Review of the lab analysis in conjunction with field observations suggest ttlat contaminant levels reported were below the minimum reporting level for analytes, except for sample 1228-09. Sample nurnber 1228-09, the two foot dispenser sample indicated 1,800 parts of TPH (Gasoline). Sample number 1228-10, the six foot dispenser sample indicated no reportable contaminants, suggesting no vertical migration of contamination. HAND CAR WASH 730 California Ave. Bakersfield, California BACKGROUND INFORMATION The firm of Golden State FLr~vironmental Services was retained as preliminary assessment contractor by D and J Construction inc., of Bakersfield, California, to certify the abandonment of two existing , underground storage tanks for California Ave. Fland Car Wash at730 California Av~. in Bakersfield, California (see attached vicinity map). An application for permit for permanent closure of underground hazardous substances storage facility was submitted to the Kern County Environrnental Healttl Department by D and J Construction. Tile Kern County Health Department issued a permit following review and approval of application for abandonment. ABANDONMENT PROCEDURES Prior to the excavation of the tanks the Kern County Hea, lth Department and the Bakersfield Fire Department were given required prior notification by the contractor that tile subject tanks were to be decontaminated and removed. Upon arrival at the site, excavation to expose the fill, product and vent lines for the purpose of decontaminatiol.~ had been previously accomplished. Fill and vent lines were then removed to access tank for tile decontamination process. Product lines were tt~en pressure washed into the tank to remove all residual hazardous waste in the lines. ProdUct lines were subsequently disassembled and removed from the tanks. Residual liquid in the tanks were first removed using a vacuum truck. The interior of the tanks were then decontaminated utilizing high pressure (3000 psi) cold water. The interior Of the tanks were visually inspected to insure that all sludge and residual liquid had been removed. The decontamination process was continued until a reading of less than five I. percent (5%) was achieved on the L.E.L. rneter. Rinsate waters generated in the decontamination process was ~:~. removed from the tank by the vacuum truck operated by B and L Vacuum Service. A California Uniform Hazardous Waste Manifest was executed and accompanied the vacuum truck containing the wastes to Gibson Oil and Refining Co.,Inc., Commercial Drive, Bakersfield, California. After insuring that the vehicle was properly placarded the vehicle was allowed to procede to its destination Dry ice was introduced into the tanks at the rate of twenty pounds (20 lbs) per 1000 gallons of tank volume. Dry ice was broken into small pieces and distributed over the greatest possible area to secure rapid evaporation. Fire Inspector Capt. J. Embry arrived and verified that the L.E.L. and oxygen levels within the tanks were within acceptable limits and tb'e tanks were safe to remove. Tile tanks were rernoved fr~m the excavation and identification numbers spray painted conspicously on the sides. Tanks were then placed on a flatbed trailer for transport. The tanks were transported to American Metal Recycling in Ontario, California for distruction. FIELD OBSERVATIONS SAMPLING PROCEDURES Field observations and sampling procedures for the subject investigation consisted of the following: Visual and Olfactory observation of site soils, tank and. tank bedding condition, and soil sampling utilizing stainless steel drive tubes. Casual inspection of the tanks upon removal revealed no corrosion or obvious failure pointsl Soil samples for laboratory analysis were obtained at two locations from beneath the gasoline tanks at depths of two feet (2') and six feet (6'). Dispenser samples were also obtained as outlined in permit conditions utilizing procedures approved by the Kern County Health Department. A backhoe was employed to excavate to the desired test depth. Representative samples were carefully taken from the backt~oe bucket at the appropriate depths by driving tt~e stainless steel tube into the soils. After collection each end of the tube was covered with aluminum foil and then. covered with polyethylene lid, taped, and labeled..Identification numbers were marked on tubes. The tubes were placed into an ice chest which contained blue ice for transportation to tt~e laboratory. Chain-of-custody and sample analysis request forms were completed and the samples were delivered to SMC Laboratories, 3155 Pegasus Drive., ¢' Bakersfield, CA. Samples obtained below the gasoline tanks tank were analyzed for benzene, toluene, xylene, and total petroleum hydrocarbons as' specified in permit conditions. ANALYSIS Attached you will find tile laboratory analysis report from SMC Laboratories. The accompanying chain-of-custody forms have been included. It is the responsibility of the'Permittee to obtain permits which may be required by other regulatory agencies prior to beginning work. 2. Permittee must obtain a City Fire Department permit prior to initiating closure action. 3. Tank closure activities must be per Kern County Health and Fire Department approved methods .as described in Handbook UT-30. 