HomeMy WebLinkAboutRES NO 54-00RESOLUTION NO.__~ 4 "0 0 A RESOLUTION DETERMINING THAT SEATING, CABINETS, SHELVES, DOOR FRAMES, DOORS, AND WINDOW WALLS FOR THREE ADDITIONAL. SUITES AT THE CENTENNIAL GARDEN ARENA CANNOT BE REASONABLY OBTAINED THROUGH USUAL BIDDING PROCEDURES AND AUTHORIZING THE FIINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFORE, NOT TO EXCEED $47,000 IN AGGREGATE TOTAL. WHEREAS, the City of Bakersfield (CITY) desires to construct three new suites on the concourse level of the Centennial Garden Arena (ARENA); and WHEREAS, the operator of the ARENA, Ogden Entertainment, Inc, (OGDEN), agrees with the construction of these additional suites; and WHEREAS, the seating in balconies of the additional suites must match the existing seating in the existing suites in order to provide uniformity of accommodations between all the suites; and WHEREAS, CITY has determined that only the seating provided by Irwin Seating Company will match the existing seating which also were obtained from Irwin Seating Company; and WHEREAS, OGDEN has commitments from individuals and/or companies to lease these additional suites; and WHEREAS, those commitments require that the suites be ready for use by the lessees before the commencament of the Fall 2000 ice hockey season; and WHEREAS, certain items of construction, including cabinets, shelves, door frames, doors, and window walls, for these additional suites require several months for manufacturing of the items; and WHEREAS, the construction of the project would be delayed beyond the above stated project completion date if the furnishing of these items were included in the agreement with the general contractor; and WHEREAS, the Public Works Director recommends (1) that Council find that said seating for the additional suites cannot be reasonably obtained from more than one vendor because of the restricted availability of those seats and that the above described construction materials must be ordered before awarding an agreement to the general contractor and (2) that Council authorize the Finance Diirector to dispense with bidding for the seating and for said construction materials; and S:~PROJECTS~ARNOLD\Gentennial Garden Additional Concourse Level Suites\Resolution 05_19_00.wpd --May 25, 2000 Page 1 of 3 WHEREAS, the Finance Director recommends (1) that Council find that said seating cannot be reasonably obtained from more than one vendor and that the above described construction materials must be ordered before awarding an agreement to the general contractor as per the Public Works Director's recornmendation and (2) that Council dispense with bidding under subsection D.2. of Section 3.20.060 of the Bakersfield Municipal Code. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The above-recitals are true and correct and incorporated herein by reference, The seating in the balconies of the additional suites cannot be reasonably obtained from more than one vendor bec.~use of restricted availability of the seats. The cabinets, shelves, door frames, doors, and window walls must be obtained by CITY before awarding an agreement to the general contractor so that said items will be successfully integrated into an existing City project. The Finance Director is authorized to dispense with bidding in accordance with subsection D.2. of Section 3.20.060 of the Bakersfield Municipal Code. The Mayor is authorized to execute a contract, as approved by City staff, with Irwin Seating Company in an amount not to exceed $7,000. The Mayor is authorized to execute contracts, as approved by City staff, with various companies identified by City staff as being the best company to provide the cabinets, shelves, door frames, doors, and window walls, such determination being made by informal bidding of each of the items, the aggregate total of said contracts shall no'[ exceed $40,000. ......... 000 ........
