BAKERSFIELD FIRE DEPARTMENT MEMORANDUM DATE: September 11, 1996 TO: Carl Hernandez, Deputy City Attorney FROM: Mark Turk, Inspector, Office of Environmental Services SUBJECT: EnfOrcement Action Against Mr. Vernon Strong Mr. Vernon Strong installed three 12,000 gallon double walled underground fuel tanks in 1989. Title 23 CCR requires these tanks to be monitored by a state approved method, in this case, by daily sticking, monthly inventory reconciliation, and an annual tank tightness test, until December 1998 when the tanks must be upgraded or dosed. The accompanying notes indicate a full circle, from non-compliance, to forced compliance, then back to non-compliance. Please advise how best to proceed and what additional information will be helpful. Inspection notes on left cover of file. I left "Plain English" version of code with Correction Notice to obtain permit and monitor fuel per code. Neither 12/9/93 Correction Notice or Inspection Report are in file. 02/03/94 Visited site, Mr. Strong not present. Notes in left jacket cover of file. 02/04/94 I met with Mr. Strong at site. No compliance achieved. Mr. Strong said that he would comply when finds out how. (He had been delivered appropriate information previously). Correction Notice and Inspection report are in the file. Mr. Strong told me he would not tank tightness test his tanks as code requires. 02/10/94 Sent letter (in file) requiting permit and monitoring of tanks. Requires application for tank tightness test by 03/08/94. 03/31/94 Letter from City Attorney. (in file). 04/04/94 Fax from Ralph Huey, Hazardous Materials Coordinator, to Vernon Strong. Copy of 02/10/94 letter on file. 08/05/94 Notice of Violation requiring tank tightness test/monitoring within 30 days. On file. 08/08/94 Routine inspection, form in file, notes on conversation in left jacket cover of file. Inspector provided manual inventory monitoring forms and information on proper use. 08/10/94 Inspector met Mr. Strong at site. Hand delivered EPA's "Doing Inventory Right", "The Underground Press" (our publication with upgrade information) and letter from this office dated 08/05/94. He told me he would comply. Notes in left hand cover of file. 09/08/94 Mr. Strong called and requested 90 days to test one tank per month. We agreed to 60 days to test all tanks. Letter of file. 10/18/94 Letter sent from this office requiring A,B&C forms and state surcharge pursuant to Section 25287 of California H&S Code. Letter on file. At this date, 09/10/96, state surcharge has not been paid. 11/17/94 Application to tightness test 1 tank taken out by licensed tester. On file. Tank tested 11/18/96, but results not received by this office until 02/20/95. On file. 12/09/94 I called Mr. Strong. He had tested one tank, but wanted to wait umil January to test the other two. Record of phone conversation on file. 12/12/94 I visited the site to issue a citation to Mr. Strong for failure to comply with California H&S Code if he did not take out a permit to test the remaining tanks this day. He promised to do something this week. Notes in file jacket. Application to test two tanks issued to licensed tester. 02/10/95 Received results of tank tightness test. On file. 02/13/95 Permit to Operate issued by this office. 06/13/96 Inspector visited the site and met Mr. Strong. Underground Storage Tanks were due for annual tank tightness test 12/16/95 per Title 23. Tanks are not properly monitored. 09/09/q6 Inspector met Mr. Strong at site. No effort has been made by business owner to monitor the tanks per code. No intention was indicated to initiate the annually required tightness test. Huey, Hazardous Materials Coordinator of th~ City of Bakersfield, dated February 10, 1994. You were required to make arrangements for testing this tank by March 8, 1994, and you have failed and refused to do so. As you know, leaking undergroun~ storage tanks threaten the groundwater supply and the health 'of the entire cc nmunity. The purpose of this letter is to further impress upon you the need to take immediate' action. CA 93308 (2) If the underground storage tank contained a hazardous substance that could VOICE (805) 399-4697 FAX (805)399-5763 produce flammable vapors at standard temperature and pressure, it shall be inertcd, as often as necessary, to levels that will preclude an explosion or to lower levels as required by the local agency. (3) The underground storage tank may be filled with a non corrosive liquid that is not a hazardous substance. This liquid shall be tested and the test results submitted to the local agency prior to removal from the underground storage tank at the end of the temporary closure report. (4) Except for required venting, all fill and access locations and piping shall be sealed using locking caps or concrete plugs. (5) Power service shall be disconnected from all pumps associated with the use of the underground storage tank unless the power services some other equipment which is not being closed, such as the impressed-current cathodic protection system. (b) The monitoring required pursuant to the permit may be modified by the local agency during the temporary closure period. In making a decision to modify monitoring requirements, the local agency shall consider the need to maintain monitoring in order to detect unauthorized releases that may have occurred during the time the underground storage tank was used but that have not yet been detected. In all cases, corrosion protection shall continue to be operated. (c) The underground storage tank shall be inspected by the owner or operator at least once every three months to verify that the temporary closure measures are still in place. The inspection shall include but is not limited to the following: (1) Visual inspection of all locked caps and concrete plugs. (2) If locking caps are used, at least one shall be removed to determine if any liquids or other substances have been added to the underground storage tank or if there has been a change in the quantity or type of liquid added pursuant to subsection (a) (3) of this section. (d) At the end of a temporary closure period over 12 months, including any extension granted by the local agency, the owner may reuse the underground storage tank only if the tank meets the requirements of Article 3 for new underground storage tanks or is upgraded to meet the requirements of Article 6. (e) All new and existing underground storage tank systems which have been temporarily closed must continue to comply with repair and record keeping requirements, release reporting and investigation requirements, and release response and corrective action requirements specified in this chapter and Chapter' 6.7 of the Health and Safety Code. Failure to comply with the requirements will immediately terminate the temporary closure status. Upon termination of temporary closure, either through non-compliance or by expiration of the 12 month term, the tanks must either be integrity tested and re-permitted for operation or else removed from the site under a valid permit for permanent closure. This code requires ongoing monitoring of the tanks to assure that the tank is sound and that it is not leaking. Among the approved monitoring methods are a variety of automatic (electronic) methods utilizing interstitial monitoring or automated tank gauging. At this time you are not utilizing any of the state apl~roved a'utomatic monitoring methods. This code requires ongoing monitoring of the tanks to assure that the tank is sound and that it is not 'leaking. Among the approved monitoring methods are a variety of automatic (electronic) methods utilizing interstitial monitoring or automated tank gauging. At this time you are not utilizing any of the state approved automatic monitoring methods. You are therefore required to monitor your tanks using a combination of standard inventory control monitoring (manual tank gauging five days a week) for inventory reconciliation ...... and ...... annual tank integrity testing which has to be certified by the State as capable of detecting a leak of 0.1 gallon per hour. These requirements were to be completed by December 31, 1992 and annually thereafter. Our records show that tank integrity tests have never been completed on your tanks, although we do understand that you are currently completing the inventory reconciliation portion of your monitoring program. In order to bring your tanks into compliance with California law, tank integrity tests must also be completed and certified. In order to avoid further regulatory action, it will be necessary for you to make arrangements for this testing by MARCH 8, 1994. Once the monitoring requirements are completed and the. appropriate fees are paid, the Underground Storage Tank permit to operate will be issued.
