Councilmember McDermott made a motion to amend the minutes to reflect that he was in attendance at the Closed Session Council Meeting of January 24, 1990. Councilmember McDermott made a motion to amend the minutes to reflect that Mr. Charles Drew spoke at the January 24, 1990, Council Meeting, as opposed to Mr. Fred Drew. Upon a motion by Councilmember McDermott, Items a, b, c, d, e, f, g, h, i, j, k, 1, m, o, p, q and r, with the deletion of Item n., were adopted with the amendments by the following roll call vote: Ayes: Councilmembers Edwards, DeMond, Smith, Peterson, McDermott, Salvaggio None None Councilmember Brunni Noes: Abstain: Absent: Bakersfield, California, February 7, 1990 - Page 5 REPORTS Councilmember DeMond read Budget and Finance Committee Report No. 1-90 regarding Ordinance Adding Formal Contract Procedure for Contracts Not Involving the Purchase of Goods as follows: This Ordinance is proposed as a result of a recent review by staff of City practices and procedures regarding the approval and execution of City contracts, recent changes to the City Charter and Municipal Code regarding purchasing regulations, and recent experience in litigation. It is the purpose of this Ordinance to clarify the City's contracting policies and procedures, particularly for those contracts not involving the purchase of goods (i.e., service contracts, etc.) The Ordinance requires that all contracts not involving the purchase of goods be set forth in writing, approved as to form by the City Attorney, and signed by the Mayor, a City Department Head, the Finance Director and filed with the City Clerk. Such contracts of $20,000 or more must be authorized by the City Council. This is consistent with our new ordinance regarding the purchasing of goods. Contracts not involving the purchase of goods may be amended, in writing, if signed on behalf of each party. Contract amendments must Council action, with Public Works contracts. be authorized by the exception of For Public Works contracts not involving the purchase of goods, if each individual change order exceeds $10,000 or the cumulative amount of change orders for that contract exceeds 25% of the original contract amount, amendments must be approved by the Council. The Ordinance further clarifies that the City shall not be bound by any representation of any officer, employee or agent of the City unless such representation has been made in writing and approved in the above prescribed manner. The Committee recommends that the proposed Ordinance be given first reading. Bakersfield, California, February 7, 1990 - Page 6 Upon a motion by Councilmember DeMond, Budget Finance Committee Report No. 1-90 was accepted. First Reading of an Ordinance of the Council of the City of Bakersfield adding Section 3.20.105 to the Bakersfield Municipal Code relating to Formal Contract Procedure for Contracts Not Involving the Purchase of Goods. and The City Council referred the issue of the City Physician Contract to the Budget and Finance Committee for review. The Committee met and discussed this issue with staff, who provided information regarding the selection of the City Physician. It was explained by staff that the City Physician represents the interests of the City of Bakersfield by performing pre-employment physicals, drug screenings, fitness-for-duty physicals, driver's license physicals, and specialized medical services related to worker's compensation and liability claims. The Committee concluded that it is in the best interests of the City of Bakersfield to retain the City Physician for a fixed period of time. Further, that it would be appropriate to begin this period on July 1, 1990, the start of fiscal year 1990-91. Therefore, the Committee recommends the following: A two-year renewal cycle with annual reviews will be established for City Physician agreement. Staff will immediately begin the process to prepare and distribute requests for proposals for City Physician services. Staff will review and evaluate the proposals submitted and will present a report to the Council indicating those meeting the requirements of the specifications for further review by the Council or Budget and Finance Committee. Final selection will be made by the Council. Beginning July ~ , 1 990, an agreement for City Physician services be entered into for a period not to exceed two years. The Committee requests that the Council accept this report and implement its recommendations. Councilmember McDermott, Chairperson of the Budget and Finance Committee, read Report No. 2-90 regarding City Physician Contract as follows: Bakersfield, California, February 7, 1990 - Page 7 Councilmember McDermott provided a clarification to the report by stating: That the Committee suggested that instead of having a contract that is automatically renewed every year, it should occur with an agreement to be put in effect by July 1 and that all necessary steps be taken by staff to make sure that happens. Those steps would include the Request for Proposal and the Notices of the Cancellation of the Previous Contract. It is the intent of the Committee that staff would receive the proposals, make a recommendation, they would be heard back in the Committee, and the Committee would bring it back to Council for final approval. Councilmember McDermott made a motion to accept Budget and Finance Committee Report No. 2-90 with the stated additions. Councilmember DeMond further suggested that staff needs to work on the operational standards, and that staff bring back to the Council for review the request for proposals within the 60-day period. Councilmember Petersoa stated that the Committee recommended that staff should implement the