Mr. Steve Ladd invited the Council to attend their Board meeting on Tuesday, January 16, 1990, at 10:00 a.m., to accept a presentation on behalf of the City for their Canned Tree efforts. Ms. Carolyn Temple, Administrator for Medi-Center of Bakersfield, 34th and "Q" Streets, distributed correspondence to the Council and spoke regarding bidding for the City's medical contract for workers' compensation injuries and implementation of physicals. review years. Upon a motion by Councilmember PeterSson, the matter of the City's health services contract was referred to the Budget and Finance Committee. Mr. Thomas Martin, President of Martin Outdoor Advertising, 3101 Sillect Avenue, spoke regarding the ordinance pertaining to the ban on outdoor advertising signs and asked that there be a ten-month moratorium on building signs and during this period of time they would like to discuss the matter with Council. Mr. John Walker, Manager of 3M National Advertising, 5678 East Shields Avenue, Fresno, California, spoke regarding proposed prohibition on off-site advertising and requested referral of this issue back to committee. 818 Bakersfield, California, January 10, 1990 - Page 5 HEARINGS This is the time set for a public hearing to consider an Ordinance of the Council of the City of Bakersfield requiring the strengthening of unreinforced masonry buildings and the time for compliance. Correspondence has been received from Griffin Communication, dated January 8, 1990, in opposition to the proposed Ordinance. Correspondence has also been received from the Downtown Business Association, dated January 1 0, 1 990, regarding the Unreinforced Masonry Committee. This hearing has been duly advertised and posted as required by law. City Manager Dale Hawley stated that the staff recommendation is that no action be taken on the draft Ordinance and that this is the first opportunity for property owners to be heard. He suggested that Council receive input and then refer the item to staff or to the URM Committee, and if it is referred to the Committee, he suggested that the Committee be expanded to include more representatives from the area. Building Director Cal Bidwell provided a chronological history of events leading up to the noticed hearing of the draft Ordinance pertaining to unreinforced masonry buildings. Upon a motion by Councilmember Peterson, Council will abide by the regular Council rules of allowing fifteen minutes for each side to speak and five minutes for rebuttal. Mayor Medders declared the hearing open for public participation. Ms. Diane Rotondo, Greater Bakersfield Chamber of Commerce, read a letter sent to City Manager Dale Hawley on January 4, 1990, as follows: The unreinforced masonry ordinance draft is scheduled for a hearing January 10, 1990. I understand that the committee and staff spent considerable time in developing this draft and commend their efforts. Dale of the Chamber was invited to participate, and I was able to attend a part of one meeting. However, I did not contribute to nor was I or anyone from the Chamber involved in the development of this ordinance. I was contacted by Cal Bidwell's office and, of course, had to decline signing. I was very disappointed to find that my name was not removed from the draft. Please have this done before the Council meeting on the 10th and before further disbursement of the draft ordinance. Bakersfield, California, January 70, 1990 - Page 6 As you know, the Chamber has not taken a position on this ordinance. There doesn't appear to be an easy answer. Yet an appropriate alternative must be identified that is acceptable to all involved. One consideration is that possibly all financial assistance avenues have not been explored. The Chamber is prepared to participate as a part of a more representative community group, including many of those impacted. As the County and other cities are still considering alternatives, we feel there is time for further evaluation and consideration of other local approaches to solving this problem that impacts us all. Mr. Charles Drew, President of the Downtown Business Association, stated there are copies of tapes of the public meeting which the Downtown Business Association sponsored on January 3, 1990. He stated they are distilling a list of questions submitted in writing by the public at that meeting, and that list will be available at the end of the week. He also stated they have a Background Statement and a Statement of Findings that should be part of the plan that the Downtown Business Association is proposing. Mr. Curtis Darling, property owner on 19th Street, spoke in opposition to his building being placed on the unreinforced masonry building list. Mr. Robert Kuyper, Pastor of Trinity United Methodist Church in East Bakersfield, spoke in opposition to the draft Ordinance pertaining to unreinforced masonry buildings. Mr. Paul Dennis, property owner on 18th Street, spoke in opposition to the draft Ordinance pertaining to