION 15.64.110 Section 74.107, Storage and Use of Cylinders, of the Uniform Fire Code is amended to read: All compressed gas cylinders in service or in storage shall be adequately secured to prevent falling or bein~ knocked over. This shall be accomplished by the installation of safety chains of suitable size or other restraining methods approved by the Bureau of Fire Prevention. 3) Hazardous materials training not available for "crew" employees. VIOLATION OF OSHA 1910.1200(H) (2) Training. Employee training shall include at least: (i)Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); (ii)The physical and health hazards of the chemicals in the work area; (iii)The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and, (iv)The details of the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information. (h) Employee information and training. Employers shall provide employees with information and training on hazardous chemicals in their work.area at the time of their initial assignment, and whenever a new hazard is introduced into their work area. 4) Emergency plan not available. VIOLATION OF CALIFORNIA HEALTH AND SAFETY CODE CHAPTER 6.95, 25504 Business plans shall include all of the following: (b)Emergency response plans and procedures in the event of a reportable or threatened release of a hazardous material, including, but not limited to, all- of the following: (1) Immediate notification to the administering agency and to appropriate local emergency rescue personnel and the office. · (2) ProcedUres for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment'. (3) Evacuation plans and procedures, including immediate notice, for the business site. 5) Toxic and Highly Toxic gasses stored improperly. VIOLATION OF UFC 80.315 (a) Indoor Storage. 1. General. Indoor storage of other health hazard solids, liquids and gases shall be in accordance with the provisions of Sections 80.315 (a) and (c) and the general provisions specified in Section 80.301. 2. Exempt amounts. When the amount of health hazard solids, liquids and gases exceeds that specified in Table No. 80.315-A, such storage shall be within a room or building conforming to the Building Code requirements for a Group H, Division 7 Occupancy. 3. Liquid-tight floors. In addition to the provisions of Section 80.301(z), floors of storage rooms shall be of liquid-tight construction. 5. Containment. Secondary containment shall be provided in accordance with the provisions of Section 80.301(1)4. (c) Breathing Apparatus. Where other health hazard solids, liquids and gases are stored, a minimum of two self-contained breathing apparatus shall be provided. The breathing apparatus shall be suitable for use with the materials stored and shall be located near the immediate area of storage in a location that provides safety to those expected to don the apparatus. A safe area is one which is not likely to be immediately affected by the release of hazardous material in the area of concern. It usually takes a business several months to locate a qualified company or individual to prepare the RMPP. It then takes several more months to c~mplete the plan and the review by this Administering Agency. '~ The attached questionnaire regarding the qualifications of the RMPP preparer should be submitted to this Agency by January 7, 1991. Upon approval of the RMPP preparer, we will agree to a schedule for the completion of the hazard evaluation and RMPP. The finished RMPP will be due on October 7, 1991. HAZARDOUS MATERIALS Rm.~:a, SE RESPONSE PLANS AND INVENTORY Article 1. Business and Area Plans (Article 1 Heading Added Stats. 1987, Ch. 14.~ 25500. The Legislature declares that, in order to protect the public health and safety and the environment, it n_ _,~,~__ ~r~ to establLsh business and area plans relating to the handling and telease or threatened release of hazardous materials. The e~tablishment of minimum storewide standards for the~e plans is a statewide concern. Basic information on the location, type, quantity, and the health r/sks'of hazardous mater/aLs handled, used,` stored, or dLsposed of in the slate, wh/ch could be accidentally 'released into the environment, LS not now ava/lable to firefighters, health off/dal~, planners, publ/c safety officers, health care prov/ders, regulatory agendes, and other interested persons. The information provided by business and area plans is necer~ary in order to prevent or m/t/gate the damage to the health and safety of persons and the enVironment from the release or threatened release of hazardous mater/aLs into the workplace and environment. The Legislature further finds and declares that thLs chapter does not occupy the whole area of regulating the inventor!ring of b~rdous materials and the preparation of hazardous materials response plans by busine,~ses and the Leg/slature does not intend to preempt any local aaions, ordinances, or regulations wh/ch impose additional or more stringent requirements on businesses which handle hazardous mater/als. Thus, in enaa/ng thLs chapter, it ls not the intent of the Leg/slature to preempt or otherwise nullify any other statute or local ord/nances contain/ng the same or /reater standards and protections. Unless the context indicates otherwise, the following definitions govern the constructi°n of this chapter: " (a) 'Administering agency' means the department, office, or other agency of a county or city designated pursuant to subdivision (c) of Section 25502. (b) 'Area plan' means a plan established pursuant to Section 2~$03 by an administering agency for emergency response to a release or threatened release of a _h~rdous material within_ a City or cotillty. (c) 'Business' means an employer, serf-employed individual, trust, firm, joint stock company, corporation, partnership, or association. For purposes of this chapter, 'business' includes a business organized for profit and a nonprofit business. (d) 'Busines~ plan' means a separate plan for each facility, site, or branch of a business which meets the o requirements of Seclion 25504. (e)' 'Chemical name' means ~sc/enttfic designation of a substance in acc~n, ce w/th thc nomenclature system developed by the International l~ion of Pure and Applied Chemistry or th'~stem developed ,by the Chemical (f) 'Common n~me' means 'any des/gnafion o~; identification, such as a code name, code number, wade name, or brand name, ns~,.~..~o:,/.dentify a substance other than by'its chemical name. (g) 'Department' me~s thc State Department of Health Serv/Ces and 'director' means the State Director of Health Se~/c~. (h) 'Handle' meam to use, generate, process, prod,_,~, padmge, treat, store, emit, discharge, or dispose of a ha,nrd0ua material in any fashion. (i) 'Handler' means any bns/ness which handles a ha~rdons material. 'Hazardous material~'/ndede, but are not limited to,.hazardous substances, h:~rd0ns waste, and any material which a handler or the adm/nBtering agency has a rea~nable basis for believing that it would be injuriom to the health and ~afety of persons or harmful to the enviwnment if released inw the work'place or the envh'onment (k) 'I4~-~ons substance' means any subsunce or chenfica/produa for wh/ch one of the foi/owing appi/es: (1) The manufaaurer or producer is rcqu/fed to prepare a R/SDS for thc ~bs~ance Or produa pu~uam to thc I-hzardous Substances Information and Train/n§ Ac~'(Chapter 2.~ (commenc/ng with Section (c'~/)) of Pan 1 of Div/~ion $ of thc Labor'Codc) or pursuant to any applicable federal law or r%,ulafion. (2) The substance is listed as a radioactivc material/n Appond/x B of Chapter 1 of Title 10 of the Code of Federal Re/ulations, n~n~/,~ed and updated by thc Nuclear Re~hwry Conmi~ion. .. · (~) The substances listed pursuant to T~tlc 49 of the Code of Federal Re/uh~/ons. (c) The county and any city which assumes respous~'ollity pure, ant m subdivhion (b) shall designate a deparuncn~, office, or other agency of thc county or city, as the case may be, as thc administering agency rcspous~olc for admin~srerin~ and enforcing ~ chaplet. (3) Take into account the existence of local area and business plans which meet the requirements of rhB chapter so as to minimize the duplication of local efforu, cous~stcnr with ~he objectives of thB chapter. (4) Define what releases and threatened releases are required to be reported pursuant ~o Section 25507. The office shall considcr the c:dsting federal reporting requiremcn~ in de~ernfining a definition of reporting rcleascs pursuant to Sec~on 25507. (c) An a~ering agency shall esublish an area plan for emergency response ~o a release or threatened release of a hazardous material within i~s jur~Uc~ion. An area plan. i_~ nor a sla~ute, ordinance, or regulation for purposes of Sec-don ~9 of the Bv~dence Code. 