A RESOLUTION DISPENSING WITH BIDDING PROCEDURES DUE TO EMERGENCY
CLEANUP REQUIRED FOR SANITARY SEWER SPILL AT THE CORNER OF McCUTCHEN
ROAD AND GOSFORD ROAD, NOT TO EXCEED $210,906
WHEREAS, on Wednesday evening, June 16, 2004, the sewage pump system at
Wastewater Treatment Plant No. 3 malfunctioned and shut down the pumps; and
WHEREAS, Wastewater Division staff was not informed of the failure by the alarm
monitoring company; and
WHEREAS, in the early morning of Thursday, June 17, 2004, approximately 500,000
gallons of wastewater overflowed the collection system at the corner of McCutchen and Gosford
Roads; and
WHEREAS, the Public Works Director was informed that the clean-up required outside
services and disinfection chemicals to be purchased; and
WHEREAS, the Public Works Director declared this problem an emergency and the
work to be performed was of urgent necessity for the preservation of life, health or property; and
WHEREAS, the nature of clean-up and the potential liability to the City, required the use
of outside forces and disinfection chemicals to perform the clean-up in a timely manner; and
WHEREAS, to remedy this emergency, the Public Works Director authorized vacuum
trucking and earthworking services on a time-and-materials basis to remove the spilled
wastewater, export the impacted soil, import clean fill and dispense chemicals necessary to
disinfect the area. The Public Works Director also authorized other expenses required for this
emergency.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are true and correct and incorporated herein by reference.
City Council hereby determines that based on the above recitals, the work
performed was of urgent necessity for the preservation of life, health or property,
thereby allowing the dispensing of bidding requirements as set forth in Section
136 of the City Charter and Section 3.20.060 of the Bakersfield Municipal Code.
The Finance Director is authorized to dispense with bidding in accordance with
Section 3.20.060 of the Bakersfield Municipal Code.
