SUBJECT: Underground Storage Tank Remediation, Leo Black Estate,
3909 Pierce Road, Bakersfield, CA
Dear Mr. Gilbert:
This Department has considered your request for approval to proceed
with the remediation of petroleum contaminated soil at the subject
property only. It is the Department's understanding that site
access to the Grossman's property for remedial action is being
negotiated between the involved parties. Based on information
recently provided to this office, Grossman's Inc. appears to have
previously granted a temporary license and easement to the Leo
Black estate for remedial action. This Department request that
this matter be resolved and access agreement documentation be
provided to this office no later than June 5, 1993.
Should an amicable agreement not be reached by the above date, this
Department may consider the owners of the Grossman property
responsible for cleanup petroleum contamination that has migrated
to their property. If you have any questions reagrding this

site and TPH as gasoline was detec2ed in the e[roundwater, this
Department cannot close the case at this time. The gasoline

disposition of the same, except for any such loss, cost, liability and expense arising

and Inviteea (ether than the Estate anti its egante anti ~3ntraetors),

surveys, reports, ltudles or ag~ementa of whtoh till Estate hes actual knowledge
relative to the contamination or risk of contamination of the Estate Parc, el, the
Owned Parcel or the Leased Parcel, whether now exltting or hereafter obtained.
9. Rtghts of the Estate to enter UpOn the Owned Pamel pursuant to the ten'ns
rtereof shall expire on March 1, 1991, untes~ a written extension agreement is
executed by the pa~les; provided, however, this agreement shall be automatically
extended aft~' said expiration date or any extension tllereof (but not beyond the
latest date for the 13erformen=e of the Estate's work a~ set by law, regulation or
order of a public body or officer) f~' as long es reaaonal31y necessary to complete
any remedl~tlon work the Estate Is required to complete in order to comply with
applicable laws in the event that the Estate's Contamination or the Estate's Other
Contamination Is more extensive than currently determined, or for as long as
performance by the Estate shall be prevented by any act of God, a~ of a public
enemy, by strike, war, insurrection, labor ctlstu~ance, fire, flooct, earthquake, dust
storm, wash-out, explosion, shortage of labor or SUpl=lles, governmental a~tlon of
any kind, any court orcler or clearco, or 13¥ any ottler Oause beyon~ me control of
the Estate.
10, From time to time, at the request of Grossman'e, and In any event 13afore the
Estate or any contractor or engineer or consultant enter~ upon tho Qwned Per, el,
the Estate shall provide Gro~man's with coplee of the insurance policies
maintained by the FJtate and Its eontra~ora, ~nsultant$ and engineers relative to
the work des~ribed herein, and a list of names anct addresses of t~e contractors,
censultant~ end engineers employed In conneotion with such work.
11, Nothing In this agreement alkali foe deemed to limit or 13ar any other rlgl'~ or
remedies which {3rossman's may have, by law or contract, against t~e Estate or
Drivers, with reepe~ to any contamlna+Jon of the Owned Paroel or Leased Parcel.
12. This Agreement shell be binding upon, and Inure to the 13enefit of, the panics
hereto ancl their respeotlve successors anti aeelgnl, Inoludlng without limitation any
successor owner or tenant of the Owned Parcel or Leased Parcel.
13. All notloee given hereunder shall be in writing and shall be deemed tO have
~en given when rec~lvecl by hand delivery or three (3) business days after sent
by the mall if cent, postage paid, by registered or certified mail, return receipt
