time.
Please be advised that this letter does not relieve you of any liability under the Code of
Federal Regulations or Water Code for past, present, or' future operations at thc site.
Further, it does not relieve you of the responsibility to clean up existing, additional, or
previously unidentified conditions at the site which cause or threaten to cause pollution or
nuisance or otherwise pose a threat to water quality or public health.
Additionally, be advised that changes in the present or proposed use of the site may
require further site characterization and mitigation activity. It is your responsibility to
notify this agency of any changes in report content, future contamination findings, or site
usage.

SUBJECT: Class V Shallow Injection Well Investigation
Dear Mr. Hahn:
In our January 5, 1994, correspondence, the Department indicated that the subject investigation will
be closed following closure of the discharge line and submittal of all documents pertaining to the
disposal of the wastes removed from the separator. Per our recent telephone conversation, it is our
understanding that the line has been capped; however, the waste (sludge) remains stored on site.
Laboratory analysis of the sludge performed in 1992 revealed the presence of soluble lead exceeding
the Soluble Threshold Limit Concentration (STLC) criteria listed in Title 22 of the California Code
of Regulations (CCR). As a result, the sludge has to be managed as a hazardous waste. Pursuant
to Section 66262.34 of Title 22 CCR, a hazardous waste generator is allowed to accumulate
hazardous wastes at the site of generation for a maximum of 90 days or a year without storage
permit depending on the quantity. Since the waste was generated in November of 1992, you are now
in violation of the storage requirement regardless of the quantity.
In order to be in compliance, the waste currently stored on site must be disposed of in accordance
with federal, state, and local regulations immediately. Otherwise, the continued improper
management of the above waste could result in initiation of legal action against you.

SUBJECT: Class V Shallow Injection Well Sampling Results
Gentlemen:
The laboratory results of the samples retrieved by the separator and leachfield areas have
been reviewed. The results indicated no significant levels of lead or nickel were found in
the soil beneath the shallow well system. Total recoverable petroleum hydrocarbons were
found at 100 ppm beneath the separator.
Based on the results and field observations, no further assessment or remediation is
necessary for the site. However, before the case can be closed, the discharge line from the
separator must be sealed or removed. Please inform This office after completion of this
activity in order that we can conduct our final inspection. In addition, as we previously
requested, all documents pertaining to the disposal of wastes generated during the
November 1992 incident need to be submitted to this office.

Earlier this week I had a phone conversation with Mr. Nick
Jeffers of your collection department concerning billing
received from your offices.
Your invoice to us has not been paid because we have tried
in vain to get some answers from someone in your offices.
The billing offers no explanation of the work done, or copies
of the actual work orders showing time spent, et cetera. We
called numerous times, but always got voice mail. We left
names and numbers to be called, but to date no one has returned
our calls. We feel that we were justified in requesting this
information. We are in a service business ourselves, and our
customers would never let us get away with the kind of in-
voicing we received.
We will be happy to send payment of the $720.00 to show our
good intent if 'required, but we would very much appreciate a
waiver of the 50% penalty if possible. We were told that you
might be willing to do so under the circumstances, inasmuch
as we attempted to talk to you about our situation.
Since our initial contact with you, the shallow injection well
has been closed off, and a waste water recycling system has
~been' insta-lled~ However, our site characterization has not'
been done because of the very high cost of having the testing
done and because of our rather shaky present financial state.
Is it permissible for us to seek out an alternate method for
this characterization? Or can you give us some advice on
dealing with this problem? We are open to any suggestions which
will bring us into compliance without driving us out of busi-
ness.

two elarifiers on site was due last February. To date, the workplan has not been received
by this Department.

Dear Mr. Hahn:
A review of the laboratory analysis of waste samples contained within the large clarifier
indicated the presence of elevated levels of metals, chlorinated, and total petroleum
hydrocarbons. Pursuant to Title 22 of the California Code of Regulations (CCR), lead was
detected at concentrations above hazardous waste regulatory levels.
Based on the levels detected, further characterization of the soil surrounding the two
clarifiers on site is required. Please submit a site characterization workplan proposal to this
office within thirty (30) days from the date of this letter. The workplan must be approved
by this office before any work is started.
Any wastes generated during the November 17, 1992, incident must be disposed of properly
in accordance with federal, state, and local regulations. Copies of pertinent documents such
as manifests must be provided to this office as soon as they are available.

ROAD, BAKERSFIELD CA.
Dear Mr. Hahn:
This letter is an official notice to inform you that the property noted above has been
determined by Kern County Environmental Health Services Department (KCEHSD) to be
the site of a class V shallow injection well. The well has been identified as a clarifier. This
notice is being sent to you because you are the operator of the clarifiers at the property
listed above.
Pursuant to Code of Federal Regulations 40, (40 CFR), Section 144.12 (a) provides that "no
owner or operator shalL.operate [an injection well]...in a manner that allows the movement
of fluid containing any contaminant into underground sources of drinking water, if the
presence of that contaminant may cause a violation of any primary drinking water
regulation...or may otherwise adversely affect the health of persons."
Samples of waste contained within the large clarifier were retrieved by members of the Kern
County Environmental Health Services Department Emergency Response team. Upon
review of the laboratory analyses you will be notified if further characterization must take
place. Enclosed is a copy of EPA-REGION 9 GUIDELINES FOR CLOSURE OF
SHALLOW DISPOSAL WELLS. The booklet cites the minimum requirements for site
work plan activities, contractor requirements, example illustrations of well designs, and
sampling methods and procedures. Be advised that KCEHSD may have additional
requirements not listed in the EPA closure guideline booklet.

