Description of the incident is as follows: .
Soil contamination was discovered during a tank r~moval
project.
The U.S. Environmentai Protection Agency hasissued regulations that
require a company to demonstrate proof of financial responsibility of up
to $1MM for corrective action and third party liability Caused by sudden
and/or non-sudden releases of petroleum products from underground
storage tank systems.
Accordingly, we have attached'a copy of Shell's proof of Financial
Responsibility for these locations. The letter shoWs proof of self
insurability, is in the form approved by the U.S. EPA and is signed by
the Company's c'hief financial officer.

; (3) Equip the gasoline pump dispensers (both leaded and unleaded) with nozzles in co~q~liance with the

at any ti~e after delivery by or for' Shell to Dealer and prior to introduction by Dealer into any
· otor vehicle, such program to include,'if and as necessary, periodic sampling and testing by Dealer
of Dealer's gasoline inventory, the securing of ~anhole covers, fill line caps and dispensers to avoid
unauthorized entry or use and the supervision and instruction of e~ployees and others having access to
Dealer's gasoline syste~ regarding proper procedures to prevent contamination of Dealer's'gasoline or
the introduction of leaded gasoline into vehicles designed only [or unleaded gasoline;
(5) Give pro,pt notice to Shell (by telephone to Shell's District office) of (a) the 'taking of any
gasoline samples at Dealer's Station by a representative of the EPA or .state agency to test for com-
pliance with the Regnlations, tosether ~rkth all relevant details relating thereto, and (b) the receipt
of any test results from any such sa~pling;
(6) Give pro, pt notice and details to Shell (by telephone to Shell's District office, followed
formal notice)o[ any circu~stance or occurrence at Dealer's Station which reasonably could cause
Dealer's gasoline or ~asoline dispensing equipment to be not in co~pliance with the Regulations; and
upon discovery of any such condition cease forthwith to sell, dispense or offer [or ~ale such gasoline
until Shell and Dealer can ~utually deter~ine by sa~pling, testing and/or other ~eans whether the
~asoline is in co~pliance, and if found to be not in co~p,li.ance, take such ~urther action as is neces-
sary (includin$ ptmp out) to restore availability of a co~plying product, the cost of such sa~pling,
testing and/or further action to he for .Dealer's account if 'the cause cf contamination was within
I~aler's control; and
(7) Otherw/se co~ply with all obligations i~posed on Dealer by the Regulations, whether or not such
other obligations are re£erred to or restated herein.