unreinforced masonry buildings. Mr. Alan Opel, 630 Kentucky Avenue, Baker Street, spoke in opposition to the pertaining to unreinforced masonry buildings. property owner on draft Ordinance Councilmember McDermott was seated at 7:55 p.m. Ms. Pat Griffin, M. A. Griffin & Sons and Griffin Communications, spoke in opposition to the draft ordinance pertaining to unreinforced masonry buildings. Bakersfield, California, January 10, 1990 - Page 7 Mr. Jerry VanCuren read a letter dated January 10, 1990, regarding Unreinforced Masonry Mitigation Ordinance, as follows: During the past several months I served on the committee appointed to study and formulate this ordinance, and as you are probably aware, I could not support sending this proposed ordinance to your body for consideration. As the committee studied this problem, I began to realize the serious results of the implementation of an ordinance such as is being proposed. I feel this ordinance, if adopted, will result in many people losing their property, many owners being forced out of business, and many tenants either closing their doors and/or relocating out of Central Bakersfield. We should also recognize that when the old hotels are closed, we will be creating more homeless people in Bakersfield. Legislation such as this should not be enacted without some plan of recovery or funding in place. Mr. Paul Wackerly, property owner at 19th and Eye Streets, stated that the Council should put some concentrated effort into bringing something into Bakersfield instead of trying to take something out. Mr. Egan Gost spoke in opposition to the draft ordinance pertaining to unreinforced masonry buildings. Mr. Dean Gay spoke in defense of the committee that served with Mr. Cal Bidwell in formulating the draft ordiaance pertaining to unreinforced masonry buildings and read a portioa of a letter he prepared as follows: It is very hard to get a feeling for this problem unless one goes into the areas affected to observe the buildings, then one becomes aware there are in excess of one million square feet of buildings affected. The passing of State Law 547 has placed a cloud of stagnation on every unreinforced masonry building in Bakersfield, and until the condition of the building is known and repairs made, it will be difficult to sell or lease the property for any price close to its value prior to the Bill's passage. If the City fails to pass an ordinance in compliance with SB 547, it will not relieve the owner, his agent or his tenant of possible liability in case of a quake. However, please don't pass the ordinance and then say to the building owners, "it's your problem now." It is my opinion this is a community problem. The future of Downtown depends on how we now handle the issue now. 321 Bakersfield, California, January 10, 1990 - Page 8 Mr. Gerald Clifford, property owner at 19th and Chester, spoke regarding the draft ordinance pertaining to unreinforced masonry buildings. Attorney Ed Wilson, property owner on Chester Avenue, spoke in rebuttal of the draft ordinance pertaining to unreinforced masonry buildings. Mr. Dean Gay spoke in rebuttal and discussed insurance liability. no one public action. No further protests or objections being received and else wishing to speak in favor, Mayor Medders closed the portion of the hearing for Council deliberation and Upon a motion by Councilmember DeMond, the input was received and the draft ordinance pertaining to unreinforced masonry buildings was referred to staff to include an expanded committee. Mayor Medders recessed the meeting at 8:55 p.m., and the meeting was reconvened at 9:00 p.m. ACTION ON BIDS Approval of Telephone Equipment. Upon a motion by Councilmember DeMond, the low bid from AT&T in the amount of $63,373.22 was accepted and the other bid rejected. Approval of Truck with Aerial Device for Tree Trimming by Parks Division ( replacement ). Upon a motion by Councilmember Salvaggio, the ~ow~bid ~rom Pac Power, Inc. in the amount of $73,977.63 was accepted and the other bid rejected. DEFERRED BUSINESS Adoption of Ordinance No. 3268 of the Council of the City of Bakersfield amending Chapter 2.52 of the Bakersfield Municipal Code relating to the Bakersfield Convention Center (formerly Civic Auditorium). This Ordinance was given First Reading at the Council meeting of December 13, 1989. Upon a motion by Councilmember Edwards, Ordinance No. 3268 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Salvaggio Noes: None Abstain: None Absent: Councilmembers Peterson, McDermott Bakersfield, California, January 10, 1990 Page 9 Adoption of Ordinance No. 3269 of the Council of the City of Bakersfield adding Chapter 5.35 to the Bakersfield Municipal Code relating to motion pictures. This Ordinance was given First Reading at the meeting of December 13, 1989. Upon a motion by Councilmember,DeMond, Ordinance No. 3269 of the Council of the City of Bakersfield was adopted by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None