The above tanks are used in the following: (a) Tank '#1 is used to store oil mix (grade 1 creosote and fuel oil), for use in the treating various deminsions of lumber. It has an 8" line connecting it to the press- ure and fill pumps, It has a 6" line on top which vents to a concrete lined pit. there is line connecting it to tanks 2,3 & 4. (b) Tank #2 is used to store oil mix (grade 1 creosote and fuel oil), for use in treating various deminsions of lumber. It has an 8" line connecting it to the pressure and fill pumps. There is a line on top which vents to a concrete lined pit. It has a 2" line connecting it to tanks 1,3 and 4. (c) Tank #3 is used for receiving and storing of grade 1 creosote. It has a 2" line going into the over-shot. A 3" line connecting it to tanks 1,2 and 4. (d) Tank #4 is used to mix grade 1 creosote with #6 fuel oil (30-70 Mix) for use in'treating variousodeminsions of lumber. It has a 2" line going into the over-shot. A 3" line connecting it to tank 1,2 and 3. (e) Tank #5 is a water storage tank, It collects effluent water from sections of the treating process. It is connected to tank #6 by a 2" line. III. continued (f) Tank #6 is a water storage tank. It contains water used in the treating process, and is the supply water for the cooling tower' It is con- nected to tank #6 by a 2" line and to the cooling tower by a 2" line. IV. Containers designed for storage of combustible or flammable materials must meet the requirements of chapter 1, Title 49 of the code of Federal ~Regulations (DOT Regulations) or NFPA No. 386. V. The levels in all the tanks above ~ill have movement depending upon the particular typ of treatment in progress. As an example: movement in tank #3.'Will-occur if a load of cresote is being received or creosote is being transfered to tank #4 to make a mix. VI. BAKERSFIELD FIRE DEPARTMENT M E M O-RA N D U.M June 26, 2001 TO: Ron Fraze, Fire Chief ce - ~/'~s~ FROM: Ralph Huey, Director of Environmental Servi SUBJECT: Inspection of Pacific Wood Preserving Per our discussion, we completed an inspection at Pacific Wood Preserving of Bakersfield (P.W.P.), located at 5601 District BI., on Tuesday, June 26, 2001. Specifically, this inspection was designed to determine ifP.W.P, has any creosote on site or is using creosote as part of their wood preserving process, as well as obtaining air sample readings on site, and the property perimeter. A review of our files indicates that creosote was eliminated at this facility four years ago. The '.~:'.~ current wood treatment consists of: ' ' ~'· a. Wolmanac Treatment (a chrome, arsenic, copper solution). ~ b. Borate/Boric Acid solution. ~.. c. Dricon (a fire retardant solution). .' '. We found no evidence of c[eo. sote on site 9r any 9regsotertre. at~d wood. According to Mr. Saylor, the Environmental Safety Manager, ~he Currerlt' ii'end for wood preserving is Borate Treatment which is equally harmfi:l to pests but much more environmentally safe iurrently, P.W.P. treats nearly 50 percent of ti~eir wood with Borate process; and the remaining 50 percent split between Wolmanac and the fire retardant process. Air pressure built up in the treatment cylinder instead of vacuum. Air rushed back into the working solution tank. Fluid rammed the tank causing a' 2" rupture. Between 3,000 and 5,000 gallons of .87% CCA was released. 90% of the CCA solution was contained in the secondary containment pit. We find it very beneficial to include more than just the regular inspectiOn station in tours of facilities handling acutely hazardous materials. I will contact you in the next several weeks to reschedule the A sh~ft inspection which was rained out. As we discussed, there are several Lire Code and planning items which require follow up action. I have listed these below'..' 1. The hazardous materials inventory' needs to be updated. Enclosed is an inventory 'form to be used for this purpose. I completed entries regarding the deletion of propane and the revision of creosote's hazardous components. You will need to check these entr es for accuracy and sign the bottom of the page. Please make additional entries for the working solutions of creosote and CCA. Any mixture which contains 1% or more of a hazardous material or 0.1% of a carcinogen must be declared on the haz mat inventory. Check the MSDS for the brown stain to see if it should also be added to the inventory. The material listed as "degreaser aromatic hydroca,rbons benzene" on the existing inventory requires a revised entry. Check '~he MSDS and list the specific hazardous components of this material. 2. Please review, make any necessan) additions and sign the enclosed, revised hazardous materials management plan. I have added ~nformat~on which was submitted ~n the RMPP and the conitmgency plan for Pacific Wood Preserving. 