A RESOLUTION OF APPLICATION OF THE COUNCIL OF
THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS
FOR ANNEXATION OF TERRITORY TO THE CITY OF
BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 336,
CHESTER NO. 2 ANNEXATION (WARD 2).
WHEREAS, the City of Bakersfield desires to propose a
change of organization, to wit, the annexation to the City of
Bakersfield of the hereinafter-described territory, pursuant to
Section 56800 of the Government Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that it hereby finds and determines as
follows:
1. That the City of Bakersfield hereby proposes the
annexation to the City of Bakersfield of the territory described
in Exhibit "A", attached hereto and made a part of this resolu-
tion as though fully set forth herein.
2. That a map of the territory proposed to be so
annexed, marked Exhibit "B", is attached hereto and made a part
of this Resolution as though fully set forth herein.
3. That a plan for providing services within the
affected territory of the proposed annexation, in accordance with
the provisions of Section 56653 of the Government Code, is marked
as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
4. That this proposal for change of organization, to
wit, annexation, is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985, and it is requested that
proceedings be authorized for annexation in accordance therewith.
5. That the reasons for the proposed change of organi-
zation are that the owners and residents of the affected terri-
tory desire to receive municipal services from the City of
Bakersfield, and the City desires to receive tax revenues for
benefits given and to be given to the territory proposed to be
annexed.
6. That for this proposed annexation and the zoning
upon annexation, therefor, Ordinance No. 3295, which was adopted
June 27, 1990, an Initial Study was conducted and it was deter-
mined that the proposed project would not have a significant
effect on the environment. A Negative Declaration (with mitigat-
ing measures) was prepared and posted on April 20, 1990.
7. That the laws and regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in the
California Environmental Quality Act and City of Bakersfield
Resolution No. 107-86 have been duly followed and the Negative
Declaration for this proposed annexation is hereby approved and
adopted.
8. That the territory proposed for annexation as
described herein has been determined to be uninhabited pursuant
to the Cortese-Knox Local Government Reorganization Act of 1985,
Section 56046 of the Government Code.
9. That the names of the officers of the City of
Bakersfield who are to be furnished with copies of the Executive
Officer's Report and who are to be given mailed Notice of
Hearing, if any, are:

A parcel of land situate in the Northwest quarter of Section 19, Township 29
South, Range 28 East, M.D.M., in the County of Kern, State of California, more
particularly described as follows:
Beginning at the Northeast corner of Lot 1 of Block 632 as shown on map entitled
"Map of the City of Bakersfield Kern County California" filed November 25, 1898
in the office of the Kern County Recorder, said corner also being a point on ~he
existing corporate boundary of the City of Bakersfield;
THENCE (1) Departing from said corporate boundary, westerly along the north line
of said Lot 1 and westerly prolongation thereof (South line of 36th St.), a dis-
tance of 431.20 feet to the Northeast corner of Lot 1 of Block 633;
THENCE (2) Northerly along the east line of Block 655 and prolongation thereof
(West line of Jewett Ave.), a distance of 693.00 feet to the Northeast corner of
Lot 1 of said Block 655 also being a point on the existing corporate boundary of

Police-All police services in the City of Bakersfield are administered
through the City Police Departra~nt located at the s/w corner of Truxtun
Avenue and Eye Street about l~miles south of the annexation.
Fire-City Fire Station No. 4 is about 3/4 mile East on Bernard Street
Parks and Recreation-Central Park is located within 1 mile southerly.
Jefferson Park is located l~miles to the East.
Library-N/A
Streets-The City Corporation Yard on Truxtun Avenue west of Freeway 99
will provide necessary facilities, personnel and services to
accommodate Public Works Department efforts. Maintenance
personnel will be dispatched from the Corporation Yard on a
regular basis for preventative maintenance and "As Needed" repair
including street construction and maintenance, sweeping of streets
arid street light maintenance.
Sewer-The area is already connected to the City sewer system at 34th and
Jewett Streets by contract agreement with the County Alta Verde Sanitatior
District. The City and County have agreed on detachment of the area from
the district upon annexation.
Water-The territory is now served by and will continue to be served by
California Water Service Company.
Other-(Refuse)-When annexed service will be provided by the City by
contract with a franchise collector or by City forces.

24 hour patrol is provided in the immediate
vicinity of this annexation. First priority
response is approximately 7.00 minutes or less.
Fire protection is provided on a 24-hour
basis with response time of 3 minutes or less.
The annexation will not affect City/County joint
fire service capability.
Ail City parks are open to the public at
reasonable hours.
There will be no reduction in the range or
capacity of the City to provide the necessary
Public Works Services to this area. Service
will be on a regular basis "As Needed".
Adequate capacity exists.

III.
What effects, if any, would annexation of this territory have on the existing level
of city/district services (i.e., need for additional emergency service personnel or
construction of new facilities, etc. )? The annexation of this territory will not
affect near term level or capability of the City to provide needed services. A
major portion of the area (8 acres) is now being cleared of existing residential
structures for construction of a new elementary school by the City School District.
The remainder portion is a small established built-out area. The project may or
may not required additional City Police Officers to maintain the current level of
city police protection.
IV.
Would city/district reck]ire any upgrading or change in facilities to serve affected
territory (roads, fire hydrants, mains, etc.)? If so, would city/district o__r residents
be responsible for financing? The City will not require any upgrading or chanqes in
existing facilities as a prerequisite for annexation. In case any future development
should occur, the developer shall provide and pay for major improvements or
facilities.
Indicate and explain existing zoning in affected territory. The subject territory
is presently zoned R-3 (High Density Residential) in the County. Prior to Land
clearing for the school :site, this area was occupied by multiple family, sinqle
family, institutuinal, commercial, church and open space uses.
Indicate and explain proposed prezoning in area. (List effects on present land
use that would occur as a result of annexation such as maintenance of livestock
on property, etc). The proposed prezoning or Zoninq Upon Annexation will be
City R-3 (Limited Multiple Family Dwelling) zone over the majority of the area
and R-3 CH (Limited Multiple Family Dwelling, Church Overlay) zone on the
Southerly portion where the existing church property is located (See attached
zoning plat). The proposed project will result int he elimination of seven
sinqle family ho~es, tri-plex and four plex apartments and a business (A.T. &T).
to be replaced by the school site.

List city/district services that area will directly or indirectly benefit from such as
decrease in fire insurance rate, shorter emergency response time, use of community
facilities, etc. City police should be able to respond in a more timely manner than
the present County Sheriff and State Highway Patrol. Current City Police standard is
higher sworn officer per 1,000 population percentage comt~ared to the County standard.
Refuse service will be provided by the City and will result in savings to the owners
within this annexation. No special assessments or charqes for street sweeping, leaf
collection, school crossinq guards, street lighting energy costs and fire hydrants.

Please provide the following information relative to city/district and county taxes:
List existing tax rate(s) in area. The existing tax rate in area equal 1.121153% of
assessed market value. This represents the total property tax rate. When annexed
a desiqnated percentage of the total tax of the area will accrue to the City. (Rate
as shown on 1989-90 County Auditor-Controller Tax Rate List).
Would effected area be subject to any bonded indebtedness of the city/district: If
so, explain. Yes, the tax rate for City bonds equals 0.004298% of assessed market
value. When annexed, the total tax rate will be 1.125451%. (Rates as shown on
1989-90 County Auditor-Controller Tax Rate List)

HOW will the difference in tax rates affect a house with a market value of $50,000.00?
The yearly tax would increase by the amount of $2.15 on a house of $50,000 this
market value due to inclusion of the City Bond Rate.
