NOTICE OF VIOLATION AND SCHEDULE FOR COMPLIANCE
IN THE INSPECTION OF YOUR BUSINESS THE HONDA CENTER,
LOCATED AT 2531 CHESTER AVE., BAKERSFIELD,~ CA 93301 ON
6-4-91 THE FOLLOWING HAZARDOUS MATERIALS REGULATION
VIOLATIONS WERE IDENTIFIED:
1. INCOMPATIBLE HAZARDOUS MATERIALS MUST BE STORED
SEPARATELY. THE CARB CLEANER SHALL NOT BE STORED ON THE
BATTERY WORK BENCH.
VIOLATION OF UFC 80.301
(n) Separation from Incompatible Hazardous
Materials. Storage in excess of the exempt amounts
specified in Sections 80.302 through 80.315 shall either
be:
1. Segregated from incompatible hazardouS materials
storage by a distance of not less than 20 feet, or
2. Isolated from incompatible hazardous materials
storage by a noncombustible partition extending not
less than 18 inches above and to the sides of the
stored material, or
3. Stored in hazardous materials storage cabinets
or gas cabinets, Materials which are incompatible
shall not be stored within the same cabinet.
2. THE BATTERY ELECTROLYTE TANKS WHICH ARE NO LONGER IN USE
SHALL BE DRAINED AND REMOVED FROM SERVICE. EQUIPMENT
USED ON THE BATTERY WORK BENCH SHALL BE APPROPRIATE FOR
THE PURPOSE INTENDED. THE WOODEN BOARD USED TO ELEVATE
THE CARBOYS SHOULD BE ELIMINATED DUE TO 'IT'S DEGRADATION
UPON EXPOSURE TO THE ACID.
VIOLATION OF UFC 80.401
(d) Equipment. Equipment, machinery and processes
utilized for dispensing, use or handling of hazardous
materials shall be suitable for the intended use. such
equipment, machinery and processes.shall be maintained
in an operable condition and shall be replaced, repaired
or removed from service when found to be defective.
I have included a listing of hazardous waste disposal
companies who may be able to assist you regarding disposal of
the old battery electrolyte. The manufacturer or other
disposal firms listing in the Yellow Pages may also be able
to provide this service. It is also time for you to review
and update the hazardous materials business plan for your
facility. Please mark any changes in the attached plan
directly on the printout. Chenges in material quantity and
deletions may also be marked on the printout. Use the
attached inventory form to make additions to the hazardous
materials inventory. Be sure to' correct the quantity of the
sulfuric acid in storage.
The above violations must be corrected and the revised
hazardous materials business plan submitted by July 5, 1991.
This department will schedule a re-inspection of your
facility to verify compliance. If you have any questions

or marked with the following information:
(i)Identity of the hazardous chemical(s)
contained therein; and
(ii)Appropriate hazard warnings.
(5) The employer may use signs, placards, process
sheets, batch tickets, operating procedures, or other
such written materials in lieu of affixing labels to
individual stationary process containers, as long as the
alternative method identifies the containers to which it
is applicable and conveys the information required by
paragraph (2) of this section to be on label.. The
written materials shall be readily accessible to the
employees in their work area throughout each work shift.
(7) The employer shall not remove of deface
existing labels on incoming containers of hazardous
chemicals, unless the container is immediately marked
with the required information.
(8) The employer shall ensure that labels or other
forms of warnings are legible, in English, and
prominently displayed on the container, or readily
available in the work area throughout each work shift.
Employers having employees who speak other languages may
add the information in their language, to the material
presented, as long as the information is presented in
English as well.

l. Quantifies for RMPP compliance are "equal to or greater than" the minimum criteria and apply to chemicals handled
"at any one time".
2. Businesses handling reportable quantities of Acutely Hazardous Materials that have not submitted a business plan
MUST contact local Administering Agencies. The business plan submission date will assure the Administering
Agency that a business plan has been submitted and is on file. This will also immediately identify businesses that
have not submitted business plans.
3. "Process Designation" is provided as a reporting option (with the approval of the Administering Agency) for
facilities that can most easily report by process. Thus, facility RMPP registration data could be submitted in a
similar format to a business plan that is divided by process. "By process" data can initiate an emergency
response to a process incident rather titan a general emergency response to a major facility. Process designation
can simplify inspections for major facilities and improve furore emergency response.
4. Refer to the EPA list of Exu'emely I-IsTardous Subs~mces from the Federal Register (Volume 52, No. 77, p. 13397
et. seq., April 22, 1987). Each chemical has a threshold planning quantity. This list may be changed by EPA on
an annual basis. UIxiates of this list may be available early in 1988. To comply with this element, you may attach
a copy of the inventory submitted to your Administering Agency from your business plan and highlight all Acutely
Hazardous Materials. It is recommended that facilities list all extremely tmT~rdous chemicals handled in quantities
equal to or in excess of 1) 500 pounds, and 2) any EPA threshold planning quantity less than 500 pounds.

For emergency response purpose,s, it would be desirable to describe the following to the Administering Agency:

"Pursuant to §25534, the Administering Agency may require the submission of a Risk Management Prevention Program
(RMPP), if the Administering Agency determines that the handler's opea-ation may present an acutely hazerdous materials
accident risk. The handler shall prepare the RMPP in accordance with subdivision (c) [of §25534]. The RMPP shall be
prepared within 12 months following the request made by the Administering Agency pursuant to this section."

An amendment to the RMPP must be submitted to the Administering Agency within 30 days of: 1. Any additional handling of acutely hazardous materials.
2. Any material or substantial alterations to business activities.
3. Change of address, business ownership, or business name. (§ 25533 (c) Health & Safety Code)
