On 6 May 1987 we informed the owner of the site of their responsibilities under the Toxic Pits Cleanup Act of 1984 (TPCA). On 22 May 1987 we received a telephone call from Ms Margaret Rosegay-Kott, legal representative for the owner, requesting a re-evaluation of the status of the site with respect to the TPCA. DISCUSSION The TPCA is applicable to surface i~ts in which a liquid hazardous waste or hazardous waste containing free liquids were disc/uarged after 1 January 1987. Applicability .to the TPCA in the case of the M/lham Road Dump Site should be based on the answers to two questions, specifically; 1) Is the site a surface i~t as defined by the Act? 2) Is the material stored at the site a hazardous waste containing free liquids? A surface impoundment is defined by the Act as follows; ";.. a waste management unit or part of a waste management unit which is a natural topogra~c depression, artificial excavation, or. diked area formed primarily of earthen material, although it may be lined with artificial materials, which is desiqned to hold an acommllation of liquid hazardous wastes or hazardous wastes containing free liquids, including, but not limited to, holding, storage, settling, or aeration pits, evaporation ponds, percolation ponds, other ponds, and lagoons. Surface i~t does not include a landfill, a land farm, a pile, emergency con~t dike, tank, or injection well-." (Section 25208.2(i)). The subject site does not appear to have been desiqned to hold an accumulation of liquid hazardous wastes or hazardous wastes containing free liquids. It appears that the site was designed to dispose of a solid waste. MILHA}[ROADDUMPSITE -2- 18 JUNE 1987 The c~aestion of whether the. waste stored at the site contains free liquids must now be addressed. ~he Act :3defines free liquids as ~ follow, s;" .... liquids wb_ich readily separate from the solid portion of a hazardous waste under ambient temperm~ and pressure." (Section 25208.2(w)).. In a memo _z-ur~dum from Edward Anton, Chief Program and Investigations, Division of Water Quality, State Water Resources Control Board, dated 21 March 1986 (attached) the following guidance is presented "... a surface i~t containing solid hazardous wastes is covered by TPCA as soon as it receives water from precipitation or infiltration, flooding, etc. This means that a surface i~t that is being closed (i. e., that is not receiving additional wastes), but contains residual solid hazardous wastes, must comply with the TPCA as soon as it receives a liquid. -For example, a surface impoundment that is not 'teceiv~ discharges but contains residual solid hazardous wastes is subject to the TPCA when liquid enters it." On 12 May 1987, Mr. John Richards, attorney for the State Water Resources Control Board, indicated that a definitive test for free liquids is the Paint Filter Test, EPA Method 9095 (attached). The Paint Filter Test consists of placing 100 ml or 100 g of the material into a conical paint filter (with approximately a 400 micron hole size, i.e. a number 60 paint filter) and determining if any liquid passes through the filter in five minuets. If liquid dose not pass through the filter in the alloted time the material is said to not contain free liquids. The subject site is located in an area which experiences approximately 6 inches of rain a year and has a pan "A" evaporation rate of approximately 65 inches per year. Therefore it appears that the waste material stored at the site would not receive enough liquid through precipitation or infiltration to generate free liquids as defined by t_ha 'Paint Filter Test. CONCIIfSION Upon further review of the site characteristics at the M~lham Road D~ Site, the following ~ been determined: 1) The site w-as not designed to hold an accumulation of liquid hazardous wastes or hazardous wastes containing free liquids. 2) The material' stored at the site would not be classified as a hazardous w-astel containing free liquids by the Paint Filter Test. Therefore the site would not be defined as a surface impoundment by the Toxic Pits Cleanup Act of 1984 and is not subject to the provisions of the Act. MII2fAM RDAD ED/~P SITE -3- 18 JUNE 198- However there is a potential for ground water'quality to be affectgd__ by the material stored at the site. To evaluate the potential or actual threat to ~ water posed by the ~.site the discharger sh~ld be requ]~ed to submit a report containing the following information: 1) A quantification of the_ volume of material stored at the site. 2) A c~lete characterization of the material currently stored at the site. This characterization must include analyses of representative samples for metals (copper, nickel, zinc, and lead) and polychlorinated biphyenls (PCB's). 