In accordance with Kern County Ordinance Code G-5541, Section 8.04.100 the Department
is authorized to charge for inspections, review of reports, and laboratory service costs
incurred in the process of obtaining compliance with any violations noted. Be advised that
you will be billed at the rate of $24.80 per hour for oversight during the abatement of
violations connected to the Class V well.

NARRATION:
Starkey Telephoned me at approximately 0510. He said that the KCFD
had an engine company at the corner of Pierce and Brittan.
Apparently, they discovered evidence of illegal dumping in the
gutter and they requested that the on-call Environmental Health
Department personnel respond to their location. Starkey and I both
arrived at approximately 0540 and met with Hunt.
Hunt told us that they were called because of a report that waste
oil and solvent had been dumped in the gutter. They called Company
66 to the scene and Captain Walz told them to call Environmental
Health and returned to their station. Hunt said that the street
sweepers originally discovered it and they notified the
authorities. We could smell a strong odor that was similar to that
of solvent and diesel. Black and brown oily appearing liquid that
was mixed with water was in the gutter. We traced the liquid from
the back fence of Pacific Power Inc., on Brittan, west to Pierce
then north, past the CHP station and into the storm drain that is
north of the CHP station. The KCFD placed earthen dikes in the
gutter that prevented additional fluid from running into the storm
drain. We saw that the soil around the driveway to Pacific Power
Inc. appeared wet and had an oily appearing stain. Starkey sampled
the liquid in the gutter and the soil around the driveway.
I spoke with Standridge and he told me the following:
He and Gomez were sweeping the streets in the area. At
approximately 0300 he was sweeping on Pierce Road and smelled
an odor similar to .oil or diesel. He stopped to check his
sweeper and noticed that an oily appearing liquid was in the
gutter. Some of the liquid was swept up by his truck. He
telephoned the BPD and they sent a unit. The BPD referred it
to the fire department and KCFD Engine 64-2 ~esponded.
Starkey Telephoned Hahn and he agre'ed to come to our location.
Starkey said that Hahn told him on the telephone that he pumped
liquid from the business' clarifier into the street last night.
Engine 64-2 left at approximately 0610.
Hahn arrived at 0630. He said that he is the son of the owner of
the business. Starkey and I identified ourselves and explained the
sequence of events that caused us to be there.
Hahn told us the following:
The business has been using a clarifier that is connected to
a leach line for disposal of liquid from their steam-cleaning
rack. The clarifier holds approximately 150 gallons. They
decided to discontinue this practice and install a closed,
recirculating system. He decided to clean the clarifier last
night. He did this by pumping the liquid into the gutter and
scooping the remaining sludge into a wheelbarrow. The sludge
was dumped into his yard to dry. The clarifier probably held
a mixture of oil, diesel, gasoline, and solvent that they use '
for greasy parts. In the past they have had vacuum trucks
pump the clarifier. BIOCYCLE picks up their used oil filters
and CRANES picks up their waste oil. The business has an EPA
identification number but he wasn't sure where the
documentation is kept.
At one time, while describing his actions, Hahn said that he
"...wasn't thinking" and that ..."obviously its the wrong thing to
do"
Starkey explained that Hahn needs to have the fluid cleaned out of
the gutter and disposed of by an appropriate company. Hahn said
that he knows the owner of MP Vacuum and that he would call him.
We said that MP's environmental personnel need to be contacted and
that they were acceptable to us. We told him to have his
contractor check the storm drain and to pick up the contaminated
material that the street sweeper cleaned up. I explained that the
street sweeper dropped his load in their corporation yard for them
to pick up and dispose. Hahn said that he would make sure that it
was done properly. I issue a Notice of Violation to Hahn (see
attached copy) and Hahn signed it.
Starkey sampled the sludge that was in the yard while Hahn and I
watched. We told Hahn that these samples Would be analyzed and
could possibly be used by the DA if this incident proceeded to
prosecution. We told him that he could have a split of our samples
for his own analysis. Hahn declined our offer. We suggested to
him that he have an environmental contractor collect samples for
him as a check on our results. Hahn said that there was no need
for that.
Hahn was cooperative, cordial, and forthright with us the entire
time that we were there.
Starkey and I left at approximately 0750. I delivered the samples
to BC Labs for analyses and Starkey went to get a camera. Starkey
returned to the scene and photographed it.
No further action at this time.
Sample analyses and the underground-injection well will be referred
to Terry Gray.
