HomeMy WebLinkAboutRES NO 81-90RESOLUTION NO. 81-90 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, APPROVING NEGATIVE DECLARATION AND APPROVING THE RIVERLAKES RANCH SPECIFIC PLAN OF PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE METROPOLITAN BAKERSFIELD 2010 GENERAL PLAN (LAND USE ELEMENT AMENDMENT 1-90). WHEREAS, the Council of the City of Bakersfield referred Segment III of a proposed amendment to the Land Use and Circulation Elements of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakers- field, in accordance with the provisions of Section 65353 of the Government Code, held a public hearing on May 3 and May 17, 1990, on proposed amendments to the Riverlakes Specific Plan of the Land Use Element of the Metropolitan Bakersfield 2010 General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publica- tion in the Bakersfield Californian, a local newspaper of gen- eral circulation; and WHEREAS, such Riverlakes Ranch Specific Plan of the pro- posed amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan is as follows: RIVERLAKES RANCH SPECIFIC PLAN MILAZZO & ASSOCIATES representing Unibell International has applied to amend the River- lakes Ranch Specific Plan of the Metropolitan Bakersfield 2010 General Plan as shown in the attached Specific Plan text and maps; and WHEREAS, for the above-described Segment, an Initial Study was conducted, and it was determined that the proposed pro- ject would not have a significant effect on the environment, and a Negative Declaration (with mitigation measures) was prepared; and WHEREAS, the law and regulations relating to the prepa- ration and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 107-86 have been duly fol- lowed by the City staff and the Planning Commission; and OFIIGINAL WHEREAS, by Resolution No. 18-90 on May 17, 1990, the Planning Commission recommended approval and adoption of the Riverlakes Specific Plan, subject to conditions of approval attached to the project as Exhibit "A", and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on WEDNESDAY, MAY 17, 1990, on the above-described Riverlakes Ranch Specific Plan of the proposed amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan, notice of time and place of the hearing having been given an least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, conditions of approval attached to the project as Exhibit "A", are included in the project to minimize and/or mitigate impacts; and Wq~EREAS, this amendment rearranges land uses from previ- ous general plan amendments and specific plan amendments and reduces overall density and intensity of development; and WHEREAS, the Council found as follows: 1. The $675,000 contribution to the westside freeway is adequate to mitigate anticipated off-site traffic impacts and is more beneficial to obtain right-of-way than incremental upgrading of arterial and collector intersections. 2. The mitigation agreements executed with North Bakersfield Recreation and Park District, Norris School District and Fruitvale School District are adequate to mitigate impacts on these facilities. 3. Regarding the General Commercial designation at the northeast corner of Hageman Road and Calloway Drive, the follow- ing findings are pertinent for deviating from the one-half mile commercial separation policy: a. The commercial acreage for the entire groject has been reduced by 30 acres. b. The location is the only commercial located along the west side of Riverlakes Ranch and provides service to a one-mile radius. c. The small 6-acre size and neighborhood orienta- tion reduces anticipated impacts and is buffered by low-medium density residential. d. Anticipated customer base will be in route to or from home thus reducing the number of newly created traffic trips. e. Location of neighborhood commercial west of the canal will reduce number of trips using the canal bridge. f. This commercial acreage was formerly 10 acres located interior to Riverlakes. By reducing the size and locat- ing it at an intersection of arterials the impacts on surrounding land uses have been reduced. NOW, THEREFORE, IT IS HEREBY RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals, incorporated herein, are true and correct. 2. The Negative Declaration for the Riverlakes Ranch Specific Plan is hereby approved and adopted with conditions listed on Exhibit "A". 3. Public necessity, convenience, general welfare and good planning practice justify the proposed General Plan Amendment and Specific Plan Amendment. 4. Proposed General Plan Amendment as conditioned will be compatible with future development in surrounding areas and development on the project area. 5. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted the Secretary of the Planning Commission to the City Council, hereby received, accepted and approved. by is 6. The City Council hereby approves and adopts the Riverlakes Specific Plan of the proposed amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan as identified on Exhibit "B", subject to the conditions of approval listed in attached Exhibit "A". 7. That the Riverlakes Specific Plan, as approved herein, be combined with other approved segments described in separate resolutions, to form a single Land Use Element Amendment, GPA 1-90. .......... 000 .......... Add to Page 9, Item I of the Specific Plan: "Development of local streets is likely to reduce the maximum number of units since conformance to minimum lot size excludes local streets and easements." Add to Page 46, Item 3: "The commercial should be developed "centers" concept. 121 acres designated as major as the core of the northwest Setbacks for lots sharing an immediate boundary with the golf course or lakes shall be 20 feet for the front yard 15 feet for the rear yard. and The linear landscape park/buffer located on the west side of Coffee shall be developed as follows: a o Minimum landscape setback of 25 ft. for commercial land uses and a minimum width of 50 ft. for medium and high density residential land uses and 84 ft. for suburban and low density residential land uses. Constructed concurrently with the first subdivision or parcel map adjacent to Coffee Road within each of the following segments: 1) Norris to Olive 2) Olive to Hageman 3) Hageman to Creekside C o Linear parks adjacent to residential land uses shall be constructed by the applicant and placed in a maintenance district. Landscaped setbacks at commercial land uses shall be constructed and maintained by each respective parcel owner/developer. Construct a masonry wall eight feet in height along the west boundary of the linear park for all residential land use designations between Olive to Hageman that interface with the park. Vehicle and pedestrian ingress and egress to the High Density Residential, High Medium Density, Low Density Residential and Suburban Residential sites adjacent to Coffee Road shall be limited to Norris Road, Olive Drive, Hageman Road and Creekside Drive. Driveways or other access roads for residential uses shall not allow vehicle access to Coffee Road. Page 18, Item 6 Add: The public pedestrian and bicycle path along the Friant-Kern Canal will be deleted from the plan. Page 22, Item 10. Add: Where faults may potentially affect critical or essential facilities, including but not limited to fire stations, hospitals, police stations, government administrative offices and ambulance facilities, should be covered by a specific geologic report prepared for each such location. The Precise Plan for their development shall show building placement compared to open space/parking lots. If necessary, specific geological reports shall be prepared for sites which overlay historical faults. Item #39 would be modified to read, "The applicant shall mitigate the effects of the existing steam cleaning sump to standards set forth by the City of Bakersfield Fire Department, Hazardous Materials Division prior to developing this site or prior to developing residential uses within 300 feet that are located within the project." Creekside shall be designated as a Collector-Alternate Section cur- rently defined in the Subdivision Design Manual. All local streets shall have a minimum right-of-way width of 60 feet. Page 22, Section 8.3.8 and Page 27, Section 10.3.4 - The quantities of development and the applicant's proportionate share of contribution for fire station construction will not be approved with this Specific Plan but will be analyzed at the time the development agreement is amended. Page 25, Section 9.4.3 Final design of lake systems per- tainlng to stormwater runoff shall incorporate methods to prevent initial stormwater flows from polluting the lakes while at the same time benefiting from the dilution capacity from major storm flows. This system shall be approved by the City Engineer. Page 25, Section 9.4.3 Revisions to the PDA shall be approved by the City. Should these revisions require an increase in PDA fees, such increase shall be proportioned over the GPA area only.
