On behalf of our subsidiary, CUSA, guarantor guarantees to implementing agencies and to' any and all third parties that: In the event that CUSA fails to provide alternative coverage within 60 days after receipt of a notice of cancellation of this guarantee and the Director of the implementing agency has determined or suspects that a release has occurred at an underground storage tank covered by this guarantee, the guarantor, upon instructions from the Director, shall fund a standby trust fund in accordance with the provisions of 40 CFR 280.108, in an amount not to exceed the coverage limits specified above. Page 1 of 3 In the event that the Director determines that CUSA has failed to perform corrective action for releases arising out of the operation of the above-identified tanks in accordance with 40 CFR 280, subpart F, the guarantor upon written instructions from the Director shall fund a standby trust in accordance with the provisions of 40 CFR 280.108, in an amount not to exceed the coverage limits specified above. If CUSA fails to satisfy a judgement or' award based on a determination of liability for bodily injury or property damage to third parties caused by sudden and/or nonsudden accidental releases arising from the operation of the above-identified tanks, or fails to pay an amount agreed to in settlement of a claim arising from or alleged to arise from such injury or damage, the guarantor, upon written instructions from the Director, shall fund a standby trust in accordance with the provisions of 40 CFR 280.108 to satisfy such judgement(s), award(s), or settlement agreement(s) up to the limits of coverage specified above. 4. Guarantor agrees that if, at the end of any fiscal year before cancellation of this guarantee, the guarantor fails to meet the financial test criteria of 40 CFR 280.95Co) or (c) and (d), guarantor shall send within 120 days of such failure, by certified mail, notice to CUSA. The guarantee will terminate 120 days from the date of receipt of the notice by CUSA, as evidenced by the return receipt. 5. Guarantor agrees to notify CUSA by certified mail of a voluntary or involuntary proceeding under Title 11 (Bankruptcy), U.S. Code naming guarantor as debtor, within 10 days after commencement of the proceeding. 6. Guarantor agrees to remain bound under this guarantee notwithstanding any modification Or alteration of any obligation of CUSA pursuant to 40 CFR part 280. 7. Guarantor agrees to remain bound under this guarantee for so long as CUSA must comply with the applicable financial responsibility requirements of 40 CFR part 280, subpart H for the above-identified tanks, except that guarantor may cancel this guarantee by sending notice by certified mail to CUSA, such cancellation to become effective no earlier than 120 days after receipt of such notice by CUSA, as evidenced by the return receipt. 8. Chevron also requires that the tank monitoring equipment operational and alarm condition be documented daily by using a "UST Equipment Monitoring Log" (see Attachment A). This 'log is also 'required to be used to document when equipment problems are reported to Chevron Maintenance and is to be kept as part of the station monthly inventory reconciliation records and on site at all times. Please see the attached site map for the location of all equipment at the site. The electronic monitoring devices are maintained according to manufacturer's recommendations. The dealer will also perform inventory reconciliation according to the procedure outlined in the Inventory reconciliation section of this plan, as stated in detail in Section 2626 of the copy of the California Code of Regulations, Title 23, Division 3, Chapter 16 dated May 5, 1994 that is attached to the dealer's copy of this plan. Daily and monthly inventory reconciliation is required by Chevron Policy and reconciliation records are to be kept on site at all times. December 31, 1997' Mr. Dan Hilburger Mr.-Larry Williams Chevron, U.S.A. 15359 Oxnard Street Van Nuys, California 91411 RE: Product Spill, 12/24/97 Location 203576 1125 Coffee Road Bakersfield, CA 93312 Gentlemen: The purpose of this report is to document the circumstances and ramifications of a product spill that occurred on December 24, 1997 at approximately 3:40 in the afternoon at the Chevron station located at 1125 Coffee Road in Bakersfield, California. This spill was preventable. Our driver failed to properly secure the product hose to the Civacon delivery fitting which was clamped onto the fill for the underground midgrade tank. When our driver opened the butterfly valve, approximately 30 to 40 gallons of midgrade product flowed into the delivery hOse and onto the concrete/asphalt before he was able to close the valve. Our driver indicated that he was switching fi-om a shorter delivery hose to a longer one so he could reach the midgrade tank and did not properly tighten the carnlocks on the Civacon fitting. Based on the evidence at the station, it is clear that the end of the delivery hose was not secured to