IN THE INSPECTION OF YOUR BUSINESS "REZAC LAWNMOWER SHOP"
LOCATED AT 2412 S CHESTER AVE. BAKERSFIELD, CA 93304 ON
SEPT.28th FOLLOWING HAZARDOUS MATERIALS REGULATION
VIOLATIONS WERE IDENTIFIED:
1) SEVERAL HAZARDOUS MATERIALS WERE FOUND THAT WERE NOT
INCLUDED .IN YOUR BUSINESS PLAN INVENTORY INCLUDING OVER
200 CUBIC FEET OF OXYGEN
VIOLATION OF CH. 6.96 CALIFORNIA HEALTH
& SAFETY ~CODE 25509(A)(1-4)
The annual inventory form shall include, but shall
not be limited to, information on all of the following
which are handled in quantities equal to or greater than
the quantities specified in subdivision (a) of Section
25503.5:
(1) A listing of the chemical name and common
names of every hazardous substance or chemical
product handled by the business.
(2) The category of waste, including the
general chemical and mineral composition of the
waste listed by probable maximum and minimum
concentrations, of every hazardous waste handled by
the business.
(3) A listing of the chemical name and common
names of every other hazardous material or mixture
containing a hazardous material handled by the
business which is not otherwise listed pursuant to
paragraph (1) or (2).
(4) The maximum amount of each hazardous
material or mixture containing a hazardous material
disclosed in paragraphs (1), (2), and (3) which is
handled at any one time by the business over the
course of the year.

Defective containers which Dermit leakage or
sDillage shall be disposed of or repaired in accordance
with recognized safe practices; no spilled material
shall be allowed to accumulate on floors or shelves.
VIOLATION OF UFC 79.1311 & 11.201
Disposal of waste. Combustible waste material and
residues in a building or unit operating area shall be
'~ept to a minimum, stored in covered metal receptacles
and disposed of daily.
Accumulation of waste material.
(a) Accumulations of wastemaper, hay, grass, straw,
weeds, litter, or combustible or. flammable waste
material, waste petroleum products or rubbish of any
kind shall not be permitted to.remain upon any roof or
in any court, yard, vacant lot or open space. All weeds
grass, vines, or other growth, when same endangers
Droperty or is liable to be fired, shall.be cut down and
removed, by the owner or occuDant of the DroDerty. When
total removal of growth from a Diece of property is
impractical due to size or to environmental factors,
approved fuel breaks may be established between the land
and the endangered Droperty. The width of the fuel
break shall be determined by height, type and amount of
growth, wind conditions, geographical conditions.and
type of exposures threatened.
(b) All combustible rubbish, oily rags or waste
material, when keDt within a building or ad.~acent to a
building, shall be securely stored in metal or metal-
lined receptacles equiDped with tight-fitting covers or
in rooms or vaults constructed of noncombustible
materials.
(c) It shall be unlawful to accumulate or store
combustible waste matter beneath trailers or at any
other place within an auto and trailer camD.'
(d) Commercial dumDsters and containers with an
individual capacity of 1.5 cubic yards or ,greater shall
not be stored or placed within 5 feet of combustible
walls, openings or. combustible roof eave lines.
3) HAZARDOUS MATERIALS TRAINING INADEQUATE.
VIOLATION OF OSHA 1910.1200(H)
(2) Training. Employee training shall include at
least:
(i)Methods and observations that may be used
to detect the presence or release of a hazardous
chemical in the work area (such as monitoring
conducted by the employer, continuous monitoring
devices, visual appearance or odor of hazardous
chemicals when being released, etc.);
(ii)The physical and health hazards of the
chemicals in the work area;
· . (iii)The measures employees can take to
protect themselves from these hazards, including
specific procedures the employer has implemented to
protect employees from exposure-tO hazardous
chemicals, such as appropriate work practices,
emergency procedures, and Ders0nal protective
equipment to be used; and,
(iv)The details of the hazard communication
program developed by the employer, including an
explanation of the labeling system and the material
safety data sheet, and how employees can obtain and
use the appropriate hazard, information.
4) MATERIAL SAFETY DATA SHEETS NOT AVAILABLE VIOLATION.OF OSHA 1910.1200
(g) The employer shall maintain-copies of the
required material safety data sheets for each hazardous
chemical in the workplace, and shall ensure that they
are readily accessible during each work shift to
employees when they are in their work area(s)
(h)(1) INFORMATION. Employees shall be informed of:
(i)The requirements of this section
(ii)Any operations in their work area where
hazardous chemicals are present; and,
i~ (iii)The location and availability of the
~i written hazard communication program,
including the required list(s) of hazardous
chemicals, and material safety data sheets
required by this section.
5) DIP TANK AND WASTE CONTAINER NOT PROPERLY LABELED. VIOLATION OF OSHA 1910.1200
(1) The chemical manufacturer, importer, or
distributor shall ensure that each container of
hazardous chemicals leaving the workolace is labeled,
tagged or marked with the' following information:
(i)Identity of the hazardous chemical(s)~
(ii)Appropriate hazard warnings; and
(iii.)Name and address of the chemical
manufacturer, importer, or other responsible
party.
(4) Except as provided in paragraphs 13) and (4)
the employer shall ensure that'each container of
hazardous chemicals in the workplace is labeled, tagged,
or marked with the following information:
" (i)Identity of the ha. zardous-'chemical(s) contained therein; and ~
- (ii)Appropriate hazard warnings.
(5) The employer may use signs, placards, process
sheets, batch tickets, operating procedures, or other .
such written materials in lieu of affiXing labels to
individual stationary process containers, as l°ng as the
alternative method identifies the containers to which it
is applicable and conveys the information required by
paragraph (Z) of this section to be on label. The
written materials shall be readily accessible to the
employees in their, work area throughout each work shift.
('7) The employer shall ~ot remove of deface
existing labels on incoming containers of hazardOus
chemicals, unless the container is immediately marked
with the required information. "
(8) The employer shall ensure that labels or other
forms of.warnings are legible, in English, 'and
prominently displayed on the container', or readily
available in the work area thrOughout each work shift.
Employers having employees who speak other languages may
add the information in their language to the material
presented, as long as the information is presented in
English as well. '

threatens not only the quality of the state's_.land,
air, and water resources, but poses a direct hazard to
health and safety by exposing the public 'to substances
that have been found to cause cancer, birth defects,
miscarriages, nervous disorders, blood diseases, and
damage to vital organs and genes"
VIOLATION OF CH.6.5 OF THE CALIFORNIA
HEALTH AND SAFETY CODE SECTION 25250.4
"Used oil regulated by the department shall be
managed as a hazardous waste in accordance with the
requirements of this chapter until it has been
recycled. Used oil which is not recycled shall be
disposed of, or 'transported out of .the state, as a
'.hazardous waste in accordance with this chapter".
"Section 25250.5 DisD0sal of used' oil by
discharge to sewers, drainage systems; surface or
groundwaters, watercourses, or marine waters; by
incineration of burning as fuel; or by deposit on land,
' is prohibited, unless authorized under other provisions
of law. the use of used oil as a dust suppressant or
weed control agent is prohibited".
IT WiLL ALSO BE NECESSARY FOR YOU TO PROVIDE INFORMATION AS
TO WHERE THE MATERIAL THAT GOES INTO THE STEAM CLEANER SUMP
ULTIMATELY GOES. IS IT A TANK? IS IT A LEACH FIELD? IS IT THE
CITY SEWER?
'The above violations must be corrected by OCTOBER 28, 1988