EPA GASOLINE. REGULATIONS SUPPLE~NT
~]{IS SUPPLE~NT to the above Dealer Agreement (or Contract) ("Agreement") shall'be effective' from June
30, 1989. ~his Supplement sets forth the terms and conditions regarding compliance at Dealer's
Station wi~h the re~ulatinns of the Environmental Protection Agency ("EPA") covering unleaded gasoline
and gasoline volatility, and with any applicable state regulations covering gasoline volatility, and
supersedes and replaces any prior agreements or Supplement(s) relating to the subject matter hereof.
The terms and conditions of the A~ree~ent shall apply to the sale and delivery of gasoline to Dealer
except aa set forth herein.
In the operation of Dealer's Station, Dealer shall strictly comply with the EPA regulations promul-
gated as Part 80 - REGULATION OF FUELS AND FUEL ADDITIVES, of Chapter I', Title 40, Code of Federal
Regulations, and with any applicable state regulations coveri-$ gasoline volatility, as heretofore or
hereafter amended (the "Regulations"). Under the Regulations, Dealer, .as a retailer of gasoline, must
regularly offer for sale one or more sTades of "unleaded gasoline" and, during specified annual s,,mer
"regulatory control periods," may not sell, offer £or sale or dispense gasoline ~hose Reid vapor pres-
'sure ("RV]~') exceeds the "applicable standard." '"Gasoline" and other terms used in this Supplement
shall have the same meaninss as defined in the Regulations. or in the Agreement. With respect to
Dealerts Station, Shell and Dealer witl have the following rights and obligations:
(a) Shell's Rishts and Obli{ations. Shell shall:
(1) Make' available for sale to Dealer shell branded gasoline~' including one or more grades of
unleaded gasoline, complying with the Regulations;
(2) Supply to Dealer the pump notices and labels required for unleaded gasoline by the Regulations;
(3) Continu~ng for such period as shell, in its sole Judgment, deems appropriate, take periodic
samples from the gasoline dispenser(s) of Dealer and/or other dealers supplied from the same Plant and
test such samples to determine whether the gasoline is in compliance with,the Regulations, any such
sampling and testing, however, not to relieve Dealer of any obligation Dealer may otherwise have. here-
under or by law to sell, dispense or offer for sale only gasoline complying with the Regulations;
(4) Give prompt notice and details to Dealer (by telephone, followed by formal notice) if any test
per£onned under (3) above or other circumstance known to Shell reflects that Dealer's gasoline inven-
tory is not in compliance with the RegUlations, and cooperate with Dealer in the taking of such
further action as is necessary (including pump out) to restore the' availability of complying gasoline,
the costs of any such further action, including further sampling and testing, to be for Dealer's
account if the cause of contamination was within Dealer's control;
(5) Arrange £or the painting of manhole covers and fill line caps tO identify storage tanks dedicated
to unleaded ~asoline;
(6) Have the right, through its employees, agents or representatives~ at all reasonable times for the
purpose of determining compliance with this Supplement' and the Regulations, to enter upon Dealer's
Station premises' and utilize Dealer's facilities as necessary to take samples and conduct tests of
gasoline offered for sale or dispensing at Dealer's Station and to inspect Dealer's gasoline storage
end dispensing systems and records of gusoline receipts and sales or deliveries; and
(7) Rave the right, following any default by Dealer under~ this Supplement, and without limitation of
any other rights or remedies available to Shell hereunder or otherwise, to suspend deliveries of gaso-
line to Dealer and/or enter upon Dealer's Station premises and take such action as is appropriate in
its Jud~nent (including padlocking of pump dispensers) to avoid any violatiOn or continued violation
of this Supplement or the Regulations.
(b) Dealer's Rights and Obli{ations. Dealer shall:
(1) Utilize for the stOrage and dispensin~ of unleaded gasoline only those facilities which have been
approved for such use by Shell;
(2) Properly affix and maintain the pump notices and labels required for unleaded gasoline.by the
Regulations;

Because of the almost infinite variables involved/th~s is not

During the stand-pipe test procedure the internal liquid
hydrostatic pressure applied to the Underground tank system is
generally two to three times greater than normal liquid storage
pressures. This increase in hydrostatic 'pressure will amplify
the indicated rate of leak accordin.gly.

Enclosed are the results of our investigation for' the Shell
service station located at 3623' California Avenue in the city
Bakersfield, California. The purpose of this investigation is to
define the geologic and hydrogeologic conditions, and the. limits·
of soil and possible groundwater contamination..
BACKGROUND
As 'part· of the tank removal procedure, soil samples Were obtained
from depths of 2 and 6 feet below the bottom of·the tank zone
excavation for laboratory ·analysis. The soil ·samples were
analyzed for oil and grease using EPA Method 413.1. The results
of the analyses are presented in Table 1. Based on the test .
results, the Kern County Health Department requested that site
assessment work be performed to determine the extent of the
contamination.

SITE INVESTIGATION
The site was explored on January 12,. 1987, by ·drilling three
borings with a truck mounted hollow stem auger drill rig. The
boring locations are shown on the Plot Plan, Plate I in ApPendix
A Detailed logs of the soils encountered during drilling were
compi'led by our geologist. The logs'are designated B-1 through B-
3 and are presented in Appendix A, Figures 2 through 4. At the
Completion of drilling and sampling, the borings wer'e sealed and
backfilled- to the surface.
All .borings Were drilled to a depth of 15 feet' Undisturbed soil
samples were obtained at 5' foot intervals for laboratory analysis.
The samples were qualitatively analyzed in the -field using a
Gastech portable ,vapor meter. Only the samples generating
positive reading were submitted for laboratory analysis. The
samples were tested for oil ahd grease using EPA Method 413.1 and
total organic halides using EPA Method 9010. .The results of the
laboratory 'analyses are presented in the Summary of Laboratory
Test Results, .Tables 1 and 2,

SUBSURFACE CONDITIONS
Based on the materials encountered during drilling and sampling,
the: site is underlain by alluVium of Recent age. The alluvium
consists of fine-grained siity sand, and fine- to coarse-grained
sand. Groundwater was not encountered in any of the borings.
CONCLUSIONS
'The laboratory test results indicate' that there is no significant
contamination in the soils around the waste oil tank. Based on
the laboratory test resUlts· and the field observations it is our
opinion that no additional work should be required at this site.