3) A work plan for a report addressing the potential for the'waste material to affect the beneficial uses of ground water in the area. The work plan and report would be S~bject to our review and approval and must be prepared by a California Registered civil' ~' engineer or geologist? 4) A proposal for the fiDa] deposition of the subject waste material, including disposal method and location. Act of 1984 (TPCA) to the site. We had previously received results of soil analyses preformed by the California Department of' Health Services Hazardous Material Laboratory. The samples were collected by Ms Clair Binder of the Kern County Health Department and were analyzed for total metals and base-neutral priority pollutants. The results indicate that hazardous concentrations of copper, nickel, lead, and zinc were found in the soils from_the site (see attached). The site consists of an excavated area of approximately 2,000 to 3,000 square feet and approximately 4 to 6 feet deep. The excavated area has been filled with what appears to be automobile shredder waste and so the actual depth of the excavation is unknown. The waste consists of bits of rubber and metal. The exCavation was not covered. At the time of my inspection the site did not. appear to have been recently used. A rail road spur crosses the' site to the east. At the time of my inspection several hopper cars were parked on the spur. All of one car and most of another car were filled with what appeared to be shredded metal from automobiles. A record search by the Kern County Health Department indicates that AP 169 - 150 - 01, in which the excavation appears to be located, is owned 'by Mr. Nathan Daniels. ii Milham Road Dump Site '-2- 22 April 1987 SUMMARY: The eXcavation obse~-ved during my inspection would be defined as a 'surface impoundment by section 25208.2(w) of the TPCA. The waste . . disposed of in the surface impoundment contains constituents which ' are defined as hazardous under Title 22 California Administrative Code, section 66694 - 66723. Rainwater has not been precluded from the surface impoUndment. It appears that hazardous waste containing free liquids has been discharged to an unlined surface,impoundment at the site. The purpose of tbj~ letter is to inform you of your responsibilites under the Tt~2A and to schedule the date for submittal of a Hydrogeologic Assessment Report (HAR) as required by the Act. Your responsibilities under the Act include the following: 1. Payment of fees: at this time you are responsible for 'two fees, (a) an initial fee of $1,500 and (b) an annual fee for 1986-87 of $3,000. Instructions for payment of the fees are provid_~d_ in the enclosed form entitled "F~.ardous Waste Surface I~t Fee Transmittal,,. SECITON 25208.8 (c) OF THE HEAT.T~ AND SAF~ CODE. Complainant stated he had observed a truck.dumping material that might be hazardous in the empty field south of his home on Milham Drive. Apparently a truck with a trailer or bed had come'in with a back- hoe and had dug three (3) holes and he believes they dumped some- thing in one of the holes. These holes are about 6ft deep and 10ft long. One of the holes had been covered with loose soil. Samples of soil were taken and you have those results which are high in metals. The excavations had different colored deposits. in the soil. There appears to be various types of deposits of automobiles os other vehicl.es. In discussing the case with staff it was discovered that the empty field extends to the Benham site and the record search shows the same p~rson Nathan Daniels owns the property. There is approximately 1/4 mile between each site. There are no building or boundaries in the area to seperate the property. The property contains rubble, and Some automotive parts such as tires and chrome bumpers. We took over the operation from Chevron Chemical who had operated there many years when we leased and purchased their equipment. Almost at once, we prepared to move to our present location. This move was essentially completed by August of 1974 and we turned over the key to Daniel by November 30, 1974. 2) The products handled in the 340 Daniel Lane address were DD fumigant, NH3, sodium chlorate defolient, liquid fertilizers and Sub-Sol. Products NOT handled by us were pesticides, Treflan, Nemagon, Telon, dry fertilizers, herbicides, mitecides, growth regulators, adjuvants, seeds, micronutrients, and fumigants or soil amendments other than those mentioned. 