NEW BUSINESS Referral of an Ordinance of the Council of the City of Bakersfield amending Subsection O. of Section 17.60.070 and Subsection G. of Section 17.60.080 of the Bakersfield Municipal Code, adding Subsection 48. to Section 17.60.030, and repealing Subsection A. 2. of Section 17.60.160 and Subsection A.2. of Section 17.60.170 to the Bakersfield Municipal Code relating to signs. On December 13, 1989, the City Council unanimously adopted an Ordinance extending interim Ordinance No. 3263. The Ordinance extended the prohibition agains~ the permitting of all outdoor advertising signs for a period of 10-1/2 months to allow the Planning Commission time to complete its review of the Sign Ordinance. The Planning Commission completed its review and met on December 21, 1989, and approved an Ordinance amending certain sections of the Bakersfield Municipal Code to prohibit all off-premise signs, including outdoor advertising signs. Councilmember Peterson made a motion to refer this Ordinance to the Planning Commission for further review. A provision that addresses the spacing issue of a 1,000 feet radius. 2. No billboards over roofs. 3. No circumventing on Premise Sign Code with adjacent billboards. 323 Bakersfield, California, January 10, 1990 Page 10 Mechanism where some of the billboards that are up that represent billboard clutter and visual blight will come down either by way of relocation and/or by permitting new billboards to go up elsewhere and with the provision that some of the others will come down. That the outdoor advertisers, staff and the Planning Commission go to the table as soon as possible on this matter. Councilmember McDermott made a substitute motion that this matter be referred to the Urban Development Committee. Councilmember Peterson withdrew his motion to refer this matter to the Planning Commission. The substitute motion by Councilmember McDermott to refer this matter to the Urban Development Committee was approved with Councilmember Salvaggio voting no. First Reading of an Ordinance of the Council of the City of Bakersfield amending Title 17 of the Bakersfield Municipal Code by changing the Land Use Zoning of those certain properties located on the southeast corner of Teal Street and Hughes Lane from an R-3 (Limited Multiple Family Dwelling} gone to a C-2 (Commercial) or more restrictive zone. The project area is currently zoned R-3 and designated as Commercial on the Land Use Element of the Bakersfield Metropolitan General Plan. Rezoning to C-2 will bring the site into consistency with the General Plan. First Reading of an Ordinance of the Council of the City of Bakersfield repealing Section 3.40.140 of the Bakersfield Municipal Code relating to enforcement of and penalties for violation of the Transient Lodging Tax Chapter. Currently the penalty for violation of the Transient Lodging Tax Chapter is a fine of $25.00 to $500.00. There is no prescribed jail penalty. A violator may not be ordered to pay his tax as a condition of probation. By repealing this section, the general penalty under Section 1.40.010 of the Bakersfield Municipal Code, including a possible jail sentence, would apply. Bakersfield, California, January 10, 1990 Page 11 Referral of an Ordinance of the Council of the City of Bakersfield amending Sections 13.04.140 and 13.04.190, and Subsection P. of Section 13.04.260 and Subsection A. of Section 13.04.265, and repealing Section 13.04.160 of the Bakersfield Municipal Code relating to maintenance districts. This amendment removes the requirement that notice of hearings for maintenance districts be mailed to all owners of property subject to assessment. Instead, the Ordinance requires that notice be given by two publications of display ads which must include maps of the boundaries of the districts. Upon a motion by Councilmember Peterson, this Ordinance was referred to Public Works staff for further study. Adoption of Resolution No. 3-90 of the Council of the City of Bakersfield amending the Official List of Designated Special Speed Zones, pursuant to Section 10.24.020 of the Bakersfield Municipal Code. Upon a motion by Councilmember DeMond, Resolution No. 3-90 of the Council of the City of Bakersfield was adopted by the following roll call vote: - Ayes: Councilmembers Edwards, DeMond, Smith, Brunni, Peterson, McDermott, Salvaggio Noes: None Abstain: None Absent: None Request by Councilmember Mark Salvaggio that all Council Co~mittee meetings be open and public, and that such Committee meetings will be held only after full and timely notice is made to the public. Councilmember Salvaggio made a motion that all Council Committee meetings be open and public, with the exception of meetings that are exempt from the public meeting requirements of the Brown act where they are to be considered by the full Council, and would also include Closed Session before a committee and discussions with committee concerning matters of negotiation of contracts; also, that there