the fitting when our driver opened the butterfly valve. Immediately at~er closing the butterfly valve our driver attempted to block the flow of product with spill towels and absorbent. At this time, the station attendants noticed the spill and contacted the fire department who were able to respond to the spill site by 3:50 p.m. At 4:00 p.m. our Bakersfield Terminal Manager, Dave Palmer, and a Beneto mechanic were on the scene to lend assistance. As indicated by Attachment I, we informed Captain Watts (805-326-3911) of the Bakersfield Fire Department at the scene that we had advised M.P. According to Susan Johnson, a Chevron cashier at the scene, a small amount of gasoline also reached a portion of the flower bed shown in the lower right photo. In addition to immediately notifying Chevron management at the Van Nuys terminal, at 5:50 p.m. Beneto personnel reported the spill to the National Response Center (800-424-8802, Report No. 417152) and Chemtrec (800-424-9300). Beneto Tank Lines assumes full responsibility.for this unfortunate incident.' Original reports from people at the scene of the spill estimated the quantity of product released was between 100 to 150 gallons. However, after reviewing the photos taken of the spill prior to the fire departments arrival, evaluating the tank stick readings, and interviewing the driver and other individuals at the scene, I have concluded that in reality less than 40 gallons of product was lost. Most people (including drivers) when viewing a relatively large gasoline spill for the first time typically overestimate the actual quantity of product on the ground by a factor of two or three. This is understandable given the non-polar nature of gasoline when compared to water. This phenomenon is easily demonstrated simply by putting a cup of gasoline on a smooth asphalt surface and comparing the surface area of the "spill" to an equal amount of water on the same surface. Invariably, the gasoline will cover an area two to three times the area of the water. Coincidentally, Robert Davidson of Davidson Enterprises (805-487-2767), a DOT certified cargo tank manufacturer and repair facility located in Bakersfield, was at the station and viewed the spill prior to the arrival of the fire department. David commented to me that he has seen several cases over the years where 4 or 5 gallons of gasoline had spilled from the unloading headers of customers' tanks prior to being repaired. Based on this experience, he is convinced that the Beneto driver had spilled approximately 15, but not more than 20 gallons at the Chewon station. The Beneto driver responsible for the spill was not tested for the presence of drugs or alcohol in his system at the time of the incident. This particular driver was hired on October 18, 1993 and is in good standing with the company. Since his hire date, this individual has tested negative six times for drugs and alcohol. The most recent test occurred on October 15, 1997. All our managers must successfully complete an eight hour course designed specifically to identify evidence of drug or alcohol use by their employees. Dave Palmer, a reserve police officer with the Bakersfield Police Department, was in dose proximity to our driver both inside and outside buildings at the spill site and did not notice any evidence of drugs or alcohol present in the driver's system. cf123197.11il Mr. Dan Hilburger Mr. Larry Williams December 31, 1997 Page 3 Upon arrival at the station at approximately 4:30 p.m., M.P. Environmental proceeded with the clean-up process. This consisted of spreading granulated absorbent over the foamed portions of the asphalt and concrete and then collecting and transporting this material under the Non- Hazardous Waste Manifests shown in Attachment ffl to the MeKittfick Disposal Facility located in McKittfick, California. Approximately one yard of soil was removed from the field adjacent to the comer of the property as indicated by the photo in Attachment II. Filler soil was obtained from a small berm in the field. According to the M.P.'s Don Adams (805-326-3978) who supervised the dean-up operations, the clean-up process was without incident and a success. We will take responsibility for completing and submitting the D.O.T. Hazardous Materials Incident Report. We apologize for this preventable spill. As a result of this spill the driver was suspended, and will lose incentive pay and CTE bonus. In an effort to reduce the fi'equeney of spills, we have worked with Civacon to develop a delivery fitting with a flapper valve should the fitting "pop oft" the delivery tank receptacle. Many of our trucks are now equipped with such fittings and the remaining units will be receiving theirs by July 1998. The total cost to us for equipping our fleet with these fittings is apProximately $120,000.00. In an effort to further reduce the chances of this happening in the furore, the circumstances of this spill will be presented to all our drivers during the next round of safety meetings starting in January 1998.