3) The material which we placed in the two sumps was rinse water from cleaning the fertilizer and chemical transportation tanks. The only trench we recall was an open drain ditch to carry away natural water flow. 4) The best we remember, the sumps and drain ditch were left open for a new tenant who occupied the area soon after our departure. DATE' I~J ' 3.2.2 The groundwater basin consists of a series of ~aguifers, aquitar~s, and aqu~cludes which vary in thickness due to geologic factors The aquifers, which consist primarily of unconsolidate4 alluvial deposits, include- as much as 3,000 feet of fresh water bearing sediments. They constitute an essentially "closed" storage system with little or no outflow of water. Thus the mineral consti- tuents associated with inflowing irrigation water remain after much .of the water is evapotranspired into the atmosphere. Very little'< rainfall enters groundwater storage directly. The aquifers are inter-bedded with silt and clay ~beds , which were deposited as lakebed sediments during prehistoric time. T~ese silt and clay layers prevent- (an aquiclude) or retard (an ~quitard) groundwater flow, causing confined groundwater conditions throughout much of the basin· The most widespread clay formation has been identified as the Corcoran Clay. 3.2.3 Aquifers The uppermost water bearing aquifers are called either uncon![~ned, upper layer or shallow aquifers. These aquifers are open to atmcspheric pressures and a lowering of water levels indicates a reduction in groundwater storage within the aquifer. 3-2 Analysis of water from wells tapping the UnConfined aquifer were 'used to illustrate the unconfined water conditions on the attached p!ates'i .The unconfined aquifer is susceptible to degradation from surface use'of chemicals and the disposal of these substances. The Corc°ran Clay bed created by a former glacial 'lake generally separates the upper layer, uncon'fined aquifer from the lower confined aquifers. Water in the.confined aquifer system is under pressure, thus the water level in a well penetrating a con- fined aquifer often rises to a level above the confining layer. Declines in well water elevations in such wells reflect a decline in · hydraulic head rather than a depletion of water from storage. Although the Corcoran Clay was deposited initially as a nearly horizontal silt bed, it has been tilted in a westward direction and occasionally folded by geologic forces. The depth to the base of the COrcoran Clay base varies from about 400 feet in the area west of Bakersfield to over 900 feet in the area north of Lost Hills. It Is however still recognized, with some difficulty, as the regional clay layer between an upper "unconfined" aquifer, and the system of lower "confined" aquifers. The approximate areal extent of the forcoran Clay layer is shown on PLATES IIIB, IVB, VB, VI, VII, and ';IlIB. The relationship among these aquifers is shown schematically <.in Figure 3-1. 3-3 Contaminants normally enter the groundwater reservoir through the uncOnfined' aquifer system. The vertical distribution of soluble salt contaminants within the confined aquifers and the uncon£ined aquifer is a function both of the geologic-~structure and of irrigation activities. Hydraulic heads between the two aquifer categories vary from less than 50 feet ,to more than 300 feet in parts of one western Valley. Contamination within the confined aquifer of the confining clafs occurs as a result of unconfined aquifer 'leakage" through anomalies ("windows") or permeable sec- tions of the cor~fining clays; or along the western edge of the clays near the trough of' the Valley, where the clay layer thins and "leaKage" over the edges can occur; and as a result of interaquifer ~lows between aquifers through both active and abandoned wells penetrating a'~.d/or perfozated in more than one aquifer. 3.2.4 Gr3undwater Elevation Over the years groundwater elevation information has u~en co:lected by many water districts, companies and agencies in ~ern County.. However, it Was a cooperative well measuring p.rogram est ~Dlisne,i Dy DWR that. has provided a continuing record of s~asonal g[.~.,undwater data. for many years. Data from all wells, regardless of producing aquifers, were utilized in the preparation of this map. These wells as well as major ground- water recharge areas are located on PLATE Il. 