HomeMy WebLinkAboutRES NO 88-90RESOLUTION NO. 88-90 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD PROVIDING FOR THE COLLECTION OF REFUSE CHARGES BY T~ COUNTY TAX COLLECTOR. WR~K~%S, on July 2, 1986, the City Council of the City of Bakersfield duly passed and adopted Ordinance No. 3052 requiring the recovery of costs reasonably borne from fees and charges levied therefor in providing the regulation, products, or services enumerated in this ordinance for the collection and disposal of refuse; and %~EI~EAS, Section 50 of the Charter of the City of Bakersfield and Section 51334 of the Government Code of the State of California permit the City Council to provide for the collection of such charges by the County Tax Collector; and W~{EREAS, Section 8.32.060 B. of the Bakersfield Municipal Code requires that such refuse charges be submitted to the Kern County Auditor-Controller and Tax Collector for placement of such charges as assessments on the secured roll of the County to be collected in the same manner as ad valorem property taxes. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The Council of the City of Bakersfield transfers the function of collection of refuse charges for all single-family dwellings, duplexes, triplexes and fourplexes to the County Tax Collector pursuant to Section 8.32.060 B. of the Bakersfield Municipal Code to be billed at the time of billing for property taxes. Such charges shall be in the amounts specified in Executive Order adopted pursuant to Bakersfield Municipal Code Section 3.70.040 attached hereto as Exhibit "A" and incorporated herein by reference. .......... o0o .......... The undersigned, representing the Sanitation Division of the Community Services Department, hereby certifies that the 19PO-~lFiscal Year 100 % of the costs reasonably borne incurred in providing the regulation, proOuct, or service of pursuant to Section 3.70.D4D of the Bakersfield Municipal Code will be recovered by the rate structure herein below enumerated. Said rate structure has been developed pursuant to the provisions of Chapter 3.70 of the Bakersfield Municipal Code and is hereby reco~ended for adoption by the City Manager by Executive Order as fulfillment of the provisions of said Chapter 3.70.
