A RESOLUTION OF THE COUNCIL OF THE
CITY OF BAKERSFIELD DECLARING LABORERS
ON THE HOMELESS FACILITY TO BE T~'(PORAR¥
EMPLOYEES OF THE CITY OF BAKERSFIELD FOR
PURPOSES OF WORKERS' COMPENSATIOn.
WHEREAS, the City of Bakersfield is using voluntary labor
on the construction of the City's homeless facility; and
WHEREAS, the City desires to provide workers'
compensation coverage to the voluntary laborers for any injuries
they may sustain while constructing the homeless facility; and
WHEREAS, Labor Code Section 3363.5 provides that a person
who performs voluntary service without pay for a public agency
shall be deemed to be an employee of that agency for purposes of
workers' compensation upon adoption of a resolution by the
governing body of that agency so declaring.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. The recitals set forth hereinabove are true and
correct;
2. Volunteer laborers while working on the City's
homeless facility shall be considered to be temporary employees of
the City of Bakersfield for purposes of workers' compensation for
any injuries they may sustain while constructing that facility.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on APR 4 ~90 ,