'fac s~andards for area plans in the regulations adop~ed pursuant to subdivision (a) shall provide for all of the foUowing: (1) Procedures and protocols for emergency rescue perSOnnel, including the safety and health of those personnel (2) Prcemergency plannin& (3) No,cat, on and coordination of onsitc ac~v~ies with s~a~e, local, and federal agencies, respons~le panics, and special d~c~s. (4) Training of appropriate employees. (5) Onsi~e public ~afety and information. (6) Required supplies and equipment (8) Incident critique and follow-up. (9) Requirements for notification to the office of reports made pursuant to Section 25507. (d) The admlntstering agency shall submit a copy of its proposed area plan, w/thin 180 da~ after adoption of re~qxlations by the office establishinS area plan standards, to the office for. review. Tho office shall notify the administering agency as to whether the area plan is adequate and meets the area plan standards. The administering agency shall w/thin 4.~ Clays of this notice Sill}mit a corrected area plan, The administering agency shall certify to the office every three years that it has conducted a complete review of its area plan and has made any necessary revisions. Any time an administering agency makes any substantial changes to its nrea plan, it shall forward the changes to the office within 14 days after the changes have been made. (e) An a~tering agency shah submit to the office, along with its area plan, both of the following: (1) The basic provisions of a plan to conduct onsite inspections of businesses subject to this chapter by.either the adrnlni-~tering agency or other desi~nted entity. These inspections shah emure compliance with this chapter and shall identify existing safety ~,n~nrds that could cause or contn'bute to a release and, where appropriate, enforce any applicable laws and suggest preventative mensurc c~gned to minimize thc ~k of the release of hazardous material into the WOrkplace or environment. 'l'ne requirements of this paragraph.do not alter or affect the imm~tnity provided a public entity pursuant to Section 818.6 of the Government Code. .... ~ (2) A plan to institute a data management system which will assist in the efficient a__~r~___~ to and utilizatiOn. of information cotlected under this chapter. This data management system shall be in operation withi~ two years after. the business plans are required to be submitted to the administering agency pursuant to Section 25.505. ~. (f) The regulations adopted by the or'ce puxsuant to subdivision (a) shall include an optional model reporting form for business and area plans. The office and each administering agency shall adopt reporting requirements, in cooperation w/th the Chemical Emergency plnnning and Response Commission, established by the Governor as the state emergency response commission pursuant to subsection (a) of Section 11001 of'rifle 42 of the United State Code, which are consistent with the intent and provisions of this chapter and with Chapter 116 (commencing with Seaion 11001) of Title 4:l of the United States Code, for the purpose of eliminating duplicative reporting requirements, to the .extent achievable and practicable. (Added by Stats. l!~S, Ch. 1585.) '.. 25503.2. (a) The Environmental Affairs Agency, w/th thc guidance of the Chemical Emergency Planning and Response Commission, as spedfied in Seaion 25503.1, shall develop a hazardous materials compliance assistance manual, which shall include all of the following: (1) A copy of each form required by federal and state agencies for the reporting of activities concerning hazardous materials and criteria as to who is required to file thc form. (2) The due date for each form specified in paragraph (1). (3) The address, telephone number, and contact pex~on of each federal and state agency which requires the reporting forms specified in paragraph (1). (4) An insert which contains a copy of each form used for the reporting of activ/t/es concerning hazardous materials required by each local agency under whose jurisdiction the Person requesting the manual comiuas business, including the due date for each form, and the address, telephone number, and contact person of each local agency. (5) Any other information which the Environmental Affairs Agency determines to be necessaiT. (b) On or before July 1, 1991, the Environmental ~ Agency, with the guidance of the Chemical Emergency Phnning and Response Commission, shrill make known to businesses and other interested parties, and distribute, upon request, the hazardous materials compliance assistance manual developed pursuant to sulxlivision (a). The Secretary of the' Environmental Affairs Agency my impose a fee for the manual to pay for all costs rehted to the development, maintenance, reproduction, and distribution of the manual (c) On or before July 1, 1991, the Environmental Affairs Agency, with thc/nidance of the Chemical t:-mergency Planning and Response Commission, shall submit a report to the Legislature on the status of the development and distribution of the hazardous materials compliance assistance manual program. The report shall also contain a discussion of the feasibility of the adoption of a single t~l/ng date for state and local hazardous materials reporting fofn~ incltlding rc/lommendatiOns for implementation of a single filing date for these forms, and the use of a single comprehensive hazardous materiah reporting form for businesses to submit to the appropriate state and local agendes. (Added by Stats. 1989, Ch. 938.) ' 25503~. (a) Any except as provided in subdivisions (b) which handles a h~rdous material or a mixture containing a hazardous material which has a quantity at any one time during the repening year equal to, or greater than, a total.weight of S00 pounds, or a total volume of 55 pitons, or 200 cubic feet at s~andard temperature and pressure f. or compressed/as, shall establish and implement a business plan for emergency response to a release or threatened release of a hazardous material in accordance with the standards in the regulations adopted pursuant to Section 25503. (b) Oxygen and nitrous oxide, ordinarily maintained by a physician, dentist, podiatrist, vetetinafia~ or pharmacist, at his or her office or place of business, stored at each office or phce of. business in quantities of not more than 1,000 cubic feet of each material at any one t/me, are exempt from thl.s section and from Sect/on 2550~. The administering 'agency may require a one-t/me inventory of these materials for a fee not to exceed fifty dollars .(~0) to pay for the costs incurred by the agency in proc~.____~ing the inventory forms. .. (c) (1) Hazardous material contained solely in a consumer product for direct distn'bution to, and use by, the general public is exempt from the business plan reqnirements of this dmpter unless the administering agency has found, and has provided notice to the business handling the product, that the handling of certain quantities of the product requ/res the subm/~ion of a business plan, or .any pon/on thereo/; in response to public health, sa/ety, or environmental concerns. ..... - .- , /(2) In addition to the authority specified in paragraph (4), the administering agency may, in en:eptiohal ~cu~tances, following notice and public heating, exempt from the inventory pwvisions of this chapter any hazardous substance specified in subdivision (k) of Section 25501, ff the administering agency finds that the hazardous substance would not pose a present or potential danger to the environment, or to human health and safety if the hn~rdous substance was released into the environment. The administering agency shall specify in writing the basis for granting any exemption under this paragraph. The administering agency shall send a notice to the office within five days of the effective date of any exemption granted pursuant to this paragraph. ". .:'-~-'..~?'. :-":::;~: .'