ORIGINAL RESOLUTION NO. ~ ~ = 0 0 A RESOLUTION ORDERING THE VACATION OF A 50 FOOT PORTION OF THE WAIVED VEHICULAR ACCESS RIGHTS ON THE WEST SIDE OF ASHE RD. AT THE NORTHEAST CORNER OF PARCEL MAP NO. 9233 IN THE CITY OF BAKERSFIELD WHEREAS, on WEDNESDAY, APRIL 26, 2000, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law", Government Code Sections 8300 et seq. of the Streets and Highways Code of the State of California, passed and adopted Resolution of Intention No. 1214 declaring its intention to order the vacation ora 50 foot portion of the waived vehicular access rights on the west side of Ashe Road at the Northeast comer of Parcel Map No. 9233 in the City of Bakersfield; and WHEREAS, all rights of vehicular ingress and egress were waived along a certain portion of the West side of Ashe Road by "Vehicular Access Dedication" filed for record in Book 5510, Page 1441, Official Records, in the Office of the Kern County Recorder; and WHEREAS, the Council did fix a time and place for heating all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, May 24, 2000, after notices of said hearing were duly published and posted as required by law. WHEREAS, for the above-described project, it was determined that the proposed project is exempt from CEQA, according to Section 15051(b)(3) of CEQA Guidelines, in that there is no possibility that the proposed vacation could have a significant effect on the environment; and WHEREAS, at its meeting on April 6, 2000, the vacation Was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield General Plan; and NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. The following portion of the West Right of Way Line of Ashe Road is unnecessary for present or prospective use for waiver of vehicular ingress and egress purposes and is hereby vacated subject to the conditions enumerated herein: Page 1 of 3 ~O~llGtNAL~ That portion of the West right of way line of Ashe Road situated in the southeast 1/4 of Section 16, T 30 S, R 27 E, MDM, City of Bakersfield, Kern County, California, more particularly described as follows: Commencing at the point of intersection of the center lines of Ashe Road and District Boulevard, also being a point on the east line of the southeast 1/4 of said Section 16; Thence N 00° 28' 48"E, along the center line of Ashe Road, 785.62 feet; Thence, N 89° 12' 44" W, 55.00 feet to a point on the west right of way tine of Ashe Road, said point being the northeast comer of Parcel 2 of Parcel Map 9233 filed in Book 42 of Parcel Maps, Page 153; Thence S 00° 28' 48" W, along said right of way line, 15.00' to the TRUE POINT OF BEGINNING. Thence continuing S 00° 28' 48" W, along said right of way line, 50.00 feet to the point of termination. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California.