4. Soil sampling Any deviation from sample locations and numbers or constituents to be sampled for which are described below and in Handbook SUT-30 must receive prior approval by the Health Department. a. (Tank size between 1,000 to 10,000 gallons)-a minimumof four samples must be retrieved one-third of the way in from the ends of each tank at depths of approximately two feet and six feet. 5. If any contractors or disposal facilities, other than those listed on permit .and permit application are to be utilized, prior approval must be granted by the specialist listed on the permit. '~ 6. Soil Sampling (piping area) a minimum of two samples must be retrieved at depths of approximately two feet and six feet for every 15 linear feet of pipe run and also near the dispenser area(s). 7. Sample analysis a. All (leaded/unleaded) gasoline samples must be analyzed for benzene, toluene, xylene, and total petroleum hydrocarbons. Copies of transportation manifests must be submitted~ to the Health Department within five days of waste disposal. 9. All applicable state laws for hazardous waste disposal, transportation, or treatment must be adhered to. The Kern County Health Department must be notified before moving and/or disposing of any contaminated soil. 10. Permittee is responsible for making sure that "tank disposition tracking record" issued with this permit is properly filled out and returned within 14 days of tank removal. 11. Advise this office of the time and date of the proposed sampling with 24 hours advance notice. 12. Results must be submitted to this office within three days of analysis completion. De~'u~ ~strict A' orney California Avenue Car Wash 730 California Avenue Bakersfield, California CASE SUMMARY An invoice for the permitting fees 'for the two underground hazardous substance storage tanks located at the California Avenue Car Wash were mailed to both Mr. Walker .and Mr. De -La Cruz on January 8, 1987. Both parties have current city business licenses for the property in question. Mr. De La Cruz notified ·this office that he was no longer the current owner. Mr. Walker never picked up the invoice for the fees. The certified letter was returned to this department February 9, 1987. A notice of violation was given to 3im Hall an authorized representative of the owner, Mr. Walker, stafing that the facility did not have a valid permit to operate the underground hazardous substance storage tanks due to the non-payment of fees. The owner was ordered to comply immediately or cease operation of the facility. A second notice of violation was given to L. Evans, an au'thorized representative of the owner, that stated the same thing as~the first notice of violation. On August 14, 1987 a hearing notice was sent to Mr. Walker via certified mail. Mr. Walker signed for the notice. The hearing was' scheduled for August 27, 1987 at 10:00 a.m. Mr. Walker did not show up for the hearing, or otherwise contact this office. This facility has the county'S contract for washing government vehicles. ALLEGATIONS Violation of: · Kern County Ordinance Code #G-4952, Section 3912.4.01, no underground hazardous substance storage tank. shall continue to operate unless a permit to operate is obtained by April 1, 1985. Violation .of Section 3912.4.01, Kern County Ordinance Code #G- 4952 - failure to permit underground hazardous substance storage tank 2. Violation of section 25284 (a), California Health and Safety Code - Failure to permit underground hazardous substance storage tank with local agency. Sequence of Investigatiou: January 5, 1987 - Invoice for permit fees was sent to Robert De La Cruz, the listed owuer .of the facility on the permit to operate application. January 8, 1987 - Jane Warren from the Kern County Health Department was notified by Mr. De La Cruz that he no longer owned "the facility, but that Mr. Donald Walker wa's the new owner. January 8, 1987 - A registered letter and a non-registered letter were sent to Mr. Walker stating· that the transfer of ownership papers must be filed and ~permit fees must be paid for this facility. March 11, 1987 - Mark Pishinsky from the KCHD issued a Notice of Violation (N.O.V.) to an authorized representative of the owner of California Avenue Car Wash, Jim Hale. The N.O.V. stated that unless the owner immediately obtained a valid permit to operate the tanks by paying the associated fees he must cease to operate the tanks. An tuvoice for the fees was also left with the N.O.V. At this time Mr. Pishinsky witnessed the operation of the underground tanks. March 30 - Mark PishinskY from the KCHD issued a second N.O.V. to an authorized representative of California Avenue Car Wash, L. Evans, stating the same thing as the March llth N.O.V. ,'Also included was an invoice for the permit fees with a 50% ~ate penalty. At this time Mr. Pishinsky witnessed the .operation of tile underground tanks. Sequence off Inv-es~tigation: (cbn't) August 14, 1987 - the KCHD issued a hearing date to Mr. Donald Walker in order to. discuss the facilities non-payment of perm'itting fees. August 18, 1987 - Mr. Donald Walker signed for the hearing notice. The hearing was scheduled for August 27, 1987 at 10:00 a.m. 'August 27, 1987 - Mr. Walker did not appear at the hearing, or otherwise attempt to contact this office. Exhibits: Exhibit 1.