be a 24-hour notice delivered to committee members, the news media and posted on the bulletin board. Upon a substitute motion by Council will continue with closed Councilmember Salvaggio voted no. Councilmember Smith, committee meetings. Appointment of Council Representative to the Kern County Economic Development Council. Upon a motion by Councilmember Peterson, Councilmember Smith was nominated to the Kern County Economic Development Council. :]25 Bakersfield, California, January 10, 1990 Page 12 One appointment to the Citizens' Parks and Recreation Committee due to the expiration of term by Anthony Daniels (Ward 1), whose term expired November, 1989. Upon a motion by Councilmember Edwards, Ms. Geraldine Spencer, 1019 Bank Street, was appointed to the Citizens' Parks and Recreation Committee. Appointment of Council Representative to the Consolidation Transportation Service Agency Advisory Board. Upon a motion by Councilmember Peterson, Councilmember Edwards was appointed to the Consolidation Transportation Service Agency Advisory Board. Three (3) appointments to the Community Advisory Council (Southeast Bakersfield Enterprise Zone) due to the expiration of terms by Bernard Wallace, Bill Lewis, and Alice Mack on Dec-mher 31, 1989. Upon a motion by Councilmember Edwards, Reverend Ishmael Kimbrough, 1320 Falcon Avenue, and Mr. Robert E. Lee Davis, 2024 Hasti Acres Drive, were nominated to the Community Advisory Council (Southeast Bakersfield Enterprise Zone), terms expiring December 31, 1990, and the third appointment was deferred until the next Council meeting. One appointment to the Bakersfield Airpark Advisory Committee, due to the expiration of term by Oscar Anthony, whose term expired June 17, 1989. (4-year term) Upon a motion by Councilmember Edwards, Reverend Fred L. Thomas, 213 South Milham Drive, was appointed to the Bakersfield Airpark Advisory Committee. COUNCIL STATEMENTS Upon a motion by Councilmember Salvaggio, problem at Sandra Drive/Laurel Drive and Planz Road was referred to the Public Works staff for a report. the traffic in his Ward Councilmember Salvaggio read a letter from Leadership Bakersfield regarding Par Course, Kern River Parkway, as follows: We are a group of five individuals serving on a group project as part of the Leadership Bakersfield Program of the Greater Bakersfield Chamber of Commerce. Our group's goal is to achieve the purchase and installation of a Par Course in the Kern River Parkway by June of 1990. We intend to do so by seeking private 'party contributions. Thereafter, we would purchase the par course and donate it to the City of Bakersfield for installation. We have already met with City of Bakersfield staff members who have identified a location in the development of Phase I along Truxtun Avenue at Mohawk Street as the appropriate location. 326 Bakersfield, California, January 10, 1990 - Page 13 We request that this item be placed on the next Agenda of the City Council for approval or for referral to staff as is appropriate. We have already identified likely sources of funding, but those sources will dry up if we are not able to reach an agreement with the City regarding location, installation by June 1990, and other necessary items. We will be pleased to work with you, the members of Council, or members of the City s t a f f i n accomplishing this. We look forward to hearing from you as soon as possible and to the successful completion of this donation to the development of the Kern River Parkway. Upon a motion by Councilmember Salvaggio, the par course matter was referred to staff. Councilmember Edwards announced that John Robinson, Director of the Bakersfield Senior Center, passed away, and they have asked him to serve as interim director until their search for a permanent director is completed. Councilmember DeMond spoke regarding the Panorama cooperative situation with the County and regarding the City doing the rolling curbs and gutters while the County puts down the bike path and parking lot. She stated that Supervisor Larwood indicated that the project is on hold as far as the County is concerned because City staff indicated it was going to cost more than anticipated and that it was going to be done over two fiscal years. Councilmember McDermott spoke regarding Leadership Bakersfield being an outstanding program which helps train people and give them exposure to what is going on in Bakersfield. Councilmember Brunni spoke regarding Leadership Bakersfield providing a great insight into what is happening and what possibilities there are and where people can have an impact. Councilmember Brunni stated political sign in her Ward on White Lane have removed. there is a temporary that she would like to Councilmember Brunni commented on what a nice, inspiring Prayer Breakfast they had. Councilmember DeMond thanked staff and everyone in the City of Bakersfield and County of Kern who brought in their Christmas trees to participate in the recycling project.