3. Section 80.301 (d) of the 199'1 UFC r;equires aboveground tanks to be placarded with hazard identification signs as Specified in UFC Standard 79-3. These are the diamond shaped signs with hazard Jrating numbers. I have included a copy of 79-3 and 80.301 (d) for your referenbe. Please post the placards so that tlqey are visible from a distance. The firemen have also requested that written labels naming the contents be placed under the placards. Sun Chemical provides a good example of this type of signage. Their tank labeling is visible from District Blvd. if.you would like to take a look. It is important to the firemen to be able to see the labeling from a distance. They do not want to make an approach until the contents of tanks are identified with some certainty. Please post the placards and return the business plan and inventory revisions by March 20, 1992. In the next several months, you will also be receiving notice that your RMPP is due for revision. The law requires revisions to these plans at least every three years. We have recently begun requesting them. Pacific Wood completed the RMPP in 1989 so you will be on the list of those needing to revise. Again, I appreciate all of your cooperation. After looking at the Creosole area we ~assed by the draining location of the CCA and noticed the liquid and sludge along the tracks, at that point we noticed an emoloyee sweeping uo solid dry material in the same area that the wood is draining, that has been treated with the arsenic pentoxide. Our concern fs what the total contaminants of arsenic was before and after drying in an around the area. Mr. Huey asked you if we could take some samples, we took two (2~ samoles, one II~ liquid and one II~ sludge. Your memo also stated you have had difficult getting any sdvice or industry standards concerning Risk Management and Prevention Programs (RMPP's) or Hazard Operability Studies (HAZOP's).. May I suggest thst perhaps you are not looking in the right place. The Risk Management and Prevention Program required by your facility is a State of California requirement commonly understood by a variety of Engineering Consultant firms. Guidelines were supplied to your company on July 18, 1988. I am enclosing, for your information, however the most recent guidelines supplied by the State Office of Emergency Services. However, I am bewildered by your apparent lack of concern or lack of a sense of timeliness of the project. You were notified July 18, 1988 of the RMPP requirements. The report that was furnished was found to be inadequate and on October 6, 1989 you were informed of those inadequacies and requested to correct and resubmit by December 11, 1989. Today I received your memo dated November 29, 1989, basically stating you do not know how to complete a RMPP. Don, the Health and Safety Code clearly spells out the civil liability for violating this section of the code as $2,000.00 for each day in which the violation occurs. You need to put together a comprehensive plan for how and when you will be able to complete a satisfactory Risk Management and Prevention Program. You then need to review that proposal with this office and obtain an extension if you are unable to meet the current requirement date of December 11, 1989. Finally your memo requests information on other Risk Management Plans that have been received by this office. Three other plans have been submitted by businesses in your area (i.e., on District Boulevard). These businesses are: The New Carnation Dairy Company Ice Cream Processing Facility at 7301 District Boulevard; North American Roto Engravers, Inc. at 4517 District Boulevard; and Gist-Brocades Food Ingredients, Inc.' 5455 District Boulevard. This should include a detailed list of all piping, valves, tanks and equipment used to handle the acutely hazardous materials. Two oil producing wells are located immediately south of the railroad spur located behind the southern border of the Property. No other producing wells are located within an 0.5 mile radius of the Property. 5.0. Ralph Huey, City of Bakersfield Fire Department, was contacted regarding the completion of Hazardous Materials Business Plans by other sites near the Property. The California Department of Health Services, Toxic Substances Control Division, .Expenditure Plan For The Hazardous Substance Cleanup Bond Act Of 1984, Revised January, 1988, Revision No. 3, Volume 1 was reviewed for hazardous waste sites within 1.0 mile of the Property. No State Superfund Sites or other Hazardous Waste Sites were listed. 