'The nighest groundwater elevations appear along the Kern River channel and in the northeastern portion of the study Area. ~'rom these nigh areas, subsurface water flows downhill as indicated~ Dy the arrows, other arrows indicate proDable direction of flow into isolated "low spots". Benham & Johnson occupied the site from the 1950's to 1960. There was present at that time a trench and two sumps which w~re left open when Benham & Johnson ceased operations. The Chevron Chemicalcompany assumed the control of the site and continued operations from 1960 to 1972. When their operations ceased, the sumps and trench were left open for the next occupant, the Buttonwillow Warehouse Company. The Buttonwillow Warehouse Company occupied the site from 1973 to 1974. When they left the site, all sumps and trenches were left open for the use of the. Noerr Motor Freight Company who~trucked for FMC Corporation. Noerr Motor Freight occupied the site from 1974 to 1982. In 1982 Burke and Brown bought the property. Their business is trucking steel pipe to the oilfields. Benham & Johnson were in the fertilizer business. When Chevron Chemical was at the site, they handled fertilizer 10-20, 10-12, 10-3, liquid 11-10 made from 4-10, and UN-32. They also handled pesticides in five gallon tins and fumigants, including D.D.. The unlined trench and sumps received soil fumigants, liquid fertilizer, sulfur solutions, phosphates, and nitrates. Fertilizer trucks were washed and the water was discharged to a pit. Some fertilizer was washed into the city storm water catch basin which lies immediately east and adjacent to the site property. The catch basin measures apprdximately 100 feet in width. The Butt0nwillow Warehouse Company presently handles insecticides, fumigants, fertilizers and weedkillers. Their speciality is pest control and nUtrient services, they handle Union Chemicals. They claim that when they were 340 Daniels Lane the products they handled were D.D. fumigant, anhydrous ammonia, sodium chlorate defolient, liquid fertilizers and Sub-Sol. FMC Corporation's business is agricultural chemicals which were trucked by the Noeer Motor Freight Company. When Burke & Brown bought the property, the trench and sumps were filled with lumber and debris but were still partially open. Burke & Brown levelled the sumps, which required only a small amount of earth due to their being filled, almost to capacity, with debris. On January 6, 1983, a driveby of the site was performed by the Kern Abandoned Site Project.staff. The property was observed to be level and all sumps and trenches were filled. ~. Benham & Johnson %i _ - , D~SCRIPTION OF PROBLEM: The site has. received in the Past wash water from fertilizer trucks, plus nitrates~ phosphates, D.D., sodium chlor.a,te 'defolient, liquid fertilizers and.Sub-Sol. There is a city storm water catch basin adjacent to the property and an unlined canal .05 mile south of the site. The ground water depth is 200 feet and flows in a south- easterly direction. There- are three wells in the area. One lies east at a distance of 1800 feet, one is at a distance of 100 feet' to the southWest, and one at. 4000 feet to the' southeast. The wells in this area have high nitrates)and salinity problems of 1000 ppm. GEOLOGY: The U.S. DePartment of Agriculture describes the area 'to be of the Ca~on-Tujunga association and the Grangeveille-Hesperia association. 'The soils consist, of an overburden of loemy coarse to medium sandy soil with high permeability.~ Subsoils consist of loamy coarse sand with high permeability. S~ne fertilizer was washed into the city storm water ~atch basin which lies immed£a~ely east and adjacent to the site property. ~he ca~ch basin measures approximately 100 feet in width. ~e Butt~ n~l~ow Wareh~u'se Company presently handles insecticides, fumigants, fer~iiizers and weedkillers. Their specialty is pest control and nutrient services. ~ey claim that when they were at 340 Daniels Lane, the products they handled .were D.D. fumygant, snhydrous ammonia, sodium chlorate defoiient, liqui~ fertilizers and Sub-Sol. FMC C~rporation's business is agricultural chemicals which were trucked by the Noeer Motor Freight Company. W~en ~urke & Brown (the prescott owners) b~ugnt .the property, the ~rench and sumps were filled with lumber and debris bu~ were still partially open. Burke & Brown levelled the sumps, whic~ required only a small amount of earth due to their being filled, almos~ to capacity, wi~n debris. On 6 January 1983, a driceby of the site was performe~ by ~he Departmen~ of HeaiCn Services' Abandr, ned Site Project staff. The property was observed ~o be level and all sumps and trenches were filled. The groundwater depth Zs 200 feet and fl~s. in a southeasterly, directi~n. There are three wells in ~he ~rea. One 'lies east at.a distance'of 1800 feet; one at a distance of 100 feet tn the southwest and one 'at 4000 feet to the southeast.
