IN THE INSPECTION OF YOUR BUSINESS ~E. B. .BODY WORKS

93305 ON JUNE 2ND THE FOLLOWING HAZARDOUS MATERIALS
REGULATION VIOLATIONS WERE IDENTIFIED.:
1) IlAZARDOUS'~iATERIALS WERE PRESENT BUT NO HAZARDOUS

VIOLATION OF CH. 6.95 CALIFORNIA HEALTH AND
SAFETY CODE SEC. 25503.5
(a) Any business~ except as provided in subdivision
(b), ;~hich handles a hazardous material or mixture
containing a hazardous material ~:hich has a ~uantity at
any one time during the reporting year equal to, or
gl?eater than, a total ~eight of 500 pounds, or a total
volum. D of 55 gallons, or 200 cubic feet at standard
temperature and pressure for a compressed gas, shall
establish and implement a business plan for emergency

2) VAI~IOUS OPEN AND UNLABELED WASTE OIL CONTAINERS LOCATED
THROUGHOUT SHOP AREA
VIOLATION OF oSHA 1910.1200
(1) The chemical manufacturer, importer, or
distributor shall ensure that each container of
hazardous chemicals leaving the ,~orkDlace is labeled,
tagged or marked with the follow, lng information:
(i)Identity of the hazardous chemical(s).
(ii)Appropriate hazard warnings; and
(iii)Name and address of the chemical
manufacturer; i"~porter, or other responsiblle
party.
(4) Except as provided in paragraphs ('3) and (,l)
the employer shall ensure that each container of
hazardous.chemicals in the workplace is labeled, tagged,
or marked with the following information:
(i)Identity of the hazardous chemical(s)
contained therein; and
(ii)Appropriate hazard ~arnings.
( 5 ) The emplo,~'er may use signs, placards , process
sheets, batch tickets, operating procedures, or other
such ~,~ritten materials in lieu. of affixing .labels to
individual stationary process containe'rs, as long as tile
alternative method identifies 'the containers to .~hich it
is applicable and conve~-s the information required b~:
~aragraph (2) of this section to be on label. The
~ritten materials shall be readily accessible to the
employees in their work area'throughout each ~qork Shift.
(7) The employer shall not remove of deface
existing labels on incoming containers of hazardous
chemicals, unless the container is immediately marked
~.~ith the required information.
(8) The employer shall ensure that labels or other
forms of warnings are legible, in English, and
prominen.tl,7- displayed on the container, or readil.%~
available in the ~ork area throughout each ,,~o]:'k sh. if't.
Emplo~ers having employees ~'ho speak other languages may
ad.d the information in their language 'to the material
presented, as long as the information is presented in
English as well.
3) COHFRESSED GAS CYLINDER NOT PROPERLY RESTRAINED VIOLATION OF UFC 74.107
(a) General. All compressed gas cylinders in
service or 'in storage-shall be adequately secured ~o
~revent falling or being knocked over.
EXCEPTIONS: ( 1 ) Compressed gas cylinders in
the process of examination, servicing and refilling
are exempt from this section.
(2) Medical gas cylinders may be stored and
used in' the horizontal position in accordance ~,,'ith
nationally recognized standards.

'Defective containers which permit leakage or
spillage .shall be disposed of or repaired in accordance
with recognized safe practices; no spilled material
shall be allowed to accumulate On floors or shelves.-

VIOLATION OF UFC 79.201(C)
I Empty Containers. The storage' of empty tanks and
" containers previously used for the storage of flammable
or combustible liquids', unless free from ex¥)losive
... vapors, shall be as specified for the storage of
i' flammable liquids. Tanks and containers when emptied~
shall_ have the covers or plugs immediately replaced in
openings.

disposed of, or transported out of the state, as a
hazardous' waste in accordance with this chapter".
"Section 25250.5 Disposal of used oil by
disc,barge to sewers, drainage systems, surface or
groundwaters, h~atercourses, or marine waters; by
i_ncineration of burning as fuel.; or by deposit on .land,

weed control agent is prohibited".

"(c) The disposal of untreated hazardous waste in
or onto land without, adequate technical safeguards
threatens not only' the quality of the state's land,
air, and water resources, but poses a direct hazard to
health and safety by exposing the public to substances
. that have been found to cause cancer, birth defects,
miscarriages, nervous disorders, blood diseases, and
damage to vital organs and genes".
The above violations must be corrected by JUNE IOTII 1988

SAFETY CODE SEC.25503.5
(a) Any business, except as provided in subdivision
(b), which handles a hazardous material or mixture
containing a hazardous material which has a quantity a't
any offe time during the reporting year equal to, or
'greater than, a total weight of 500 pounds, or a total
volume of 55 gallons, or 200 cubic feet at standard
temperature and pressure for a compressed gas, shall
establish and implement a 'business plan for emergency
response to a release or threatened release of a
hazardous material in accordance with the standards in
the regulations adopted pursuant to Section 25503.
2) VARIOUS OPEN AND UNLABELED WASTE OIL CONTAINERS LOCATED
THROUGHOUT SHOP AREA
VIOLATION OF OSHA 1910.1200
(1) The chemical manufacturer, importer, or
distributor shall ensure that each container of
hazardous chemicals leaving the workplace is labeled,
tagged.or marked with the following information:
(i)Identity of the hazardous chemical(s).
(ii)Appropriate hazard warnings; and
(iii)Name and address of the chemical
manufacturer, intporter, or other responsible
party ~
(4) Except, as provided in paragraphs (3) and (4)
the employer shall ensure that each container of
hazardous chemicals in the workplace is labeled, tagged,
or marked with the following information:
(i)Identity of the hazardous chemical(s)
contained therein; and
(ii)Appropriate hazard warnings.
(5) The employer may use signs, placards, process
slicers, batch tickets,-operating procedures, or o'tber
such written materials in lieu of affixing .labels to
individual stationary process containers, as long as the
alternative method identifies the containers to which it
is applicable and conveys 'the information required by
paragraph (2) of this section to be on la'bel. The
written materials shall be readily accessible to. the
employees in their work area throughout each work shift.
(7) The employer shall not remove of deface
existing labels on incoming containers of hazardous
chemicals, unless %he container is immediately marked
with the required information.
(8) The employer shall ensure that labels or other
forms of warnings are legible, irt English, and
prominently displayed on the container, or readily'
available in the work area throughout each work shift.
Emplo};ers having employees who speak other languages may

presented, as long as the information is presented in

3) CO~FRESSED GAS CYLINDER NOT PROPERLY RESTRAINED VIOLATION OF UFC 74.107
(a) General. All compressed gas cylinders in
service or in storage shall be adequately secured to
prevent falling or being knocked over.
EXCEPTIONS: (1) Compressed gas cylinders in
the process of examination, servicing and refilling
are exempt from this section.