-'? (3) The administering agency, upon application by a handler, may, exempt a handler under the conditions it deems proper from any portion of the business plan upon a written finding that the exemption would not pose a significant present or potential hazard to human health or safety or to the environment or affect the ability of the administering agency and emergency rescue personnel to effectively respond to the release of a hazardous material, and that there are unusual drcnntstances justifying th/s exemption. The administering agency shall specify in writing the basis for any exemption under this paragraph. (4) The adngnistefing a§ency upon application by a handler may exempt a hazardous material from the inventory provisions of this chapter upon proof that the material does not pose a significant present or potential bn~rd to human health and safety or to the environment ff released into the workplace or environment. The administering agency shall specify in writing the basis for any exemption under this paragraph. ($) A~ admin/stering agency shall exempt a bus/ness operating a farm for purposes of cultivat/ng the soil or raising or harvesting any agricultural or horticultural commodity from f'fling the information in the business plan required by subdiv/~ions (b) and (c) of Sect/on 25504/f all of the follow/ng requiremen~ are met: (A) The handler annually provides the inventory of information required by Section Z509 to the county agricultural commissioner before Sanuary 1 of each )'ear. (B) Each building in which hazardous materials subject to this chapter are stored is posted with si/ns, in accordance with regulations which the office shall adopt, which provide not/ce of the storage of any of the following: (i) Pesticides. (ii) Petroleum fuels and oil. Types or rcn/uzers. (C) Each county agricultural commissioner forwards the inventory to the administering agency within 30 days after receiving the inventory. (d) The administering agency shah provide all information obtained from completed inventory forms, upon request, to emergency rescue personnel on a 24-hour basis. (e) The administering agency shall adopt procedures to provide for public input when approving any applications submitted pursuant to paragraph (3) or (4) of Subdivision (c). (Amended by' Stats. 1989, Ch. 874.) 25503.6. Any business which is required to establish and implement a business plan pursuant to Section 25503.5 and is located on leased or rented real property shall notify, in writing, the owner of the property that the bus/ness is subject to Section 25503.5 and ho_~ complied with its provisions, and shall provide a copy of the business plan to the owner or the owner's agent within five work/ng days after receiving a request for a copy from the owner or the owner's agent. (Added by Stats. 1988, Ch. 12.) '5 25503.7. (a) When any railroad ca!' con~nining any hazardous material or hazardous substance remains within the same railroad facility or b~iness facility for more than 30 days, or a business knows or has reason to know that any railroad car containing any hazardous material or hazardous substance will remain at the same railroad tadlity or business facility for more than 30 days, the hazardous material or hazardous substance is deemed stored at that location and for purposes of this chapter and subject to the requirements of this chapter. (b) Notwithstanding Section 2.5510, a business handling hazardous materials or hazardous substances which are stored in a manner subject to subdivision (a) shall immediately notify the admini.~tering agency whenever a hazardous material or hazardous substance is stored in a railroad car. (Amended by Stats. 1988, Ch. 1632.) 25503.8. (a) Any business no~ subj~c~ m subd~s~on (a) of Sec'don 25503.5 which h. ~luhed m submi~ ch~mieal. invento~] information pursuant to Section 11022 of Title 42 of thc United States Code, as that section reads on Janual7 1, 1988, or as it may be subsequently amended, shall establish and implement a business plan in accordance with Section 25503.5 and Section 25505. (b) Any. business required to establhh and implement a business plan pursuant to subdivision (a) shah not be deemed to'be in violation of this chapter until.the date of the next reporting period, spedfled in subdivision (d) of Section 25505, which occurs after the business becomes subject to subdivision (a), nnless the administering agency requests the business to establish and implement the business plan at an earlier date. ..... (a) Thc inventory of information required by Section 25509 and whatever additional information that the administering agency finds is necessary to protect thc health and safety of persons, property, orthe cnvinmment. Any such information is, however, subject to trade secret protection pursuant to Section 25511. (b) Emergency response plans and procedures in the event of a reportable release or threatened release of a hazardous material, including, but not limited to, aH of thc following:. (1) Immediate notification to the administering agency and to appropriate local emergency rescue pe~onnel and ' thc otfic~ (2) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (3) Evacuation plans and procedures, including immediate notice, for the business site. (c) Training for aH new employees and annual training, including' refresher courses, for all employees in'safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the plans and procedures specified in subdivision (b). These training programs may take into consideration the position of each employee. (d) Any business required to file a pipeline operations contingency plan in accordance with thc California Pipeline Safety Act of 1981 (Chapter 5.5 (commencing with Section 51010) of Pan 3 of Division 1 of Title 5 of thc Government Code) and the regulations of thc Department of Transportation, found in Pan 195 of Title 49 of the Code of Federal Regulations, may file a copy of those plans with the administering agency instead of h-ling an emergency response plan specified in subdivision (b). (e) Any business operating a farm exempted by paragraph (5) of subdivision (b) of Section 25503_S from flung the information specified in subdivisions (b) and (c), shall, notwithstanding this exemption, provide the training programs specified in subdivision (c). (Amended by Stats. 1986, Ch. 463.) 25505. (a) Not later than six months after thc office adopts regulation standards for business plaus, each handler shaH submit its business plan to the administering agency and certify that it meets thc requirements of this chapter. If, after review, the administering agency determines that the handler's business plan is deficient in any way, the administrative agency shall notify thc handler of these defects. The handler shall submit a corrected business plan within 30 days of the notice. If a handler fails after reasonable notice to submit a business plan in compliance with this chapter, the admlni-~tering agency shall immediately take appropriate action to enforce this chapter, including the imposition of civil and criminal penalties specified in this chapter. (b) In addition to the'requirements of Section 25510, whenever a substantial change in the handle~s' operations occurs which requires a modification of its business plan, the handler shall submit a copy of the plan revisions to the administering agency within 30 days of the operational change. (c) Thc handler shall,'in any case, review the busine~ plan, submitted pursuant to subdivisions (a) and Co), on or before Sanuary 1, 1988, and at least once every two years thereafter, to determine if a revision is needed and shall certify to the adminlstcring agency that the review was made and that changes were made to the plan. A copy of these changes shall be submitted to the administering agency as part of this certification. (d) Unless exempted from the business plan requirements under this chapter, any business which handles a hn~rdous mate~:/ai shall nnnttally subm/t a completed inventory form to the admfn/-~tering agency of the county or city in which the bminess is located. Notwithstanding any other provision of law, an inventory form shah be filed on Or before Sanuary 1, 1988, for the 1988 calendar year, and annually thereafter. This inventory shall be filed annually, notwitl~tanding the review requirements of subdivision (c). (Amended by Stats. 1986, Ch. 463.) 25505.1. An administering agency may use the offices of the county agricultural commi-e.~ioncrs to distribute business *plan forms to farmers who are subject m Section 25505. 