A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD CERTIFYING THE AMOUNT OF THE
WILLIAMSON ACT CANCELLATION FEE TO BE PAID
TO THE KERN COUNTY TREASURER FOR CANCELLATION
OF THE WILLIAMSON ACT CONTRACT ON A PORTION
OF THE POLO GROUNDS.

WHEREAS, the landowner of a site has requested cancella-
the Williamson Act Contract for that site identified as
Lots 1 to 8 and lots 17 to 20 both inclusive
of the Jewetta and Raine Subdivision No. 1, as
shown on th.e map of said subdivision, recorded
January 8, 1914 in Book 3, Page 3, records of
Kern County Recorder, containing 240 acres,
more or less;
and
WHEREAS, tke Kern County Assessor was requested to
determine the fair market value and cancellation fee;
and
WHEREAS, THE Kern County Assessor determined
market value of the subject site is $2,567,000.00 and
same to the City Council;
and
the fair
certified
WHEREAS, pursuant to Government Code Section 51283(b),
the cancellation fee is 12-1/2 percent of the fair market value
which is equal to $2;20,875.00 on this particular property;
and
WHEREAS, the cancellation fee of $320,875.00 must be
paid to the Kern County Treasurer by the property owner within
one year of tentative cancellation of the Williamson Act
Contract;
and
WHEREAS, if the cancellation fee is not paid within one
year of approving tentative contract termination, the fair market
value and cancellation fee will be recalculated and such recalcu-
lated fee will supersede the presently certified Kern County
Assessor's fee.
NOW, THEREFORE, IT IS HEREBY RESOLVED and found by the
Council of the City of Bakersfield as follows:
1. The above recitals, incorporated herein, are true
and correct.
2. The fee for cancellation of the Williamson Act
Contract on assessors parcels 360-140-08, 360-140-09, 360-140-10
and 360-140-11 shall be $320,875.00, to be paid by the landowner
to the County Treasurer as deferred taxes upon cancellation.
3. The amount of said fee is hereby certified to the
County Auditor.

I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on NOV ? 1~90 by the