9.0. Don Plain, California Department of Health Services (DHS), Abandoned Sites Program, was contacted regarding any reported violations or deficiencies on the Property, permit status of the Property, and any reported spill cases or other hazardous waste sites within a one mile radius of the Property. i DHS has not inspected the Property. The Property has not been permitted by DHS and no violations or deficiencies have been fried with this agency. · There are no reported underground fuel 16ak cases on the Cortese List which are likely to impact groundwater within a one mile radius of the Property. ° There are no methane zones within a one mile radius of the Property. ° The Governor's Office of Planning and Research (OPR) Hazardous Waste and Substances Sites List was reviewed for identified Hazardous Waste Sites in Bakersfield. No sites were listed within a one mile radius of the Property. · One site within one mile of the Property is documented .with the Abandoned Sites Program Information System (ASPIS) List. This site is presented belOw: Site ~ Address Nalco Chemical 4851 Stine Road Pacific Wood Preserving of Bakersfield : October 30, 1989 EES Project No. 7502 Page 4 According to the ASPIS unit of DHS, a preliminary site assessment of Nalco Chemical was required by DHS in 1987. Subsequent to the assessment, the Central Valley Regional Water Quality Control Board (RWQCB) required a hYdrogeological investigation at Nalco. Further conversations about this site with Dale Hoverman, DHS Duty Officer, and Scott Moore, RWQCB, revealed that Nalco Chemical has been placed on the RWQCB Toxic Pits Control Act (TPCA) list. Nalco Chemical blends scale and corrosion inhibitors at the Stine Road site. Waste water from the blending process was formerly stored in a surface pond at the facility. Leakage of waste water from this pit has impacted soils under the site. The RWQCB requested that a hydrogeological investigation be completed to define the lateral and vertical extent of contamination. According to Mr. Moore, the most recerit analytical results filed with the RWQCB indicate that contamination from the surface pond is confined to the upper 20 feet of soil below the site. Because of the depth of groundwater under the site and the direction of groundwater flow, this site is unlikely to impact groundwater quality under the Property. 10.0. Regarding the cracked concrete and potential for contamination of soil underneath the concrete pad on the Property, no evidence of contamination was observed around the cracks. -However, it is'posSible that contamination does exiSt below the cracked area. EES cannot qualify or warranty 'soil conditions below the cracked concrete because evidence of contamination was not visible on the concrete surface at the time of the site inspection. After looking at the Creosole area we passed by the draining location of the CCA: and noticed the liquid and sludge along the tracks, at that point we noticed an employee sweeping up solid dry material in the same area that the wood is draining, that has been treated with the arsenic pentoxide. Our concern is what the total contaminants of arsenic was before and after drying in an around the area. Mr. Huey asked you if we could take some samples, we took two (2) samples, one (1) liquid and one (1) sludge. Approximatly 95% of the solution was recovered in the sealed pit below the cylinder. A small portion did get on the ground. Help was called in and clean up was started immediately. IMMEDIATELY AFTER THE SPILL IS DETECTED, A LOCAL CONTRACTOR WILL BE SUMMONED TO REMOVE ANDY STANDING LIQUIDS AND HAUL THE SPILLED MATERIAL TO A FACILITY APPROVED TO HANDLE THAT PARTICULAR WASTE. IF FOR SOME REASON A CHEMICAL SPILL IS NOT CONTAINED WITH IN A DIKE OR SUMP AREA, AN AREA OF ISOLATION WILL BE ESTABLISHED AROUND THE SPILL . THE SIZE OF THE AREA WILL GENERALLY DEPEND ON THE SIZE OF THE SPILL AND THE MATERIALS INVOLVED. IF THE SPILL IS LARGE AND INVOLVES A TANK OR A PIPELINE RUPTURE, AND INITIAL ISOLATION OF A LEAST 100 FT. IN ALL DIRECTIONS WILL BE USED. SMALL SPILLS OR LEAKS FROM A TANK OR PIPE WILL REQUIRE EVACUATION OF AT LEAST 50 FT. IN ALL DIRECTIONS TO ALLOW CLEAN-UP AND REPAIR AND TO PREVENT EXSPOSURE. WHEN ANY SPILL OCCURS, ONLY THOSE PERSONS 'INVOLVED IN OVERSEEING OR PERFORMING EMERGENCY OPERATIONS WILL BE ALLOWED WITHIN THE DESIGNATED AREA. IF POSSIBLE THE AREA WILL BE BLOCKED OFF. WIDE AND 1000 FT LONG WILL BE EVACUATED DOWNWIND IF VOLATILE MATERIALS ARE SPILLED. IF THE EMERGENCY COORDINATOR DETERMINES THAT THE COMPANY IS UNABLE TO HANDLE THE EMERGENCY, THEN LOCAL, STATE, FEDERAL AUTHORITIES WILL BE NOTIFIED OF THE SITUATION. ALSO AVAIZABLE FOR FIRE CONTROL ARE PORTABLE FIRE EXTINGUISHSERS AT LEAST ONE EXTINGUISHER IS LOCATED IN EAC'H OF THE FOLLOWING AREAS: o LUMBER INCISOR o MAIN OFFICE BUILDING o A AND B MACHINE o CREOSOTE PLANT AT PUMPS o CREOSOTE PLANT LAB ALL EXTINGUISHERS COMPLY WITH NATIONAL FIRE CODE STANDARDS FOR PORTABLE FIRE EXTINGUISHERS, AND THEY ARE INSPECTED AFTER EACH USE OR AT LEAST MONTHLY. PACIFIC WOOD PRESERVING OF BAKERSFIELD CONTINGENCY PLAN CONTINUED EVACUATION PLAN ALL EMERGENCIES REQUIRE PROMPT AND DELIBERATE ACTION. IN THE EVENT OF ANY MAJOR EMERGENCY, IT WILL BE NECESSARY TO FOLLOW AN ESTABLISHED SET OF PROCEDURES.
