Box 5476 Bakersfield, CA 93388 Re: Bakersfield Friction Materials 3500 Pierce Rd., Bakersfield, CA Dear Mr. Gardner: A complaint was received by this office on March 5, 1991, regarding the disposal of waste oil and acetone by employees of Bakersfield Friction Materials. An investigation was conducted on March 7, 1991. It appears that waste oil has been discharged to the ground adjacent to the north fence in the rear lot. It is a violations of the California Health and Safety Code, Article 13, Chapter 6.5, Division 20, Section 25250.5, for waste oil to be disposed of in this manner. Therefore, within 30 days, all visibly contaminated soil is to be excavated and placed into secure containers. Representative samples(s) must be collected and analyzed by a certified hazardous waste laboratory for the following constituents: lead, arsenic, chromium, cadmium, total halogens and polychlorinated biphenyls (PCB's). Notify this office 48 hours prior to sampling. When laboratory analysis has been completed, forward a copy of the report to this office for review. Based on the analyses performed by B.C. Laboratories, the sample results for lead exceed the criteria for establishing the soil sampled as a hazardous waste. To date no documentation has been received by this office evidencing proper disposal of your hazardous wastes. Within 15 days of receipt of this letter, you are to either forward the proper documentation or arrange for a licensed hazardous waste hauler to provide transportation of your waste to a hazardous waste facility. Forward a copy of the uniform hazardous waste manifest to this office when this has been completed. If you do not have an EPA identification .number, you may obtain a number from the California Department of Health Services. You can contact them at (916) 324-1781.