25505.2. The city or county may file an appeal of the decision of thc office with the Director of the Office of Emergency Set~ices,.under procedures established by the office,. (b) This section does not exempt any admini-~m-inlg agency from compliance with any other provision of this chapter. (c) Any business located in a city or county which is exempt f~om the regulations adopted pursuant to this chapter concerning business plans, shall comply, with the ordinance adopted by the city or county. (Added by Stats. 1986, Ch. 463.) 25505.3. (a) Any administering agency which, pursuant to a local ordinance, is collecting substantially the same information required by Sections 25504 and 25509, on or before the business plan submission date specified in subdivision (a) of Section 25505, may collect only the additional information n~_~__~ry to bring thc business plans and inventory forms into compliance with this chapter, for thc purposes of the business plans and inventory forms required to be submitted in 1987.. (b) This section shall remain .in effect only until January 1, 1988, and as of that date is repealed. (Added by Stats. 198~, Ch. 46~.). 25505.4. (a) Notwithstanding any other provision of 'this chapter, any administering agency which, on l~fay 31, 1986, had 'in effect a local ordinance containing business inventory reporting requirements substantially similar to this chapter may extend the date for submission of a business plan by a handler pursuant to this chapter to a date not later than Sanuary 1, 1988. (b) Any administering agency which extends the date for submission of a business plan shah submit to the office a schedule for the submi.~ion of the business plan and a copy of the local ordinance. (c) This section shall remain in effect only until January 1, 1988, and as of that date is repealed, unless a later enacted statute, which is enacted before January 1, L988, deletes or or, ends that date. (Added by Stat~ ~986, C~. 25505.5. Notwithstanding any Other provision of law, no public entity shall be held Liable for any injury or damages resulting from an inadequate or negligent review of a business plan conducted pursuant to Section 25505. (Added by Stats. 19~, C'n. 25506. (a) The admlni-~tering agency shall maintnln records of aH business plans received and shall index them by street address and company name. 'l'ne business plan and revisions shall be available for public inspection during the regular working hours of the administering agency, except that those portions of the business plan specifying the precl~ location where hazardous materials are stored and handled onsite, including any maps of the site, as required 7 by paragraph (:T) of subdivision (a) of Section 2~509, shall not be available for in,s~Ction. The administering agency shah transmit copies of the en .tire business plan or any information contained in thc husines,~.plan to any requesting state or local agency. ,." (b) Any person who files an inventory form required under Section 25509 with thc admin£qtering agency shah deemed to have filed the inventory form required by subsection (a) of Section 1102 of Title 42 of the United States Code with the state emergency response comm~sion and emergency planning conunitt~ established pursuant to Section 11001 of Title 42 of the United States Code. (c) The administering agency shall, upon request, transmit the information collected pursuant to this chapter to the Chemical ~mergency Planning and Response Commission, established by the Governor as the state emergency response commt~-qion pursuant to subsection (a) of Seedon 1100! of Title 42 of the United States Code, and to the local emergency planning committe~ established pursuant to subsection (c) of Section 11001 of Title 42 of the United States Code. (Amended by Stats. 1988, Cb. 25507. ,(a) Except as provided in subdivision (b), the handler or any employee, authorized representative, agent, or designee of a handler shall, upon discovery, ftnmediately report any release or threatened release of a ILunrdous material to the admin(-qtering agency, and to the offce, in accordance with the regulations adopted pursuant to Section 25503. Each handler and any employee, authori2~! representative, agent, or designee of a handler shall provide all state, city, or county fire or public health or safety personnel and emergency rescue personnel with n___,~_ to the --- (b) Subdivision (a) does not apply to any pe13on engaged in the transportation of a hazardous material on a highway which is subject to, and in compliance with, the requirements of Sections 2453 and 23132.5 of thc Vehicle Code, (Amended by Stats. 1988, Ch. 1585.) 25507.1. (a) Any business required to submit a follow-up emergency noUce pursuant to subdivision (c) of Section 11004 of Title 42 of the United States Code, as that section reads on January 1, 1989, or as it may be subsequently amended, shaft submit the notice on a form approved by the office.. (b) The offce may adopt guidelines for the use of the forms required by subdivision (a). (.Added by Stats. 1988, Ch. 1585.). 255~. ~n order to carry out the purposes of this chapter, any employee or authorized representative of an adm~nister~g agency has the authority specified in Section 25185, with respect to the prem/ses of a handler, and in Section 2~185.$, with respect to real property which ~ w~thin 2,0(30 feet of the premises of a handler, except that this authority shall include inspections concerning hazardous material, in addition to hazardous waste. (Amended by Stats. 1986, Ch. 463.) 25509. (a) The annual inventory form shah include, but shall not be limited to, information on all of the following which are handled in quantities equal to or greater than the quantities specified in subdivision (a) of Section 25503.5: (1) A listing of the chemical name and common names of every hazardous substance or chemical product handled by the business. (2) The category of waste, including the general chemical and mineral composition of the waste listed by probable maximum and minimum concentrations, of every hazardous waste handled by the business. (3) A l~ting of the chemical name and common names of every other hazardous material or nztxture containing 'a hazardous material handled by the business which is not othel~vis~ listed pursuant to paragraph (1) or (2). (4) The maximum amount of each hazardous material or mixture containing a hazardous material disclosed in paragraphs (1), (2), and (3) which is handled at any one time by the business over the course of the year. (5) Sufficient information on how and where the hazardous materials disclosed in paragraphs (1), (2), and (3) are handled by the business to allOW fire, safety, health, and other appropriate personnel to prepare adequate emergency responses to potential releases of the hn~rdous materials. (6) The S~C Code number of the business if applicable. , ('7) The name. and phone number of the per3on representing the business and able. to assist emergency per3onnel in the event of an emergency involving the business during nonbusiness hours. (b) The adminl-qtering agency may permit the reporting of the amount of hazardous material under th£q section by ranges, rather than a specific amount, as long as those ranges provide the information n__,~___~_ry to meet the needs of emergency rescue personnel, to determine the potential hazard from a release of the materials, and meets the purposes of ~hi.q chapter. ' (c) Eccept ~s prov/ded/n subd/vision (d), the annual inventory form requ/red by tiffs sea/on shaUaiso include all inventory informati0~ required by Section 11022 of Title 42 of the United States Code, as that seaion reads on January 1, 1980,.or as' it may be subsequently amended. (d) If, pursuant m federal law or regulation, as it currently exists or as it may be mended, there is a dcterm/na~on that the inventory information required by subdivisions (a) and (b) is substantially equivalent to the inventory information required under the Emergency Phnning and Commun/~y R//ht-to-Know Ac~ of 1986 (42 U.S.C. Sec. 11001 et seq.), thc requ/remcnrs of subd/vhion (c) shall not apply. (a) If a businc~ believes that the inventory r~uired by th/s chapter involves the release of a trade secret, the business shall nevertheless make the disclosure ro thc*admin/sr¢fi~g agency, and shall nor~/the admin/srcring.. agency: in writingof that beUef on thc inventory form. (Amended by Sram 1986, Ch. 25513. F. ach adrnin£xtering county or city may, upon a majority vote of thc governing body, adopt a schedule of fees to be collected from each business required to subm/t a business plan pursuant to thi_~ chapter wh/ch is within its jurisdiction- The governing body may provide for the waiver of fees when a business as defined in Section 25501.4 submits a busine.