SELECTION OF A BUSINESS FOR
RISK MANAGEMENT AND PREVENTION PROGRAM
Authority:
Chapter 6.95, Article 2, CA Health & Safety Code
Section 25534 requires an Administering Agency (AA) to
make a preliminary determination of the likelihood that a
handler's use of an acutely hazardous material (AHM) poses a
significant accident risk. The definition of an accident
(Section 25532), which could result in significant injury or
death, is not limited to offsite consequences.
If a significant likelihood of an accident is found to
exist, Section 25534 states that the Administering Agency
shall require completion of a Risk Management and Prevention
Program (RMPP). Risks that are found to be remote do not
require a RMPP unless the Administering Agency so chooses.
Estimates of risk are to be based upon worst case
assumptions.
Ranking Method:
Any handler whose use or storage of an AHM exceeds
California's adopted total'planning quantity (TPQ) will be
evaluated for accident risk according to the following
ranking scale. If a mixture containing an AHM component
exceeds the TpQ, the mixture is considered to be an AHM whose
use should be evaluated according to the risk ranking scale.
The rating subscales and rating rational are attached.
1. Facility Risk Index - determined by the
scoring of a facility risk questionnaire.
2. History of Hazardous Materials Inspections - O x 3 =
a percentage based upon the number of violations.
3. Population Exposed - determined by the score
derived by the attached scale.
4. Mass Casualty Potential - taken from the ~-x 1 =
Registry of Chemical Synonyms prepared by
Dr. John Arterberry of the Northridge Toxicology
Center.
5. Toxicity factor.