assistance of outside experts to draw up the request for proposals. City Manager Dale Hawley stated he would be able to prepare a time report for Council within a week or two. Councilmember Edwards suggested that some representation by the organized employees be involved with this process. Councilmember Edwards suggested that staff work with the Insurance Committee and keep the employee groups abreast of what is happening and that they be allowed to express their interests and concerns. The motion by Councilmember McDermott to accept the Budget and Finance Committee Report No. 2-90 with the stated corrections was approved. Upon a motion by Councilmember DeMond, the Finance Director was authorized to enter into a discount agreement with Rimara Supply Company. Annual Contract No. 90-37 with Granite Construction Company for Road Oil Sand for Streets Department. Upon a motion by Councilmember Peterson, the low bid from Granite Construction Company in the amount of $160,650.00 was accepted, the other bids rejected, and the Mayor authorized to execute the Contract. 1 3/4 cubic yard Front End Loader for Parks Department (replacement). Upon a motion by Councilmember Edwards, from Quinn Company in the amount of $77,352.12 was the other bid rejected. the low bid accepted and DEFERRED BUSINESS Zoning Resolution No. 379 of the Council of the City of Bakersfield granting, in part, and denying, in part, the appeal by Mel Blanton from the decision of the Board of Zoning Adjustment to revise and add conditions to a previously approved Conditional Use Permit (#4706) allowing an automotive service center in a C-1 (Limited Commercial) Zone on that certain property commonly known as 3901 Wible Road. This Resolution sets forth the decision of the Council following the public hearing on the matter held on January 24, 1990. Action on this Report was deferred from the ,neeting of January 24, 1990. City Manager Dale Hawley read Joint City/Employee Medical Insurance Committee Report No. 1-90 Regarding Health Care for Retirees as follows: On January 29, 1 990, the Joint City/Employee Medical Insurance Committee met to review the City manager's Report on Retiree Health Care, which was presented to the Council on January 13, 1990. The Committee considered the City Manager's recommendation to pick up 42% of the 1990 premium increase from the Medical Reserve Account for retirees covered under the Blue Cross Plan, only up to the period ending December 31, 1990. It was also discussed that the amount taken out of the Medical Reserve Account would probably be less than the $240,000 originally approved by the Council on December 13, 1989, since 93 retirees transferred to Health Net during the recent open enrollment. Currently 76 retirees are enrolled in Blue Cross, and 188 retirees are enrolled in Health Net. The majority of the Committee members approved the allocatio~ of 42% of the 1990 health care rates for the retiree group covered under the Blue Cross Plan, and that this amount be taken out of the Medical Reserve Account for 1990 only. The Joint City/Employee Committee requests the of this Report. Medical Insurance Council's approval Upon a motio~ by Councilmember Peterson, Joint City/Employee Medical Insurance Committee Report No. 1-90 and City Manager Report No. 4-90 regarding Health Care for Retirees were accepted. Upon a motion by Councilmember Peterson, the recommendations of Joint City/Employee Medical Insurance Committee Report No. 1-90 and City Manager Report No. 4-90 were implemented. Councilmember DeMond announced that the first meeting for the Unreinforced Masonry Building Ordinance Committee will be held Thursday, February 15, 1990, at 7:00 a.m. Bakersfield, California, February 7, 1990 - Page 16 COUNCIL STATEMENTS Councilmember McDermott informed the Council he will be distributing to the Council in the next day or two the Annual Report of the Kern Economic Development Corporation. Councilmember Salvaggio referred to the City Attorney's Office, the Chief of Police and the Police Vice Department an article that appeared in the Los Angeles Times on February 1, 1990, regarding a new state law on child pornography and how prosecution is taking place under this aew law. Councilmember Salvaggio referred to the City Attorney's Office an article that appeared in the Los Angeles Times on January 27, 1990, pertaining to Los Angeles implementing a zoning ordinance seeking to shut down pornography shops in Hollywood, and he would like to know how their proposed ordinance is any different than the current one the City of Bakersfield adopted a few years ago. Councilmember Salvaggio referred to the Building Department an article that appeared in the Los Angeles Times regarding Los Angeles posting big bills for residents' illegal signs. Councilmember Salvaggio stated there is another new state law requiring video stores to place x-rated videos in a separate area within their facility, and he would like to see how this applies locally. Councilmember DeMond stated she recently went to a D.A.R.E. graduation ceremony and Officer Dean was the police officer who had guided children at the particular school, and she commended the officers for the enthusiasm generated through this program. Councilmember Smith referred to the Traffic Committee the area south of Eissler School on Eissler Street. She stated there is concern about the traffic that seems to be speeding through this area. There is a traffic guard there, but area residents feel there is not enough protection for students crossing the street. Councilmember Edwards commended Chief Patterson and members of the Bakersfield Police Department for their quick response and their professionalism.