~s plan. The fee shall be set in an amount sufficient to pay only those costs incurred by the county or dty in carty/ng out this chapter. Ia determining thc fee schedule, thc administering agency shall consider the volume and degree of hazard potential of the hazardous materials handled by the businesses subject to this chapter. (Amended by Stats. 19~, Ch. 15~.) 25513.1. (a) On or before Sanuary 1, 1987, the board of supervisors of a county may, by resolution, apply to the Controller for a loan to pay for thc costs necca~ry to initially implement tiffs chapter. (b) Each county may apply for one loan in an amount not to exceed seventy-five thousand dollars (S75,000). (c) The Controller shall develop procedures for the subm/~ion of rc~oiutions pursuant to th/s ~tion. (d) A county shall repay the loan within 15 months from the day the loan is made by the Controller, or on April 1, 1983, whichever comes first. The loan shall be repaid with interest charged at the rate of interest earned by the Pooled Money Investment Account on the date when the loan is made. (e) There is hereby appropriated from the General Fund to the Controller, the funds necc~ary to make the loans pursuant to this seaion. (f) If a county does not repay the loan and interest thereon within thc time required by subdivision (d), the Controller shall withhold the amount which is unpaid from any state payment~ which are due to thc county. (Added by Stats. 198~, Ch. ~3.) 2.5//I4. (a) Any business that violates Sections 25503.5 to 25//05,/ndusive, or Sections 2~508 to 2~510, inclusive, shall be civilly liable to the administering county or city in an amount of not more than two thousand dolhrs ($2,000) for each day in which thc violation occurs. If the violation results in, or significantly contributes to, an emergency, including a fire, the business shall also be assessed thc full cost of the county or city emergency response, as wcll as the cost of clean/ng up and disposing of the hazardous materials. (b) Any business that knowingly viohtes Sections ~503.$ to 25505, inclusive, or Seaions 2550~ to 2~510, inclusive, after reasonable notice of the violation shall be civilly liable to the administering county or city in an amount not to exceed five thousand dolhrs (~,000) for each day in which the violation occurs. (Added by Stats. 1985, Ch. 1!67.) 25515. Any person or business who violates Sea/on 2~507 shall, upon conviction, be pun/shed by a fine of not more than twenty-five thousand dollars (S25,000) for each day of violation, or by imprisonment in the county jail for not more than one year, or by both the fine and imprisonment. If thc conviaion is for a violation committed after 10 a first conviction under this section, the person shall be pun/shed by a fine of not less than two thousand dollars (~2,000) or more than. fifty thousand dolhrs (~0,000) per day of violation, or by imprisonment in the state prison for 16, 20, or 24 months or in the county jail for not more than one year, or by both the fine and imprisonment. .Furthermore, if thc viohtion results in, .or significantly contributes to, an emergency, including a fire, to which the ~OUllty or ~ty is ret[ltired to respond, the person shall also be assesc~ the full co~t of the county or city emergency response, as well as thc cost of cleaning up and disposing of the hazardous materials. (Added by Stats. 198~, Ch. H67.) 2~15.1. Any person who willfully prevents, interferes with, or attempts to impede the enforcement of this chapter by any authorized representative of an aclmfn£qtering agency ~ upon conviction, guilty of a misdemeanor. (Added by Sta~ 19S6, Ch. 4a~.) .. ~ 25515.2. (a) All criminal penalties collected pursuant to this chapter shall be apportioned in the following manner:. · (1) 1fifty percent shall be paid to the office of the city attorney, district attorney, or Attorney General, whichever office brought the action. (2) F~ly per--at shall be paid to the agency which is responsl'ble for the investigation of the action. (b) All c/vii penalties collected pursuant to this chapter shall be apportioned in the following manna':. (1) Fu'b/percent shall be pa/d to the office of the dty attorney, distr/c~ attorney, or Attorney General, whichever office brought the action. ............... .. (2) Ftfty percent shall be paid to the agency.responsl-ol¢ for thc investigation of the act/on. (¢) In all civil and criminal actions in which a penalty is imposed, the amount oftw~ hundred dollars (~200) shall be deducted from the amount of the civil or criminal penalty before the amount is apportioned pursuant to subdivision (a) or (b). This two hundred dolla~ (~.00) shall be deposited in the Hazardous Material and Waste F_nforcement Training Fund, which is hereby establ/shed in thc General Fund. (d) The moneys in the Hazardous Material and Waste ~.nforcement Training Fund shah be available for expenditure, upon appropriation by the Legislature, to the O~ce of Criminal Justice Planning, to support training in the invest/gation and prosecution of violations of laws and regular/ohs concerning ~,~rdous mater/als and wastes by local, county, and state hazardous material and waste enforcement Officers, including, but not limited to, ~refighters, Police officers, local health officers, dry attorney and dish-/ct attorney cr/minal investigators, c/ty attorneys, and district attorneys. (e) If a reward is paid to a person pursuant to Section 2~517, thc amount of the reward shall be deducted from the amount of the criminal or civil penalty before the amount is apportioned pu~uant to subdivision (a), (b), and (c). (Added by Stats. 1986, Ch. 443.) '2~516. When the administering agency determines that a businc~ has engaged in, is engaged in, or is about to engage in any acts or practices which constitute or will constitute a violat/on of this chapter or any regulation or order promulgated thereunder, and when requested by the administering agency, the dty attorney of the city or thc district attorney of the county in which those acts or practices have occurred, are occurring* or will occur shah make application to thc superior court for an order enjoining thc acts or practices or for an order d/rccting compliance, and, upon a showing that thc person or business has engaged in, is engaged in, or is about to engage in the acts or practices, a permanent or temporary iniunction, rcstr:~in!ng order, or other appropriate order may be granted. Tiffs section does not prohibit a city attorney or district attorney from seeking thc same relief upon the c/ty attorney*s or district attorney's.own mot/on. (Added by Stats. 1985, Ch. 1167.) 25516.1. Every civil action brought under this chapter shall be brought by the city attorney, district attorney, or Attorney General in the name of thc people of thc State of Califom/a, and any actions relating to the ~mc violation may be joined or consolidated. .(Added by Sins. 1986, Ca. 463.) 25516.2. (a) In any civil action brought pursuant to ,his chapter in which a temporary restraining order, prelim/nary injunct/on, or permanent injunction is sought, it is not necessary to allege or prove at any stage of the proce___,~_ing any of thc following: (1) Irreparable damage w/Il occur should thc temporary restraining order, preliminary injunction, or permanent injunction not be issued. (2) The remedy at law is inadequate. It (b) Thc court shaIl issue a temporatT restralnin§ order, prel/ntina~ injunction, or permanent injunction in a civil action brought pursuant to thi.~ chapter without the allegations and without thc proof spec/fled in subdivision (a). (Added by Sta~. 