W~K~U%~, by Resolution of Intention No. 1074 adopted on June 13, 1990, a public hearing was called for July 25, 1990, at the hour of 7:00 P.M., in the Council Chambers in the City Hall, 1501 Truxtun Avenue, Bakersfield, California, to ascertain whether the public necessity, health, safety or general welfare requires the removal of poles, overhead wires and associated overhead structures and underground installation of wires and facilities for supplying electric, comunication, cable television or similar and associated services, within that certain area, more iparticularly described as follows: UNDERGROUND UTILITY DISTRICT NO. 2 DIVISION 21 That area in the City of Bakersfield, State of California, more particularly described as follows: A 50-foot wide strip of land in the North 1/2 of Section 26, Township 29 South, Range 27 East, M.D.M., City of Bakersfield, County of Kern, State of California, and said strip being situated along the following described center line; Commencing at the point of intersection of the center lines of Truxtun Avenue and Empire Drive as shown on Parcel Map No. 7310 filed in Book 32 of Parcel Maps at 80 in the office of the Kern County Recorder; Thence North 00000'07" West, along said Empire Drive center line, 278.00 feet to the beginning of a 300.00 foot radius curve, concave to the southeast; Thence Northeasterly along said centerline curve through a central angle of 22°13'26", an arc distance of 116.36 feet to the center of an existing concrete monument with a brass cap marked R.C.E. 15331 (per Parcel Map No. 7310); Thence, departing said centerline, North 26°23'26" East, 1,0127.64 feet to the TRUE POINT OF BEGINNING; Thence Sollth 84°17'03" West, 660.00 feet to the END POINT of this description. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WttEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to appear and be heard. NOW, T~EFORE, BE IT RESOLVED by the Council of the City of Bakersfield that, pursuant to Chapter 12.32 of Title 12 of the Municipal Code of the City of Bakersfield, the above- described area is hereby declared an underground utility district and is designated as Underground Utility District No. 2, Division 21, of the City of Bakersfield. Attached hereto, marked Exhibit "A", and hereby incorporated as a part of this Resolution, is a map or diagram entitled as follows: UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 21, delineating the boundaries of said District. BE IT FUR'~"~-RESOLWED that the electric utility which undertakes underground installation of its facilities shall use the underground conversion allocation computed pursuant to decisions of the Public Utilities Co~mission of the State of California for the purpose of providing to each premises in Underground Utility District No. 2, Division 21, requiring a maximum of one hundred feet of individual electric service trenching and conductor, as well as backfill, paving and conduit. Any balance of costs required for conversion of utility service to individual properties to undergrounded service shall be borne by the City or otherwise provided at no cost to property owners. BE IT FURTHER RESOLVED that the Council does hereby fix December 21, 1991 as the date on which all affected utilities must have all facilities installed, and have completed removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, cable television or similar or associated services within Underground Utility District No. 2, Division 21. BE IT FUR'£~- RESOL~ that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 2, Division 21, of the adoption of this Resolution within ten (10) days after the date of such adoption. - 2 - Such notification shall be made by mailing a copy of this Resolution, together with a copy of Chapter 12.32 of the Municipal Code of the City of Bakersfield, to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. BE IT FUR'£'-K- ~R~OLVED that the Council hereby finds and determines as follows: 1. That the public necessity, health, safety or general welfare req'uires the removal and undergrounding of poles, overhead wires and associated overhead structures within Underground Utility District No. 2, Division 21. 2. The Underground Utility District herein created is in the general public interest for the reason that the streets, roads or right-of-way in the District are extensively used by the general public and carry a heavy. volume of pedestrian and vehicular traffic. .......... o0o ..........