PROPOSED WORK PLAN .
The site will be explored by drilling a single slant boring
adjacent to the new waste oil tank and two vertical holes around
the limits of the old tank excavation. The borings Will be
drilled to a minimum of 15 feet. The approximate locations of the
proposed borings is shown on the Plot Plan, Figure 1.. A detailed
log of each boring will be compiled by our geologist.
Soil samples will be obtained at five foot· intervals for
laboratory analysis. Samples will be stored in three inch
stainless steel, tubes. The ends will be covered-with aluminum
foil, ,capped with plastic end 'capS,.and placed in an ice· chest to
reduce the potential for volatilization. All %he sampling
equipment will· be washed and double rinsed 'in ~.distilled water
between samples to reduce the effects of cross contamination.
BAsed on a qualitative analysis performed in the field, only those
sampl'es Which generate a po'sitive reading will be submitted for
laboratory analys~s. The soil samples will'be tested for oil and
greaSe (EPA 413.1), le~d (EPA 7421), and total organic halides
(EPA 9020).
The samples will be qualitatively analyzed in the field using a
Gastecktor - Hydrocarbon Super Surveyor Model 1314. Based on the
field analyses, soi'ls exhibiting significant levels of
contamination will be stOred on site in approved containers.
These soils will be tested for hazardous characteristics and
disposed of in accordance with applicable codes. At the
completion of drilling and sampling, the boring will be sealed to
within three feet of.the surface with bentonite grout.
It is our Understanding that water may be encountered at depths of
.less than 30 feet: If ground wa~ter is encountered during
drilling, ground water monitoring wells will be installed in the
two vertical borings. Details of the well. construction are
'presente~ in Detail A: Typical Monitoring Well Construction,
Figurel.
The ground water well Will be developed and sampled for evidence
of. contamination. A .minimum of five borehole volumes will be
pumped from the well ~ith an air lift pump to develop the well.
Prior to sampling, three casing volumes will be pumped from the
well to assure obtaining a representative sample. The water from
well development and purging prior to sampling will be
containerized and disposed of at an approved facility. After
purging, water samples will be obtained using a Teflon ballot and
placed in VOA bottles with Teflon Septums. The samples will be
stored on~ ice for transport to the laboratory. Ground water
samples will be tested"'f'or total hydrocarbons (EPA 8015), benzene,
toluene, and x¥1ene (EPA 602).

Gentlemen:
Submitted herewith are the Soil contamination test results and loggings
we performed on the removal of a 550 Gallon Waste Oil Tank at the Shell
Service Station on the corner of California and Real Road on July 29, 1986.
Two samples for contamination were taken. One at two (2) foot below the
bottom of the tank and one at six (6) foot below. Each sample was put in
a glass container and taken to Stan Comer, Chemist/Consultant for testing.
As shown on the test results, there is slight evidence of contamination
present. The water table in this area is approximatel~y 125' according to
the Kern County Water Agency, 1984~Water Supply Report.

As per our telephone conversation of October 21, 1986, all obvious
contaminated soil is to be left on the jobsi~te. The tanks are
not to be set until we have some preliminary soil analysis from
from Consolidated Testing Laboratories. Consolidated Testing
Laboratories will 'contact you on October 22, 1~86 in the morning
with prelimihary soil analysis. The tanks will be set on
October 22, 1986 in the afternoon, barring any problems.

Gentlemen:
Submitted herewith are the soil test results and loggings we performed on the.
removal of four (4) gasoline tanks at the Shell Service Station on the corner
of California Avenue and Real Road oh June 2, 1986. This is part of a system
upgrading.
Ail tests for contamination were taken at 2' and 6' below the bottom of the
tanks and product lines ~(see attached drawing for test locations).
The soil samples taken for analysis of the contamination were marked and kept
in.glass containers and taken to B C. Laboratories, Inc.,.at 3016 Union Avenue
for lesting. The results of these tests show n~ contamination in any of the
areas.
The soil logs, a drawing showing the tahk locations and testing locations,
along With the test results 'for contamiantion are attached.

retrieved. Soil samples for every 15 linear Jest of pipe run
must be retrieved from 2' and 6' depths below the pipelines.
5. All soil samples must be analyzed for benzene, toluene, and
xylene.
6. Advise this office of time and date .of proposed sam~ltng with 24
hours advance notic~.