25517. (a) Any person who provides information which materially conm'bute-~ to the imposition ora dvil penally, whether by settlement or COurt order, under Section 25514, as determined by the d~ a~torney, disu'ia attorney, or the Altomey General filing the aaion, shall be paid a re~l by the adminhtering agency or the slate equal to 10 percen~ of the amount of the civil penalty collected. The reward shall be paid from the amounl of the civil penally colieaed. No revrard paid pursuant to this subdivision shall exceed five thousand dollars (~5,000). (b) Any person who provides/nformation wh/ch materially conm'outes to the conv/ction of a person or bus/ness under Sectioa 25515, as determined by the city attorney, district attorney, or the Attorney C-eaeral mini the action, shall be pa/d a reward by the a~tefing agency or the state equal to 10 percent of the mount of the fine collected. The reward shall be paid from the amount of the dvil penalty collected. No reward pe/d pursuant to this subd/vhion shall exceed five thousand dolhrs (~5,000). (c) No informant shall be eligible for a reward for a violation known to the administering agency, unless the informatioa .materially contributes to the imposition of a/mina/or..civil penalties for a viohtion spec/fled in thh section. .. (d) If there is more than one informant fOr a single viohtion, the person making the'first notification received by the office wh/ch brought the actioa shall be eligible for the reward, except that, if the notifications are postmarked on the same day or telephoned notifications are received on the same day, the reward shall be divided equally among (e) public officers and eml~loyees of thc United states, the State '(~f California, Or counties and dties in this state are not eligible for the reward punuant to subdivisioa (a) or CO), unless the providing of the informatioa does not relate in any manner to their responsibilities as public officers or employees. (f) An informant who is an employee of a business and who provides information that the business has viohted this chapter is not eligible for a reward if the employee intentionally or negligently caused the violation or if the employee's pr/ma~ and regular responsib/lities included investigating the violation, unless the business know/ngly caused thc violation.. (g) The adm/nister/ng agency or the state shah pay rewards under this sect/on pursuant to the foLlow/ng procedures: (1) An application shall be signed by the informant and presented to the adm/nistering agency or the state with/n 60 days after a final judgment has been entered or the period for an appeal of a judgment has expired. (2) The determination by thc district attorney or city attorney or Attorney General as to whether the information provided by thc applicant materially contributed to the imposition of a jud/mcnt under Section 25514 or 25515 shall be final. (3) The administering agency or the state shall notify the applicant in writing of its decision to grant or deny a reward within a reasonable time period follow/nE the filing of an application. (4) Approved reward cia/ms shah be paid by the administerin§ agency or the state within ~30 days of the colleaion and deposit of the penalties specified in subdivision (a) and Co). (h) The names of reward applicants or informants shall not be disclosed by the administering agency or the state unless the names are otherwise publicly disclosed as part of a judicial proceeding. (i) Notwithstanding any other provision of th/s section, rewards paid by the state shall only be paid after appropriation by the Legislature. (Amended by Stats. 1986, Ch. 465.) 25517.5. (a) The office may develop materiais, such as guidelines and informational pamphlets, to assist businesses to fulfill their obligations under tiffs chapter. Co) The o/rice may adopt emergency regulations for the purpose of implementing Sections 2~5(B and 25509. These emergency regulations shall be adopted by the office in accordance with Chapter 3.~ (commencing with Section 11340) of Part I of Divisioa 3 of Title 2 of thc Government Code, and for purposes of that chapter, the adoption of these reguhtions is an emergency and shall be considered by the Office of Administrative Law as ne,:__~__~ry for the immediate preservation of thc public peace, health, and safety, or general welfare. (Added by Stats. 1986, Ch. 46~.) 25518. Th/s chapter shall be construed h'berally so as to accomplish thc intent of the Leglshture in protecting thc public health and safety and the environment. (Added by Stats. 1985, Ch. 11~57.) 12 25519. If any provisio~ this chapter or the application thereof to ~pet~on or ciroumtances is held invalid, that invalidity slmH not affect other provisions or applications of the chapter which can be given effect without the invalid provision or application, and to that end the provisions of this chapter are severable. 2~520. The office, not later than January 10, 1986, shall adopt emergency regulations for thc immediate report of release or threatened release of a hazardous material as required by Sect/on 25507 until regulat/ons are adopted pursuant to Section 25503. Regulat/ons adopted pursuant to tiffs section are not subject to rev/ew by the Ofl/ce of An/de 2. Hazardous Materials Management .... (Article 2 added by Stats. 1986, Ch. 1260) .:..'. 2553L The Legishture finds and declares that a si~iflcant number of chemical manufacturing and processing facilit/es generate, store, treat, handle, refine, process, and transport hazardous mater/als. The Legislature further finds and declares that, because of the nature and volume of chem/cah handled at these facilities, some of those operations may represent a threat to public health and safety The Legislature recognizes that the potential for explosions, fires, or releases of toxic chemicals into the environment exists. The pwtection of the public from uncontrolled releases or explosions of hazardous materials is of statewide concern. There is an increasing capacity to both minimize and respond to releases of toxic air contaminants and hazardous mater/als once they occur, and to formulate effident phns to evacuate dtizens if these discharges or releases cannot -be contained. However, programs designed to prevent these accidents are the most effeaive way to protect the community health and safety and the environment. These programs should antidpate the circumstances that could result in their occurrence and require the taking of n~ry precautionary and preemptive actions, consistent with the nature of the bn~rdous.materiais handled by the facility and the surrounding environment. (Added by Stats. 1986, Ch. 1260.) 115532. Unless the contex~ indicates otherwise, the following definitions govern the construction of this article: (a) "Acutely hazardous material' means any chemical designated an extremely hazardous substance which is listed in Appendix A of Part 355 of Subchapter $ of Chapter I of Title 40 of the Code of Federal Regulations. (b) 'Acutely hazardous matefiais accident risk" means a potential for the release of an acutely hn~rdous material into the env/ronment which could produce a significant likelihood that persons exposed may suffer acute health effects resulting in si~ificant injury or death. (c) 'Administering agency" means the department, office, or other agency of. a county or city which is designated pursuant to Section 25502 to implement ~ chapter. (d) 'Handler" means any business which handles an acutely hazardous material, except where aH of the acutely hazardous materials present at the business are handled in accordance with a removal or remedial action taken pursuant to the Carpenter-Presley-Tanver Hazardous Substance Account Act (Chapter 6.8 (commencing with Section (e) "Modified facility' means an addition or change to a facility or business which results in either a substantial' increase in the amount of a.cutely .hazardous materials hnndled by the facility or bnsine-'~S, or a significantly increased risk in handling an acutely hn~rdons material, as determined by the administering agency. "Modified facility" does not include an increase in production up to the facility's existing operating capacity or an increase in production levels up to the product/on levels author/zed in a perm/t granted pursuant to Section 42300. (f) "Qualified person" means a person who is qualified to attest, at a minimum, to the validity of the hazard and operability studies performed pursuant to Section 25534, and the rehtionship between the corrective steps taken by the handler following the hazard and operability studies and those hazards which were identified in the studies. (g) 'Risk management and prevention program' or 'RMPP" means all of the administrative and operational programs which are designed to prevent acutely hazardous materials accident risks, including, but not limited to, programs wit/ch /ndude design safety,of new and existing equipment, standard operating procedures, preventive maintenance programs, operator training and accident investigation procedures, risk assessment for unit operations, or operating alternatives, emergeOesponse planning, and internal or externa~it procedures to ensure that these programs are being executed as planned. (Amended by Stats. 