This letter confirms'the completion of site investigation involving
the Class V Shallow Injection Well at the above locations. It is
the position of this office that no further action is required at
this time.
In an effort to 'help you understand any liability that may still
occur, please be advised that there could be. liability under other
federal and state regulations or codes.
Along with this liability, conditions that may pose a threat to the
public and or groundwater from existing or 'future conditions may
have to be addressed at a later time.
Any changes in the present or proposed use of the site may require
further site characterization and mitigation activity. Please
notify this agency of any changes in report content, future
contamination findings, or site usage.

Dear Mr. Millard
The results of the samples retrieved March 3, 1994, by Smith
Gutcher and Associates, Inc. at the location noted above have been
received by this office. Our review has determined that the
hazardous waste toxicity criteria for metals has not been exceeded
for liquid/soil sampled in the wash rack/ clarifier/ under the
leach line, nor does the liquid/soil sampled exceed the Maximum
Contaminant Levels (MCL) as published in the U.S. Environmental
Protection Agency (EPA), Drinking Water Regulations and Health
Advisories of 1992.
Further soil investigations will not be required. In order to
minimize the potential for future discharge of an industrial waste
into the wash rack, the system should be abandoned in accordance
with U.S. EPA guidelines for closure of Class V Shallow Injection
Wells. Your plan to abandon this system should be submitted to this
office within thirty (30) days so that a timely review can be made.

Dear Mr. Starkey:
Subsequent to our discussion, a background soil sample was
collected on the Acco Cable Splicing property. The work was
performed for Mr. Steve Millard. The property is located at 3504
Pierce Road in Bakersfield, California. The background soil
sample was collected and analyzed to ascertain if the heavy metal
concentrations detected below the leach field, associated with a
steam cleaning facility on the property, were natural levels or
represented soil contaminants.
The soil sample location was 40 feet north and 35 feet west of
the southeast corner of the property. This is a dirt area which
runs north-south along the east edge of the property. The area
is approximately 40 feet wide. I was informed by Mr. Millard
that there has been no equipment or facilities in this area that
might contribute contaminants to the soil.
A hand auger was used to auger a boring to a depth of approxi-
mately 4 feet below the ground surface. A hand driven core
sampler was used to collect the soil sample. The core sampler
contained a 2 inch by 2 inch brass liner. The liner was removed
from the sampler and the ends immediately covered by Teflon seals
and polyethylene caps. The liner was labeled and placed in a
plastic bag. It was then placed in an ice chest on blue ice and

delivered to BC Laboratories in Bakersfield for analyses. The
appropriate chain of custody record accompanied the soil sample.
The soil sample was analyzed for barium, chromium, copper, lead,
nickel, vanadium, and zinc. These metals were detected in the
sample collected from below the leach field. The results of the
chemical analyses are included in Attachment A. As can be seen,
the barium, chromium, copper, lead, nickel, vanadium, and zinc
concentrations were 137 mg/kg, 15 mg/kg, 13 mg/kg, 5.1 mg/kg, 9.5
mg/kg, 43 mg/kg, and 58 mg/kg, respectively. Table 1 compares
the analytical results of the soil sample collected from below
the leach field with the background soil sample. The analytical
results for the seven heavy metals for the soil sample collected
from below the leach field are slightly to moderately higher than
the background concentrations. Except for vanadium and zinc,
they all exceed MCL levels for groundwater. There are no MCL
levels for these two constituents.
It appears, based on this work, that the soil below the leach
field is slightly contaminated. Additional soil sampling below
the leach field may be warranted to characterize the contami-
nation.

Dear Mr. Gilmer:'
This is to inform you that the property noted above has been determined by Kern County
Environmental Health Services Department to be the site of a Class V shallow injection
well. The well has been identified as a wash rack located on the west side of the shop
building of the business listed above. This notice is being sent to you because you have
been identified as the contact person for the Joseph Gilmer Family Trust.
Pursuant to Code of Federal Regulations 40, (40 CFR), Section 144.12 (a) provides that
"no owner or operator shall...operate [an injection well]...in a manner that allows the
movement of fluid containing any contaminant into underground sources of drinking water,
if the presence of that contaminant may cause a violation of any primary drinking water
regulation...or may otherwise adversely affect the health of persons."
During our inspection sufficient evidence was observed to indicate that the wash rack and
subsurface structure discharge industrial waste to the ground. Compliance may be achieved
by demonstrating that the wash rack and the other appurtenances are not regulated in
accordance with the Class V Shallow Injection requirements. Please notify this Office within
thirty (30) days of receipt of this notice of your intention to either proceed with the
characterization of the Class V wells in accordance with the enclosed guidelines from EPA-
REGION 9 or demonstrate that they do not meet the criteria of a Class V Well. The
enclosed booklet cites the minimum required for site work plan activities, contractor
requirements, example illustrations of well designs, and sampling methods and procedures.
Should you wish to discuss the above regulations or criteria for Class V identification,
please do not hesitate to call the inspector indicated below.
In accordance with Kern County Ordinance Code G-5541, Section 8.04.100, the Department
is authorized to charge for inspections, review of reports, and laboratory service costs

incurred in the process of obtaining compliance with any violations noted. Be advised that
you will be billed at the rate of $20.00 per hour for oversight during the abatement of
