RESOLUTION NO. /+0-90 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF THE ALLEY ON THE SOUTH SIDE OF BRUNDAGE LANE EXTENDING WEST FROM OLIVE STREET, IN THE CITY OF BAKERSFIELD. WHEREAS, on Wednesday, March 21, 1990, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1072 declaring its intention to order the vacation of the alley on the south side of Brundage Lane extending west from Olive Street, in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on WEDNESDAY, APRIL 18, 1!)90, after notices were duly published and posted as required by law. NOW, THEREFORE, BE RESOLVED by the Council of the City of Bakersfield as follows: 1. That the vacation of the alley on the south side of Brundage Lane extending west from Olive Street, in the City of Bakersfield, County of Kern, State of California, more particu- larly described in Exhibit "A" attached hereto and made a part hereof, is unnecessary for present or prospective street or ease- ment purposes. 2. That the vacation of the alley on the south side of Brundage Lane extending west from Olive Street, in the City of Bakersfield, County of Kern, State of California, be and the same is hereby closed up, vacated and abandoned for public street purposes, reservinq the easement for public utilities and munici- pal services in the area to be vacated as described in Exhibit "A," which shall be quitclaimed back to underlying land owner when said owner provides for the relocation of public facilities in the area and grants a new easement to the City for those relocated facilities. Reference to said Resolution of Intention No. 1072 is hereby made for further particulars. 3. That the City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested Dy the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California. S FIEIf~( / --- CITY ATTOR~ or, the City of Bakersfield AJS/meg Attachment Exhibit "A" Exhibit "B" R RES 5 ORDER1072A 4/9/90 EXHIBIT A 6377 1157 All of the remaining portion of the 20-foot wide Pubic alley dedicated on Tract No. 1549 filed May 17, 1950 in Book 7 of Maps, Page 95 in the office of the Kern County Recorder, said alley portion lying between the West right of way line of Olive Street and the Northeasterly right of way line of the State Freeway 99 interchange at State Freeway 58, being more particularly described as follows: Beginning at the point of intersection of the South line of said alley and the West line of Olive Street as shown on Map of said Tract No. 1549; THENCE North 89°54'40" West, along said South line, 127.63 feet to a point on said State Freeway right of way line; THENCE North 49019'37" West, along said right of way line, 30.74 feet to a point on the North line of said alley; THENCE South 89054'40" East, 151.00 feet to a point on said West line of Olive Street; THENCE South 00010'28" East, 20.00 feet to the point of beginning. RESERVING THEREFROM a nonexclusive easement and right of way for public utili- ties and municipal services facilities, to lay, construct, operate, maintain, repair, reconstruct, change the size of or remove pipelines, conduits, cable, wires, poles or any other structures, fixtures or equipment, in, under, across, over and upon the entire above described alley area. 4:E~.3.12 · {30.~0 -35+00 · ~o~ 6377 ~,~,~ 1'_88 20 ~ ST.