1987, Ch. 1415.) 25533. (a) On or l~efore September 1, 1987, the Office of Emergency Sen~ices shall develop an acutely hazardous materials registration form to be completed by the owner or operator.of each business in the state which, at any time, handles any acutely h=~rdous material Except as provided in Section 25536, on or before January 1, 1988, any business which handles acutely h:~rdous materials in the amounts spec/fled in subdivision (a) of Section 25536 shall file the registration form with the administering agency. The Office of Emergency Services may adopt appropriate regulations to implemen! the requirements of this section. (b). The acutely hazardous materials registratioll form shall incJtlde, but is not limited to, all of the following information: (1) The information included in the business plan prepared pursuant to Section 25504. (2) A general description of the processes and prindpal equipment involved in thc handling of the acutely hazardous materials~ (c) Within ~0 days of any one of the following events, any business subjea to this seaion shall submit to the administering 'agency an amendment to the registration form: :, (1) Any handling of an aCUtely hazardous material which was not mentioned on the registration form. (2) Any material or substantial alterations or additions to the business or activity which require changes in the risk management program that are different from, or absent in, the present pwgram. (d) Any business which submits a Certified risk management and prevention program puu'nant to Section 25534 shall implement thc approved risk management and prevention program_ (Amended by Stats. 1987, Ch. 1415.) 25534. (a) After receiving an acutely h~,'~rdous material registration form filed pu~uant to Section 25533, the administering agency shall make a preliminary determi~:~tion whether there is a significant likelihood that the handler's usc of an acutely b~rdous material may pose an acutely hazardous materials accident r~k. (1) If the administering agency determines that there is a significant likelihood of risk pursuant to this subdivision, it shall require the handier to prepare and to submit an RMPP in accordance with a timetable based on the priority ranking established in subdivision (b). (2) If thc administering agency determines that there is not a significant likelihood of risk pu~uant to thB subdivision, it may require the preparation and submission of an RMPP, but need not do so if it determines that the likeliho~l of an acutely hazardous materials accident risk is remote. (b) The a~lministering agency shall rank each usc of an acutely hazardous material identified pursuant to paragraph (1) of subdivision (a) in terms of the relative risks associated with i~s use, should an acutely hazardous materials accident occur. The estimation of the relative risks posed by the use of an acutely hazardous material shall be based on worst case assumptions regarding thc quantity and rate of release of thc acutely ba~nrdous material, air dispersion, toxicity, meteorological conditions, and other pertinent parameters. Based on the estimate of relative risks, the administering agency shall establish a timetable for the submi~ion of thc RMPP for the usc of the acutely h~,~rdous material which shall, in no case, result in its submission later than three years from thc date thc acutely hazardous materials registration form was received by the administering a§ency. (c) The RMPP shall include all of the following elements: (1) A description of each accident involving acutely hazardous materials which has occurred at thc business or facility within three year~ from the date of thc request made pursuant to subdivision (a), together with a description of the underlying causes of the accident and the measures taken, if any, 't° avoid a recurrence of a similar accident. (2) A report specifying the nature, age, and condition of the equipment used to handle acute~ h~w~rdous materials at the business or facility and any schedules for testing and maintenance. (3) Design; operating, and maintenance controls which minimize thc risk of an accident involving acutely hazardous materials. (4) Detection, monitoring, or automatic control systems to minimize potential acutely b~rdous.materials accident (:5) A schedule for implementing additional steps to be taken by the business, in response to the findings of the assessment performed pursuant to subdivision (d), to reduce the risk of an accident involving acutely hazardous materials. These actions may include any of the following: (A) Installation of alarm, detection, monitoring, or automatic control devices. 14 (B) Equipment m ohs, repairs, or additions. (C) Changes in the operations, procedures, maintenance schedules, or facility design. (6) Auditing and .inspection programs designed to allow the handler to confirm that the RMPP is effectively cm~ied ouc ....~ (7) Recordkeep~ procedures for the l~PP. (d) The RMPP shah be based upon an assessmen~ of the prOCeS~ operations, and procedures of ~e busings, and shall consider all of the following: (1) The results of a h~rd and operability study which identifies the h~rds assodated with the handling of an. acutely hazardous material due to operating error, equipment failure, and external cven~ which may present an acutely t,:,~rdous mater/als accident risk. · (2) For the hazards/dent/fled in the h~rd and operab/i/ty Stud/es, an off~ite consequence analysi~ which, for the most likely hazards, assumes pessimistic air dispersion and other advel~ environmental conditions. (e) The business shall subm/t to the admln~tering agency any additional supporting technical information deemed v_ _~___~.~ry b~ the adrnini.q~ering agency to clarify information submitted pursuant to subd/vision (c). (f) A handler shah maintain all records concerning an RMPP for a period of at least five yea~. . '". (2) The RMPP shah identify, by floe, all pezsonnel at the business who are responm'ole for canting out the sPeCific elements of the RMPP, and their respective responsibilities, and the RMPP shah include a' detailed ttmining program to ensure that those persons are able to implement the RMI~P. - .. (h) The handler shall review the RMPP, and shall make necessary revisions t° the RMPP at least every three years, but, in any event, within 60 days following a modification which would materially affect the handling of an acutely hazardous materiaL -'-'- (1) Any PerSOn who handles acutely hazardous materials and who owns or operates two or mort business fac/lities which are substantially identical may prepare a single genetic RMPP applicable to all those facilities if the handling of the acutely hazardous materials is substantially similar at aH of those fadlit/es. (j) The RMPP, and any revisions required by subdivision (h), shall be certified as complete by a qualified person and the facility operator. · (k) Except as specified in subd/vision (d) of Sea/on 25535, the handler shall implement aH act/vities and programs spec/fled in the R1V[PP within one year following the certification made pursuant to subdivision (j'). Implementation of the RMPP shall include carry/ng out aH operating, maintenance, monitoring, inventory control, equipment inspection, auditing, recordkeeping, and training programs as required by the RMPP. The administering agency may grant an extension of this deadline upon a showing of good cause. (I) The Office of Emergency Sezvices shall adopt, and publish for distribution, guidelines for the preparation and submission of an RMPP. In preparing the guidelines for hazard and operability studies, the office shall at a minimum, base its procedural recommendations on those set forth in the 1985 Guidelines for Chemica{. Hazard Evaluation Procedures, prepared by the Center for Chemical Process Safety of the American Institute of Chemical Engineers. (Amended by Stats. 1989, Ch. 1325.) 25534.1. Every RMPP prepared pursuant to Section 25534 shall give consideration to the prox/mity of the faciLity to schools, residential areas, general acute care hospitals, long-term health care facilities, and child day care facilities. For purposes of this section, "general acute care hospital' has the meaning provided by subdivision (a) of Section 1250, 'long-term health care facility" has the meaning provided by subdivision (a) of Section 1418, and "child day care facility" has the meaning provided by Section 1596.750. In reviewing an RMPP pursuant to subdivision (a) of Section 25535, the admin/stering.agency may have access to and review aH technical information in the handler's possession which is reasonably ne_o~__~_ry to allow the administering agency to make a determination regarding the sufficiency of the RMPP. That information may include any study or analysis conducted pursuant to subdivision (d) of Section 25534. Information conducted pursuant to subdivision (d) of Sect/on 25534 shall not be disclosed by the administering agency except as provided in Section 25511. (Added by Stats. 1988, Ch. 1589.) 25535. (a) An owner or operator of a facility submitting an RMPP pursuant to Section 25534 shall submit the RMPP to the administering agency after the RMPP is certified as complete by a qualified pex~on and the facility operator. (d) Any officer or employee or formcr officer or employee of the ad~i,istering agency or any other government agency who, because of that employment or official position, ~ possession of; or has access to, information designated as a trade secret pursuant to this section, shall noi knowingly and willfully disclose the information in any manner to any person not authorized to receive the information pursuani io this section. Notwithstanding Section 2~$15, any person who violates this subdivision, and who knows that disclosure of this information ~o the general public is prohibited by the section, shall, upon conviction, be punished by imprisonmen~ in thc county jail for not more than six months or by a fine of not more than one thousand dollars ($1,0(]0), or by both fine and imprisonment. (e) Any information prohibited from disclosure pursuant to any federal statute or regulation shall no~ be disclosed. Article 3. Emergency Planning and Community Right to Ir, now Act of 1986 Implementation (Article 3 Added by Stats. 1988, Ch. ~$8) 25~4~. The Office of Emergency Senrices shall develop informational guidelines for facilities required to comply with Chapter 116 (commencing with Section 11001) of Title 42 of the United States Code and with this chapter, and shall assist the administering agencies in assuring full distribution of these guidelines to those facilities. (Added by Stats. 1988, Ch. $~8.) Article. 5. Hazardous Materials Use Reduai~n Institute (Article 5 Added by Stats. 1990, Ch. 891) 25547. For the purposes of this article the following definitions apply: (a) (I) 'Hazardous materials use reduaion' means inplant changes in production processes or raw materials that reduce, avoid, or eliminate the use of hazardous materials, or the generation of hazardous by-products per unit of product, so as to reduce risks to the health of workers, consumers, or the environment, without shifting risks between workers, consumers, or pans of the environment. Hazardous materials use reduction shall be achieved through any of the following techniques: (A) Input substitution,.which means replacing a hazardous material or raw material used in a production pr°ceas with a nonhazardous or less hazardous material. (15) Product reformulation which means substituting for an existing end product an end product which is nonhazardous or less hazardous upon use, release, or disposal. (C) Production process redesign or modification, which means developing and using production processes of a different design than those currently used. (D) Production process modernization, which means upgrading or replacing existing Production proo~___s equipment and methods with other equipment and methods based on the same production process. (E) Improved operation and maintenance controls of production process equipment and methods, which means modifying or adding to existing equipment or methods, including, but not ]|mited to, such techniques as improved housekeeping practices, system adjustments, product and process inspections, and production proc__~_s control equipment or methods. 17 (F) Recycling, reuse, or extended use of hazardous materials by using cqmpment or mctheds which become an in. tegral part or the produ~gn-process of concern, including, but not limitt~d to, filtl, ation alld other closed-loop methods. (2) *Hazardous mhterials use reduction* does not include promoting or requiring incineration, thc transfer from one medium of release or discharge to. other media, offsite hazardous waste rccyr, ling, or any method of treating hazardous waste at the end of the' production process. (b) 'Institute* means the Hazardous Materials Use Reduction Institute specified in Section 2~$47.1. (Added by S~a~, l!~0, Cb. S~l.) 2~.~47.1. It is the intent Of the Legislature that the University of California ellllance its research and teaching activities relating to hazardous mterials use reduction, and to esamine the feas~llity of establishing a hazardous mt~'ia~ ii~ reduction institllte within thc l.l~ty of Califorlg3. To accomplish.this purpose, thc university is requested to report to thc Legislature by March 1, 1991, on thc following: (a) ~2dsting ~ and t~aching pro~l'3m-q within the un/versity that promote an undentanding of hazardous mterials use reduction and which develop new processes and materials to promote hazardous materin!s usc reduction ' (b) The feasibility of establishing a Hazardous Materials Use Reduction Institute that encourages and coordinates research, teaching, and training in hazardous materials nse reduction, which may include, but not be limited to, the fields of. engineering, environmental health and safety, and occupational health and safety. · (1) Thc report shall evaluate possible functions to be provided by such an institute, including the following. '~'(A) Providing L, eneral information about, and actively publicize thc advantases of and developments in, hazardous inter, is usc reduction, and thc requirements of this chapter. (B) Establishing courses, seminaz~ updates, Lmidelines, and other publications, and other means of providing technical information for hazardous materials users, including small quantity users, and, as appropriate, work in cooperation with thc department. (C) Developing and providing undergraduate curriculum and training for students and faculty on hazardous material use reduction. (D) Establishing and providing for a hazardous materials usc reduction postgraduate education and research program for both of thc following purposes: (i) To train students who seek ~raduate level educational training and advanced de~ees in hazardous materiats use reduction. (ii) To train professionais to be qualified to assist businesses or business groups to reduce the usc of hazardous materials. (E) Providing onsite technical extension services to help identify opportunities for hazardous materials use reduction among hazardous materials user ~roups and handlers, which include an emphasis on providing information to thc general public. (F) Sponsoring pilot projects to develop and demonstrate innovative technologies for hazardous materials use reduction and making avn!lablc results of these projects for use by thc public. (G) Providing hazardous materials use reduction training and assistance to government employees, citizens, community ~roups, workers, labor representatives, and local governmcn! beards and officials. (H) Establishing, to thc extent possible with bn~,~ous materials users or user Stoups, including small quantity users, an intensive technology transfer, research, and technical assistance pro,*am r¢~ardin§ the most hazardous mterials. (1) Studldng thc social, environmental, and cconomic costs and benefits of hazardous materials technologies as compared to hazardous materials use reduction practices. (J) EstablishinS a competitive srants pro~ram for research on h*~rdous materials use reduction techniques and (K) Conducting research on alternative methods of reducing thc usc of hazardous materials, including thc reduction of hazardous materials in product formulation so as to reduce household, as well as industrial, hazards. (L) Providing information on hazardous materials use reduction for application to the preparation of use and source reduction plans, pursuant to the Hazardous Waste Source Reduction and Mauasemcnt Review Act of 1989 (Article !1.9 (commencing with Section 2~244.12) of Cllapter ~5 of Division 20 of the Health and Safet~ Code).
